The FBI confiscated six drones in Atlanta for flying too close to the football stadium where the Super Bowl will be played Sunday, Reuters reports: Drone flight was prohibited on Saturday and from 10 a.m. until 5:30 p.m. EST on Sunday for one nautical mile (2 km) around the Mercedes-Benz Stadium and up to an altitude of 1,000 feet (305 meters), the Federal Aviation Administration said. The FAA will establish temporary flight restriction that prohibits drones within a 30-nautical-mile radius of the stadium and up to 17,999 feet in altitude from 5:30 p.m. to 11:59 p.m. EST on Sunday, the agency said. ..
Drones "are a big concern," said Nick Annan, Homeland Security Investigations special agent in charge. "There are a few other things that are in place to mitigate drones," he added without elaborating. Operators who send drones into restricted areas around the Mercedes-Benz Stadium could face more than $20,000 in civil penalties and criminal prosecution, according to the FAA.
Drone pilots are advised to check the FAA's B4UFly app to check when and where they can fly -- and the aviation agency has also produced a slick 20-second video "encouraging Super Bowl fans to bring their lucky jerseys, face paint and team spirit to the game -- but leave their drones at home -- because the stadium and the area around it is a No Drone Zone." -

FAA Moves Toward Treating Drones and Planes As Equals (hackaday.com)
Hackaday's Tom Nardi writes about the Federal Aviation Administration's push to repeal Section 336, which states that small remote-controlled aircraft as used for hobby and educational purposes aren't under FAA jurisdiction. "Despite assurances that the FAA will work towards implementing waivers for hobbyists, critics worry that in the worst case the repeal of Section 336 might mean that remote control pilots and their craft may be held to the same standards as their human-carrying counterparts," writes Nardi. From the report: Section 336 has already been used to shoot down the FAA's ill-conceived attempt to get RC pilots to register themselves and their craft, so it's little surprise they're eager to get rid of it. But they aren't alone. The Commercial Drone Alliance, a non-profit association dedicated to supporting enterprise use of Unmanned Aerial Systems (UAS), expressed their support for repealing Section 336 in a June press release: "Basic 'rules of the road' are needed to manage all this new air traffic. That is why the Commercial Drone Alliance is today calling on Congress to repeal Section 336 of the FAA Modernization and Reform Act of 2012, and include new language in the 2018 FAA Reauthorization Act to enable the FAA to regulate UAS and the National Airspace in a common sense way."
The 2018 FAA Reauthorization Act does not simply repeal Section 336, it also details the new rules the agency would impose on unmanned aircraft and their operators. Under these proposed rules, all unmanned aircraft would be limited to an altitude of 400 feet unless they have specific authorization to exceed that ceiling. They must also be operated within line of sight at all times, effectively ending long-range First Person View (FPV) flying. There's also language in the Reauthorization Act about studying the effects of flying unmanned aircraft at night, or over groups of people. It also states that drones, just like traditional aircraft, must be registered and marked. It even authorizes the FAA to investigate methods of remote identification for drones and their operators, meaning it's not unreasonable to conclude that RC aircraft may be required to carry transponders at some point in the future. To many in the hobby this seems like an unreasonable burden, especially in the absence of clear limits on what type of small aircraft would be excluded (if any). The report also notes that the 2018 FAA Reauthorization Act will require drone operators to have to pass an "aeronautical knowledge and safety test," and to show proof of their passing to any law enforcement if questioned. Also with the repeal of Section 336, "young people might actually be excluded from flying remote-controlled aircraft," Nardi writes. "While many RC planes and quadcopters are marketed as children's toys, in the absence of Section 336, it's not clear that a child could legally operate one. The FAA requires a person to be 16 years of age to obtain a pilot's license, and if unmanned aircraft are truly expected to obey the same 'rules of the road,' it's not unreasonable to assume that age requirement will remain in effect." -
Airlines Restrict 'Smart Luggage' Over Fire Hazards Posed By Batteries (npr.org)
An anonymous reader quotes a report from NPR: Airlines including American, Delta and Alaska have announced restrictions on so-called smart luggage because the lithium-ion batteries found in many of these suitcases pose a fire risk. "Beginning Jan. 15, customers who travel with a smart bag must be able to remove the battery in case the bag has to be checked at any point in the customer's journey. If the battery cannot be removed, the bag will not be allowed," American said in a statement on Friday. The same day, Delta and Alaska announced similar policies on their flights.
American's policy dictates that if the bag is carry-on size, passengers can take the luggage onboard, so long as the battery can be removed if needed. If passengers need to check the bag, the battery must be removed and carried onboard. But if the bag has a non-removable battery, it can't be checked or carried on. An FAA spokesman told The Washington Post that the airlines' policies are "consistent with our guidance that lithium-ion batteries should not be carried in the cargo hold." -

An anonymous reader quotes a report from The Verge: Today, President Donald Trump endorsed a plan to hand over oversight of the nation's airspace to a non-profit corporation that will likely be largely controlled by the major airlines. Republicans argue that privatizing air traffic control will help save money and fast track important technological upgrades. But Democrats and consumer groups criticize that plan as a corporate giveaway that will inevitably harm passengers. The air traffic reform proposal, which fell short in Congress last year, would transfer oversight from the Federal Aviation Administration (FAA) to a government-sanctioned, independent entity that would be made up of appointees from industry stakeholders. The effort picked up steam when the union representing air traffic controllers endorsed the plan, citing years of understaffing by the FAA. Some passengers may balk at the idea of handing over day-to-day management of the nation's highly complex air traffic control system to the same companies that rack up tens of thousands of customer complaints a year, and occasionally physically assault or drag passengers off their planes. But the Trump administration argues this is the only way to modernize a system that still runs on technology that's been around since World War II. The FAA is already years into a technology upgrade known as NextGen, which involves moving from the current system based on radar and voice communications to one based on satellite navigation and digital communications. The FAA wants to use GPS technology to shorten routes, save time and fuel, and reduce traffic delays by increasing capacity. -
FAA Warns More Drones Are Flying Near Airports (fortune.com)
Between February and September of 2016, there were 1,274 reports of drones near airports -- versus just 874 for the same period in 2015, according to newly-released FAA research. "The report detailed more than 1,200 incidents of airplane pilots, law enforcement, air traffic controllers, and U.S. citizens reporting drones flying in places they shouldn't," writes Fortune. An anonymous reader quotes their report: One of takeaway of the report was that while the FAA has received several reports from pilots that drones may have hit their aircraft, the administration was unable to verify any such claim. "Every investigation has found the reported collisions were either birds, impact with other items such as wires and posts, or structural failure not related to colliding with an unmanned aircraft," the FAA said in a statement... Although a drone hasn't smashed into an airplane yet, the FAA "wants to send a clear message that operating drones around airplanes and helicopters is dangerous and illegal. Unauthorized operators may be subject to stiff fines and criminal charges, including possible jail time," the FAA said. -

What's expected to produce a 30-fold increase in a matter of months is a new rule that went into effect today and makes it easier to become a commercial drone operator. Broadly, the new rules change the process of becoming a commercial drone pilot: Instead of having to acquire a traditional pilot's license and getting a special case-by-case permission from the regulators, drone operators now need to pass a new certification test and abide by various flying restrictions (and, well, be older than 16). The rest of the drone safety rules still apply: No flights beyond line-of-sight, over people, at night, above 400 feet in the air or faster than 100 miles an hour. Drones also can't be heavier than 55 pounds, and all unmanned aircraft have to be registered. Businesses, however, may get special wavers to skip some of the restrictions if they can prove they can do so safely. The drone association expects the industry will create more than 100,000 jobs and generate more than $82 billion for the economy in the first 10 years of being integrated into the national airspace. New FAA Rules Allow US Companies To Fly Drones Without a Pilot's License (faa.gov)
On Tuesday, the Obama administration announced new rules for commercial drones. It states that drone pilots can now fly without waiting to get permission from the government. Previously, commercial operators were required to apply for a waiver from the FAA to operate small drones for commercial purposes. According to the new regulation, a drone must weigh less than 25kg, and it must fly under 400 feet (122m) and at a maximum speed of 161km per hour. DJI spokesman Adam Lisberg said: This is a major development for the future of drones in America. It means that businesses and farmers and government agencies and academic researchers can put drones to work without having to get an airplane pilot's license or follow other onerous rules. Those were pretty high barriers to entry. Part 107 is a vote of confidence from the FAA that drones can be safely integrated into the national airspace, and that a wider adoption of drones for all sorts of non-recreational uses will bring real benefits to America.More coverage on The Verge, and Reuters. -

An anonymous reader writes: It will now be easier for students to pilot drones as part of their schoolwork, thanks to new Federal Aviation Administration rules that exempt high schools and colleges from the more stringent aircraft regulations placed on businesses. In a memo released Wednesday outlining the new guidelines, federal regulators have designated drone schoolwork as a hobby or recreational -- as opposed to commercial -- activity, allowing students for the first time to fly unmanned aircraft without a pilot's license or special authorization from the government. "Schools and universities are incubators for tomorrow's great ideas, and we think this is going to be a significant shot in the arm for innovation," said FAA Administrator Michael Huerta during a drone conference in New Orleans. But the agency's policy prohibits teachers from being the primary operators of unmanned aircraft, because they are paid for their work and therefore "would not be engaging in a hobby or recreational activity" while flying a drone. (They can, however, pilot drones in a limited way -- in case of emergency, for instance.) -

Earlier this month a drone even performed the first FAA-sanctioned drone delivery to an urban area, carrying food, water and a first-aid kit in a box attached to a rope, while a team led by a 15-year-old pilot won the $250,000 first-place prize in the first World Drone Prix in Dubai. The FAA logged 538 drone incidents in the U.S. over the last six months, according to a new report released Friday, including hundreds of incidents in which drones approached airports. But while one incident involved a drone within 20 feet of a plane, "the majority of the incidents are minor," reports The Verge, "with pilots or bystanders reporting drones that are flying in restricted airspace without necessarily endangering anyone." -
FAA: Small Drones Must Be Registered By February (bloomberg.com)

Starting on 21 December, all newly-purchased drones between 250 grams (.55 lbs) and 25 kg (~55 lbs) must be registered before their first flight. Owners of drones purchased before that time must register by 19 February 2016. The FAA will charge $5 to register the drones, though the first month of registrations will be free. "Make no mistake: unmanned aircraft enthusiast are aviators, and with that title comes a great deal of responsibility," said U.S. Transportation Secretary Anthony Foxx. "Registration gives us an opportunity to work with these users to operate their unmanned aircraft safely. I'm excited to welcome these new aviators into the culture of safety and responsibility that defines American innovation." There is also an age requirement: kids under the age of 13 will not be allowed to register a drone by themselves. Walmart Applies To Test Drone Use For Delivery and Inventory Checking (faa.gov)

The tests are to include not only home delivery — with the permission of residents within the 'flight path' — but also inventory-checking procedures at Walmart parking lots. It only costs $5 to make an application of this nature to the FAA, and until some hint of concrete legislation comes to light from the newly-formed UAS task force on November 20th, that's probably about as much as any company would want to spend on speculative drone-delivery research. -
FAA Proposes $1.9 Million Fine For Unauthorized Drone Use
An anonymous reader writes: The U.S. Federal Aviation Administration has been under pressure to regulate the nascent drone industry. It's obvious they lack a clear idea of how to proceed — but they're trying. Today they announced a proposal to fine SkyPan International a whopping $1.9 million for allegedly conducting 65 unauthorized commercial drone flights over Chicago and New York City. The flights occurred over a period of almost three years, for the purpose of aerial photography. 43 of the flights impinged upon highly restricted airspace, and the FAA says none of them were "without risk." They bluntly allege that SkyPan "operated the aircraft in a careless or reckless manner so as to endanger lives or property." SkyPan now has 30 days to respond. -
Air Traffic Snafu: FAA System Runs Out of Memory
minstrelmike writes: Over the weekend, hundreds of flights were delayed or canceled in the Washington, D.C. area after air traffic systems malfunctioned. Now, the FAA says the problem was related to a recent software upgrade at a local radar facility. The software had been upgraded to display customized windows of reference data that were supposed to disappear once deleted. Unfortunately, the systems ended up running out of memory. The FAA's report is vague about whether it was operator error or software error: "... as controllers adjusted their unique settings, those changes remained in memory until the storage limit was filled." Wonder what programming language they used? -
FAA Has Approved More Than 1,000 Drone Exemptions
coondoggie writes: The Federal Aviation Administration today said it has issued 1,008 exemptions to businesses wanting to fly unmanned aircraft in the national airspace. Such small drones have been on the bad side of the news in the past few days: there have been at least three complaints about the diminutive aircraft flying near the flight path of JFK airport in New York. All three of the flights landed safely but the events prompted New York Senator Charles Schumer to call for "tougher FAA rules on drones," as well as geofencing software that could prohibit a done from flying higher than 500 feet, and keep it two miles away from any airport or sensitive area. -

In March they were finally given permission to test a drone they had developed six months prior, and they said the drone was already obsolete. Their complaints appear to have worked — yesterday, the FAA gave permission to test a new, updated delivery drone. According to the FAA's letter (PDF), the drone must stay at an altitude of less than 400 feet and at speeds of less than 100 mph. -

An anonymous reader sends this report from the NY Times: In an attempt to bring order to increasingly chaotic skies, the Federal Aviation Administration on Sunday proposed long-awaited rules on the commercial use of small drones, requiring operators to be certified, fly only during daylight and keep their aircraft in sight. The rules, though less restrictive than the current ones, appear to prohibit for now the kind of drone delivery services being explored by Amazon, Google and other companies, since the operator or assigned observers must be able to see the drone at all times without binoculars. But company officials believe the line-of-sight requirement could be relaxed in the future to accommodate delivery services. -

MIT researcher Hamsa Balakrishnan and her team are making air traffic control systems more efficient through a combination of better models and new embedded technologies. Testing their algorithms at Logan Airport in Boston, they showed that by holding aircraft back for 4.5 minutes, they could improve flow on the runways and save nearly 100 pounds of fuel for each aircraft. -
SpaceX Wins FAA Permission To Build a Spaceport In Texas
Jason Koebler writes SpaceX just got approval from the Federal Aviation Administration to build a 56.5-acre spaceport along the Gulf of Mexico on the Texas-Mexico border—a huge step toward actually making the spaceport a reality. Wednesday, the FAA, which handles all commercial space launch permitting in the United States, issued what's known as a "Record of Decision" that suggests the agency would allow the company to launch 10 Falcon 9 rockets and two Falcon Heavy rockets per year out of the spaceport, through at least 2025. -
FAA Bans Delivering Packages With Drones

The revelation was buried in an FAA document (PDF) unveiled Monday seeking public comment on its policy on drones, or what the agency calls "model aircraft." The FAA has maintained since at least 2007 that the commercial operation of drones is illegal. ... In Monday's announcement, published in the Federal Register, the FAA named Amazon's December proposal as an example of what is barred under regulations that allow the use of drones for hobby and recreational purposes. The agency did not mention Amazon Prime Air by name, but it didn't have to. Under a graphic that says what is barred, the FAA mentioned the "Delivering of packages to people for a fee." A footnote added, "If an individual offers free shipping in association with a purchase or other offer, FAA would construe the shipping to be in furtherance of a business purpose, and thus, the operation would not fall within the statutory requirement of recreation or hobby purpose." -

Divers have been searching for the drone. What's more, the drone is reportedly over the FAA's 25-pound weight limit, so they shouldn't have been flying it in the first place (the Chronicle says 49 pounds, the Montgomery County Police Reporter says 29 pounds — either way, it's too heavy). Hugh Pickens DOT Com (2995471) writes "Hasani Gittens reports that as miraculous as it was that a 16-year-old California boy was able to hitch a ride from San Jose to Hawaii and survive, it isn't the first time a wheel-well stowaway has lived to tell about it. The FAA says that since 1947 there have been 105 people who have tried to surreptitiously travel in plane landing gear — with a survival rate of about 25 percent. But agency adds that the actual numbers are probably higher, as some survivors may have escaped unnoticed, and bodies could fall into the ocean undetected. Except for the occasional happy ending, hiding in the landing gear of a aircraft as it soars miles above the Earth is generally a losing proposition. According to an FAA/Wright State University study titled 'Survival at High Altitudes: Wheel-Well Passengers,' at 20,000 feet the temperature experienced by a stowaway would be -13 F, at 30,000 it would be -45 in the wheel well — and at 40,000 feet, the mercury plunges to a deadly -85 F (PDF). 'You're dealing with an incredibly harsh environment,' says aviation and security expert Anthony Roman. 'Temperatures can reach -50 F, and oxygen levels there are barely sustainable for life.' Even if a strong-bodied individual is lucky enough to stand the cold and the lack of oxygen, there's still the issue of falling out of the plane. 'It's almost impossible not to get thrown out when the gear opens,' says Roman.
So how do the lucky one-in-four survive? The answer, surprisingly, is that a few factors of human physiology are at play: As the aircraft climbs, the body enters a state of hypoxia—that is, it lacks oxygen—and the person passes out. At the same time, the frigid temperatures cause a state of hypothermia, which preserves the nervous system. 'It's similar to a young kid who falls to the bottom of an icy lake," says Roman. "and two hours later he survives, because he was so cold.'" -

Now a team of Italian researchers from the HCI Lab of the University of Udine has publicly released the first in a set of aviation safety apps on which they are working. Their mission is to propose novel, first-of-their-kind solutions to a well-known problem in aviation safety: passengers lack preparedness about what to do in aircraft emergencies, and do not pay attention or do not clearly comprehend the pre-flight briefings and safety cards used by airlines to instruct them about safety. So the project is re-inventing safety cards and briefings with new media, turning them into games and apps. The first game they decided to release focuses specifically on the 'Brace for impact' position: players can pose the body of their avatar in the 3D airplane cabin and get a personalized simulation of a crash landing . FAA OKs US UAVs
Two unmanned aerial vehicles have received approval from the Federal Aviation Administration to perform commercial operations in United States airspace. The Scan Eagle 200 from Insitu will be launched from a ship and used to monitor icebergs and migrating whales in parts of the Arctic where companies are looking for oil. The PUMA from Aerovironment will be used by emergency response teams for monitoring oil spills. (Both are referred to as unmanned aircraft systems, or UAS, by the Administration.) "Issuing the type certificates is an important step toward the FAA's goal of integrating UAS into the nation's airspace. These flights will also meet requirements in the FAA Modernization and Reform Act of 2012 that define Arctic operational areas and include a mandate to increase Arctic UAS commercial operations." -

The FAA says there are approximately 167,000 aircraft in the United States and a total of 230,000 worldwide that rely on the current 100 octane, low lead fuel for safe operation. It is the only remaining transportation fuel in the United States that contains the addition of tetraethyl lead, a toxic substance, to create the very high octane levels needed for high-performance aircraft engines. Operations with inadequate octane can result in engine failures, the FAA noted." -

The Federal Aviation Administration today issued a blunt statement on the impact of sequestration on the nation's air traffic control system, which this week begain furloughing about 10% of air traffic controllers for two days or so per month. It reads as follows: 'As a result of employee furloughs due to sequestration, the FAA is implementing traffic management initiatives at airports and facilities around the country. Travelers can expect to see a wide range of delays that will change throughout the day depending on staffing and weather-related issues. ... Yesterday more than 1,200 delays in the system were attributable to staffing reductions resulting from the furlough.'" U.S. Democrats and Republicans spent the day using the FAA's statement as political fodder rather than working on resolving sequestration. -

FAA To Investigate 787 Dreamliner
Dupple sends word from the BBC that the U.S. Federal Aviation Administration will be conducting a safety review of the Boeing 787 Dreamliner after a number of incidents have called the aircraft's hardiness into question. "An electrical fire, a brake problem, a fuel spill and cracks in the cockpit's windshield have affected Dreamliner flights in the past week. ... The Boeing 787 Dreamliner is one of the most advanced aeroplanes ever created. Much of it is made from very strong, light carbon-fibre composite material. However, a spate of technical issues has hurt its image. On Friday, two new problems were found, adding to Boeing's woes." A spokesman for Boeing said they were "absolutely confident in the reliability and performance of the 787," and were cooperating fully with the FAA's investigation. The 787 went into service in 2011, and 50 have been delivered to various airlines since then, with hundreds more on order. Qatar Airways has received five of them, and it has criticized Boeing for manufacturing faults. -

The Federal Aviation Administration says laser events aimed on planes have nearly doubled in the last year, leaping from 1,527 in 2009 to 2,836 in 2010. The highest number of incidents was reported at Los Angeles International Airport, which recorded 102 in 2010. Lasers pointed at cockpits can temporarily blind pilots, forcing them to give up control of an aircraft to their co-pilot or abort a take-off/landing. In March of 2008, unidentified individuals wielding four green laser pointers launched a coordinated attack on six incoming planes at Sydney Airport, which resulted in a ban on all laser pointers in the state of New South Wales." -

Senate Votes To Replace Aviation Radar With GPS

It will help pay for the upgrade by increasing aviation fuel taxes on private aircraft. It will require two inspections per year on foreign repair stations that work on US planes. And it will ban pilots from using personal electronics in the cockpit. This just needs to be reconciled with the House version and is expected to become law soon. Several airplane companies have promised to produce Light-Sport planes that will cost no more than a luxury car."

Sort of like Abandonware for airplanes. This very closely resembles Lawrence Lessig's idea of a creative commons, into which source code would be escrowed. Once the copyright expired or became abandonded, the sources would be released. "This set of legal guidelines will help the FAA develop a set of procedures to legally release what had previously been unnecessarily protected as proprietary data.". Hopefully the Copyright office will take note of the success here, as well as the Supreme Court's hearing of Eldred v Reno." -

As such, security is tighter than ever. There will be no public / press farewell to the astronauts as they leave for the pad. The FAA has NOTAMs covering the new airspace restrictions around Cape Canaveral. CNN is reporting that the Air Force has fighters flying Combat Air Patrol and roads and waterways on the surface will be tightly restricted. Also, Endeavour will be carrying nearly 6000 flags, which will be given to families of 9/11 victims, and organizations that helped in the aftermath. It's such a shame. I just moved to FL, and I've never seen a launch. I've seen two landings, including Endeavour's maiden voyage, so I was looking forward to this. I was in NJ on 9/11 and it hit close to home, now it's like the terrorists have taken one more thing from us. I may not be as close as I'd like to be (read: onboard), but I'll be watching anyway. Good luck, Endeavour." -
