Welcome to Bandwidth Hell...aka Silicon ValleyI live in Palo Alto, California, right down the hill from Stanford University. I don't have broadband. And it appears that I won't have broadband until Crawford, TX freezes over, either.
For the past 15 months, I've tried virtually every option available and I can't get it. The
.com bust didn't help some struggling providers, but the real problem is the bastards that control the last mile. Because they have monopolies on the copper coming into my house, I am left with the poor prospect of allowing SpeakEasy.net to service themselves monthly on my posterior, while being grateful that they're only charging $89.99 for an 128k line.I'd like to have other options, but reality has a nasty way of intruding on my dreams. Here's a quick rundown for those who are interested:
Cable Modem: Real Soon Now[TM], @Home says so. And that's been their story for the last 15 months.
Sprint Wireless: I live in a local valley that line-of-sight technologies can't penetrate. Of course, Sprint isn't even offering this now...
Wireless (Ricochet): Had a fat 128k pipe, but Chapter 13 took down the connection. Aerie (who bought Ricochet) claims to be offering service again. If only they would have done something 2 months sooner.
Satellite: Check out Huge Aircrash's, er I mean Hughes Electronics' spiffy DiRECWAY technology. What's that? Only available for Windows 98, 2k, and ME? Well Windows ME harder! I refuse to buy another computer to access the 'Net.
Fiber: I can pay to have Fiberhood run fibre to the rental I live in...or not.
DSL: Some local monopoly claims that they'll be upgrading their equipment in my area, which will shorten the 23,400 feet distance between my home and highspeed heaven Real Soon Now[TM]. And it's been their story for 15 months, too.
The real problem is that no one can afford to compete with the incumbent telcos. Even if someone could come up with a high-speed wireless solution (and 128k does not qualify) for my area, they'd be out of business within 2-3 years of inception and within 6-9 months of deployment. Why? Guess where the monopolies would spend their time upgrading their services--areas where customers have no choices, or areas where their monopoly is threatened?
The demand is threre. Content is not really holding up broadband. Broadband is being held up by the ILECs--at virtual gunpoint.

Re:What they *should* have doneWell, I didn't mean to be misleading, but I do subscribe to the least expensive package that TW offers, simply because I do not need anything better. They also offer a business-class service that provides unlimited transfers, for about $90 more per month. For T3 speeds, that's really an excellent deal unless you happen to live in a cage at Exodus.
As for your comparison with satellite access - I am not sure why you brought this up, but IIRC it costs about $70/month and has horrible latency. Contrast with my 8ms ping times to Yahoo for half the price, and the cable modem wins hands down.
The simple fact remains that your cable company has to pay for a lot of extra T1s every time a handful of warez kiddies join their network. And anything they can do to keep their costs down (and avoid raising rates or going bankrupt) is just swell. Especially if it keeps my level of service high.

Re:Actually, It's Worse Than ThatWell, comcast uses @home, here is the AUP. It doesn't say no VPN, it does say no servers. It says that it is not to be used for commercial purposes. It in no way applies to checking office email from home.
The Intellectual property statement is this: "Through these actions, a user also authorizes Excite@Home and its distribution affiliates to reproduce, publish, display, transmit and distribute such content as necessary for @Home to deliver the content in a timely manner."
The actions they're referring to is posting content in the personal web space they provide. Obviously they need to transmit, etc. the content in order for people to view it on the web. They are not claiming ownership of anything that passes through their network.
No business can satisfy people who look at a regular AUP and see it in the most twisted and evil way possible. -

here is a TOS for ATT. Where does it say you cannot network your computers together?
The closest I can find is it says you cannot provide network services via the @home service. Key word here being via In this scenarios, we are NOT providing network services via @home. @home isn't even in the picture. We are providing network servies via your favorite Router/NAT application/device. @home is not taking part in any of the sharing. Your PC is just acting on behalf of other devices. Just like if you call me on the phone, and ask me to look up something for you. Thats how NAT works. You say you want to do operation X, and the NAT server will say, "ok, let me do that for you. And I'll tell you what the other computer said"
Sharing means, the server would have to say, "here is a network line. talk to the computer your damn self"...
This scenario would require your server to actually be a bridge. But a NAT server is NOT a bridge.
Some of the terms are just plain stupid. Like you can't run a server of anykind. Including HTTP. Guess that means we can't run Windows XP/ME. Both implement UPnP Services, which contain embedded HTTP Servers. Guess this means you can't buy UPnP Devices either, like your internet enabled toaster/refrigerator/etc, because all UPnP Devices have embedded HTTP Servers. Guess you can't use Desktop Remoting either, becaues that runs an RDP server. -

I have been a customer of both MediaComm/AT&T/@Home and Cedar Falls Utilities Cybernet (Cedar Falls, IA). My MediaComm service has been marginal at best; bad modems, crappy bandwidth, and work arounds to account to allow for my operating system of choice.
:) My service from CFU was a much better experience. Better technical support, when needed, OS freedom, and best of all, no 128kbs upstream cap. I think having a local service rather than a national broadband mass of companies has several advantages both its customers and the internet in general. Small localize services can better control the amount of spam running through thier networks, do some preventative virus blocking and security checks while still providing all the web, mail, news, and IRC that you could hope for. And in my case, it's all put together in just one bill along with my water, tv, electric, etc. A small, but definatly side effect. Now, if only my landlord had not signed a bulk contract for all his units to use AT&T. cfu.net @home -
Monitoring means assuming responsibility for usageThis was an issue circa 1996 when ISPs were wrestling with weather or not they are responsible for the actions of their users ans as such should attempt to keep track of activities on their network. I though the general concensus was that ISPs were not liable for the infringing activities of their users, unless they state that they will attempt to prevent such activity in socuments such as 'Acceptable Use Policies'. It sounds like Excite@Home screwed up their acceptable use policy and some content provider threatened to force them to make good on their statements that they would monitor the network for 'unacceptable uses'. Reharding the acceptable use policy, they say:
A spokesperson from Excite@Home said, "we are not watching every bit and byte, but we would randomly check from time to time."
The US AUP for their service describes illegal acticity but doesn't seem to describe how it will be observed. I was unable to locate the Austrelian policy. Presumably is't different in this regard. Also this statement, supports my theiry that some content provider called them on a badly written AUP that they have to make good on:"I wouldn't call it policing, we're just trying to comply with the law and by highlighting the issue to customers, its putting us in a better position as acting as a responsible Netizen on the Internet," the spokesperson said.
I've written a couple AUPs in my day and one has to be vary careful about what one says will be done to keep track of user behavior, because any knowlege of illegal activity must be acted upon, whereas simply providing bandwidth does not usually create so many legal obsticles, no matter how many threatening letters you may get from the RIAA and other such organizations.

Excite@Home Restrictiveness
I have been an @home customer for several years now, and have found out the hard way that they enforce rules that aren't quite in their Acceptable Use Policy I have been repremanded for uploading over 500 megs in a 24 hour period. I don't remember reading anything about that in the AUP. Recently they filtered port 80 and 25 without any warning when they have specifically stated that they would not filter these ports in the past.

Thank you for your report of Code Red probes.
While we are not allowed to give out specific information regarding subscriber identity, or specific action taken without legal process, we have identified the offending user and taken appropriate action against this account. If you are receiving 'get' command strings from an @Home user or users, directed at port 80, it is likely that that originating machine has been compromised by the Code Red virus. One of the effects it has is to cause infected machines to search for other machines that would be exploitable. Machines that are running unpatched versions of Windows NT Server or 2000, with a Web Server and IIS (Microsoft Index Server 2.0 or Indexing Service in Windows 2000) are vulnerable to this exploit. If you are NOT running this OS and services, your computer is not subject to this particular compromise.
So it sounds like they are trying to do something, and apparently sending in IPs can help them weed out problem servers... slow, but better than nothing.
...and they didn't even say anything about me running a server in the first place!

If you consider that @Home's acceptable use policy explicitely says that running servers isn't allowed... there are two interesting things to note. First, there are a lot of people running public web servers that @Home just ignores. Another thing is that it probably wouldn't be a problem legally for @Home to minimize the impact of code red by blocking port 80 traffic like they did with port 137, at least temporarily.

I've never seen a TOS that gives the provider the right to scan my network, and I find it incredible that I got harassed for inquiring about how their obviously non-standard routing worked.

To them, the internet is AOL or MSN. Just more chances to have their eyeballs spammed with ads and do a little shopping- in other words, just like the rest of our capitalist world except less convenient to use (compared with TV or opening up a magazine). In their eyes... the internet is absolutely nothing special... basically just TV, with hyperlinks, and added technical annoyances.

In some places, yes. I read recently that California is trying to pass laws to make the sale of crack prosecutable as attempted murder, and if the D.A. can prove that the stuff a dealer sold someone resulted in death, it is prosecuted as first-degree murder. I don't know if the law actually passed however.

The truely killer-app for game consoles will be the system that first comes to market using Linux as an OS. The benefits of using Linux should be apparent to all, and it is rather suprising that nobody has done so yet. Most likely this is due to Microsoft's monopolistic tactics and its using its market strength to force companies to use something inferior. Or gee, could it be because linux sucks balls for gaming? Unless you want to play Tux Racer, Quake 3, or Unreal Tournament, Linux gaming ain't exactly hopping these days, and to top it off, several developers have said they won't be doing linux games anymore because no one is buying them.
