Qualcomm Sues Apple For Contract Breach (reuters.com)
Qualcomm has sued Apple, again, this time alleging that it violated a software license contract to benefit rival chipmaker Intel for making broadband modems, the latest salvo in a longstanding dispute between the two companies. From a report: Qualcomm alleged in a lawsuit filed in the California state court in San Diego on Wednesday that Apple used its commercial leverage to demand unprecedented access to the chipmaker's highly confidential software, including source code. Apple began to use Intel's broadband modem chips in the iPhone 7, which it launched last year.

NASA Wants Private Company To Take Over Spitzer Space Telescope (spacenews.com)
schwit1 writes: NASA has issued a request for proposals from private companies or organizations to take over the operation of the Spitzer Space Telescope after 2019. SpaceNews reports: "NASA's current plans call for operating Spitzer through March of 2019 to perform preparatory observations for the James Webb Space Telescope. That schedule was based on plans for a fall 2018 launch of JWST, which has since been delayed to the spring of 2019. Under that plan, NASA would close out the Spitzer mission by fiscal year 2020. That plan was intended to save NASA the cost of running Spitzer, which is currently $14 million a year. The spacecraft itself, though, remains in good condition and could operating well beyond NASA's current plan. 'The observatory and the IRAC instrument are in excellent health. We don't have really any issues with the hardware,' said Lisa Storrie-Lombardi, Spitzer project manager, in a presentation to the committee Oct. 18. IRAC is the Infrared Array Camera, an instrument that continues operations at its two shortest wavelengths long after the spacecraft exhausted the supply of liquid helium coolant. The spacecraft's only consumable is nitrogen gas used for the spacecraft's thrusters, and Storrie-Lombardi said the spacecraft still had half its supply of nitrogen 14 years after launch." The way a private organization could make money on this is to charge astronomers and research projects for observation time. This could work, since there is usually a greater demand for research time than available observatories.

AMD, Which Lost Over $2.8 Billion In 5 Years, Takes a Hit After New Report (arstechnica.com)
An anonymous reader quotes a report from Ars Technica: On Monday, AMD's stock price plunged nearly 9 percent after a report by Morgan Stanley, a major investment bank, which found that "microprocessor momentum" has slowed. According to CNBC, a new report by analyst Joseph Moore found that "cryptocurrency mining driven sales for AMD's graphics chips will decline by 50 percent next year or a $250 million decline in revenue. He also forecasts video game console demand will decline by 5.5 percent in 2018." As per AMD's own SEC filings, the company lost over $2.8 billion from 2012 through 2016. However, new releases from AMD suggest that it may be on something of a resurgent track. As Ars reported last month, AMD's Ryzen and Threadripper processors re-established AMD's chips as competitive with Intel's.

NotPetya Outbreak Left Merck Short of HPV Vaccine Gardasil (securityledger.com)
chicksdaddy shares a report from The Security Ledger: The NotPetya malware infection shut down pharmaceutical giant Merck's production of the pediatric vaccine GARDASIL last June, forcing the company to borrow the drug from a stockpile maintained by the U.S. Centers for Disease Control and Prevention to meet demand, The Security Ledger reports. The anecdote was contained in a quarterly filing by Merck with the U.S. Securities and Exchange Commission (SEC) on Friday. That filing also showed that the company continues to suffer financial fallout from the outbreak of the NotPetya malware in June, reducing both sales and revenue for the quarter by hundreds of millions of dollars. In its quarterly 8-k filing, Merck said that revenue for the quarter was "unfavorably impacted" by around $135 million due to "lost sales in certain markets related to the cyber-attack." Sales in the third quarter of 2017 were also reduced by around $240 million, which Merck chalked up to production shutdowns resulting from NotPetya. In a chilling insight into the extent of the disruption the malware caused to Merck's operations, the company disclosed that part of its quarterly losses were linked to the interruption of its production of GARDASIL, a vaccine used to prevent Human Papillomavirus (HPV) which is linked to certain cancers and other diseases. To make up for what it described as "overall higher demand than originally planned," Merck was forced to borrow the vaccine from a stockpile maintained by the U.S. Centers for Disease Control (CDC), the company said.

McAfee Says It No Longer Will Permit Government Source Code Reviews (reuters.com)
Dustin Volz, Joel Schectman, and Jack Stubbs, reporting for Reuters: U.S.-based cyber firm McAfee said it will no longer permit foreign governments to scrutinize the source code of its products, halting a practice some security experts have warned could be leveraged by nation-states to carry out cyber attacks. Reuters reported in June that McAfee was among several Western technology companies that had acceded in recent years to greater demands by Moscow for access to source code, the instructions that control basic operations of computer equipment. The reviews, conducted in secure facilities known as "clean rooms" by Russian companies with expertise in technology testing, are required by Russian defense agencies for the stated purpose of ensuring no hidden "backdoors" exist in foreign-made software. But security experts and former U.S. officials have said those inspections provide Russia with opportunities to find vulnerabilities that could be exploited in offensive cyber operations. McAfee ended the reviews earlier this year after spinning off from Intel in April as an independent company, a McAfee spokeswoman said in an email to Reuters last week.

Chipmaker Nvidia's CEO Sees Fully Autonomous Cars Within 4 Years (reuters.com)
An anonymous reader shares a report: Nvidia chief executive Jensen Huang said on Thursday artificial intelligence would enable fully automated cars within 4 years, but sought to tamp down expectations for a surge in demand for its chips from cryptocurrency miners. Nvidia came to prominence in the gaming industry for designing graphics-processing chips, but in recent years has been expanding into newer technologies including high-performance computing, artificial intelligence, and self-driving cars. Its expansion has been richly rewarded with a 170 percent stock surge over the past year, boosting its market value to $116 billion. "It will take no more than 4 years to have fully autonomous cars on the road. How long it takes for the vast majority of cars on the road to become that, it really just depends," Huang told media after a company event in Taipei.

The Geometry of Islamic Art Becomes a Treasure of a Game (arstechnica.com)
Sam Machkovech from Ars Technica reviews the game Engare, describing it as a "clever, deceptively simple, and beautiful rumination on geometry and Islamic art-making traditions." The game consists of relatively simple puzzles and a freeform art toy that unlocks its puzzles' tools to allow you to make whatever patterns you please. From the report: The game, made almost entirely by 23-year-old Iranian developer Mahdi Bahrami, starts with a 2D scene of a circle repeatedly traveling along a line. Above this, an instructional card shows a curved-diagonal line. Drop a dot on the moving circle, the game says, and it will generate a bold line, like ink on a page. As the ball (and thus, your dot) rolls, the inked line unfurls; if you put the dot on a different part of the circle, then your inked line may have more curve or angle to it, based on the total motion of the moving, rotating circle. Your object is to recreate this exact curved-diagonal line. If your first ink-drop doesn't do the trick, try again. Each puzzle presents an increasingly complex array of moving and rotating shapes, lines, and dots. You have to watch the repeating patterns and rotations in a particular puzzle to understand where to drop an ink dot and draw the demanded line. At first, you'll have to recreate simple turns, curves, and zig-zags. By the end, you'll be making insane curlicues and rug-like super-patterns.
But even this jaded math wiz-kid couldn't help but drop his jaw, loose his tongue, and bulge his eyes at the first time Engare cracked open its math-rich heart. One early puzzle (shown above) ended with its seemingly simple pattern repeating over and over and over and over. Unlike other puzzles, this pattern kept drawing itself, even after I'd fulfilled a simple line-and-turn pattern. And with each pass of the drawing pattern, driven by a spinning, central circle, Engare drew and filled a new, bright color. This is what the game's creator is trying to shout, I thought. This is his unique, cultural perspective. This looks like the Persian rugs he saw his grandmother weave as a child. -
Justice Department Demands Five Twitter Users' Personal Info Over an Emoji (techdirt.com)
An anonymous reader quotes a report from Techdirt: Back in May, the Justice Department -- apparently lacking anything better to do with its time -- sent a subpoena to Twitter, demanding a whole bunch of information on five Twitter users, including a few names that regular Techdirt readers may be familiar with. If you can't see that, it's a subpoena asking for information on the following five Twitter users: @dawg8u ("Mike Honcho"), @abtnatural ("Virgil"), @Popehat (Ken White), @associatesmind (Keith Lee) and @PogoWasRight (Dissent Doe). I'm pretty sure we've talked about three of those five in previous Techdirt posts. Either way, they're folks who are quite active in legal/privacy issues on Twitter. And what info does the DOJ want on them? Well, basically everything: [users' names, addresses, IP addresses associated with their time on Twitter, phone numbers and credit card or bank account numbers.] That's a fair bit of information. Why the hell would the DOJ want all that? Would you believe it appears to be over a single tweet from someone to each of those five individuals that consists entirely of a smiley face? I wish I was kidding. Here's the tweet and then I'll get into the somewhat convoluted back story. The tweet is up as I write this, but here's a screenshot in case it disappears. The Department of Justice's subpoena is intended to address allegations that Shafer, who has a history of spotting weak encryption and drawing attention to it, cyberstalked an FBI agent after the agency raided his home. Vanity Fair summarizes the incident: "In 2013, Shafer discovered that FairCom's data-encryption package had actually exposed a dentist's office to data theft. An F.T.C. settlement later validated Shafer's reporting, but in 2016, when another dentist's office responded to Shafer's disclosure by claiming he'd violated the Computer Fraud and Abuse Act and broken the law, the F.B.I. raided his home and confiscated many of his electronics. Shafer was particularly annoyed at F.B.I. Special Agent Nathan Hopp, who helped to conduct the raid, and who was later involved in a different case: in March, he compiled a criminal complaint involving the F.B.I.'s arrest of a troll for tweeting a flashing GIF at journalist Kurt Eichenwald, who is epileptic. Shafer began to compile publicly available information about Hopp, sharing his findings on Twitter. The Twitter users named in the subpoena had started a separate discussion about Hopp, with one user calling Hopp the "least busy F.B.I. agent of all time," a claim that prompted Shafer's smiley-faced tweet."

Apple Reduced Face ID Accuracy To Ease Production, Bloomberg Reports (bloomberg.com)
In order to speed up the production of iPhone X, which Apple plans to begin shipping starting November 3, the iPhone-maker told its suppliers that they could reduce the accuracy of the Face ID facial recognition system, Bloomberg reported on Wednesday, citing multiple people familiar with the matter. Earlier reports suggest that suppliers were facing difficulties manufacturing the Face ID system, something that was holding them back from manufacturing enough iPhone X units for the holiday season. From the report: As Wall Street analysts and fan blogs watched for signs that the company would stumble, Apple came up with a solution: It quietly told suppliers they could reduce the accuracy of the face-recognition technology to make it easier to manufacture, according to people familiar with the situation. Apple is famously demanding, leaning on suppliers and contract manufacturers to help it make technological leaps and retain a competitive edge. While a less accurate Face ID will still be far better than the existing Touch ID, the company's decision to downgrade the technology for this model shows how hard it's becoming to create cutting-edge features that consumers are hungry to try. And while Apple has endured delays and supply constraints in the past, those typically have been restricted to certain iPhone colors or less important offerings such as the Apple Watch. This time the production hurdles affected a 10th-anniversary phone expected to generate much of the company's revenue. Apple has denied the claims made in Bloomberg report.

Snapchat Reportedly Stuck With 'Hundreds of Thousands' of Unsold Spectacles (theverge.com)
According to The Information, Snapchat expected demand for its camera-equipped glasses known as Spectacles to continue after the holidays and ordered "hundreds of thousands" of additional units. But demand didn't pick up after the company opened up its sales to a wider audience, leaving those units to collect dust in warehouses. The Verge reports: It's not known exactly how many Spectacles have been sold so far, but from the sound of it, Snap may have dramatically over-ordered units of its debut hardware device. Earlier this month, Snap CEO Evan Spiegel said the company had sold "over 150,000 units," which sounds pretty bad in the context of having hundreds of thousands sitting around waiting to be sold; although The Information says that figure includes unassembled units with parts that could potentially be used in other products. Spiegel has tried to paint Spectacles as both relatively successful and merely an early start in hardware. He claims they outsold Apple's first iPod -- a comparison clearly meant to suggest they could eventually have enormous success. But Spiegel also said hardware would really only be important to Snap a decade from now.

Stephen Hawking's Thesis Crashes Cambridge Site After It's Posted Online (bbc.com)
An anonymous reader quotes a report from BBC: Demand for Stephen Hawking's PhD thesis intermittently crashed part of Cambridge University's website as physics fans flocked to read his work. Prof Hawking's 1966 thesis "Properties of expanding universes" was made freely available for the first time on the publications section of university's website at 00:01 BST. More than 60,000 have so far accessed his work as a 24-year-old postgraduate. Prof Hawking said by making it available he hoped to "inspire people." He added: "Anyone, anywhere in the world should have free, unhindered access to not just my research, but to the research of every great and enquiring mind across the spectrum of human understanding. It's wonderful to hear how many people have already shown an interest in downloading my thesis -- hopefully they won't be disappointed now that they finally have access to it!" The 75-year-old's doctoral thesis is the most requested item in Cambridge University's library. Since May 2016, 199 requests were made for the PhD -- most of which are believed to be from the general public rather than academics. The next most requested publication was asked for just 13 times. The Cambridge Library made several PDF files of the thesis available for download -- a high-resolution "72 Mb" file, digitized version that's less than half the size, and a "reduced" version that was even smaller -- but intense interest overwhelmed the servers. Here's the first paragraph of Hawking's introduction: "The idea that the universe is expanding is of recent origin. All the early cosmologies were essentially stationary and even Einstein whose theory of relativity is the basis for almost all modern developments in cosmology, found it natural to suggest a static model of the universe. However there is a very grave difficulty associated with a static model such as Einstein's which is supposed to have existed for an infinite time. For, if the stars had been radiating energy at their present rates for an infinite time, they would have needed an infinite supply of energy. Further, the flux of radiation now would be infinite. Alternatively, if they had only a limited supply of energy, the whole universe would by now have reached thermal equilibrium which is certainly not the case. This difficulty was noticed by Olders who however was not able to suggest any solution. The discovery of the recession of the nebulae by Hubble led to the abandonment of static models in favour of ones which were expanding."

Hong Kong Has No Space Left for the Dead (vice.com)
Justin Heifetz, writing for Motherboard: When Fung Wai-tsun's family carried their grandfather's ashes across the Hong Kong border to Mainland China in 2013, they worried Customs officers, thinking the urn was full of drugs, would stop them. Fung, like many others in Hong Kong, could not find a space to lay his loved one to rest in his own city and would have to settle for a site across the border and hours away. It's an increasingly common story as demand for spaces to house the dead outpaces supply here in the semi-autonomous Chinese territory of some 7.4 million people. Hong Kong's public, government-run spaces to store ashes -- which are affordable to the public, starting at $360 -- have waiting lists that can last years. But many Chinese, like Fung, strongly believe the ashes must be put in a resting place immediately as to not disrespect their ancestor's spirit. Meanwhile, a private space -- one that is not run by the government -- tends to start at more than $6,000 and can go for as high as $130,000. This is simply not an option for many families like the Fung's. In Hong Kong, most people cremate their loved ones and house the urns in columbariums, or spaces where people can then go to pay their respects. While burying a body is possible, the option is prohibitively expensive -- and besides, Hong Kong has a law that the body must be exhumed after six years, at which point one must be cremated.

Tesla Plans Factory In China, Discounts Insurance For Self-Driving US Cars (electrek.co)
Business Insider reports: Tesla has created a customized insurance package, InsureMyTesla, that is cheaper than traditional plans because it factors in the vehicles' Autopilot safety features and maintenance costs. InsureMyTesla has been available in 20 countries, but Tesla just recently partnered with Liberty Mutual to make the plan available in the U.S. InsureMyTesla shows how the insurance industry is bound for disruption as cars get safer with self-driving tech.
Electrek reports: There have been several false alarms over the past few years about Tesla building a factory in China. Earlier this year, Tesla finally confirmed working with the Shanghai government to establish a manufacturing facility in the region and promised an announcement by the end of the year. Now the Wall Street Journal reports that they have come to an agreement with the local authorities on a "wholly owned" factory in the region... China is already the biggest market for electric vehicles, or any vehicles for that matter, and Tesla profited from the demand by tripling its sales to over $1 billion in the country in 2016. Tesla continues to have strong sales in the country this year, where it leads foreign electric car sales with no close second. -
Tech Companies To Lobby For Immigrant 'Dreamers' To Remain In US (reuters.com)
An anonymous reader quotes a report from Reuters: Nearly two dozen major companies in technology and other industries are planning to launch a coalition to demand legislation that would allow young, illegal immigrants a path to permanent residency, according to documents seen by Reuters. The Coalition for the American Dream intends to ask Congress to pass bipartisan legislation this year that would allow these immigrants, often referred to as "Dreamers," to continue working in the United States, the documents said. Alphabet Inc's Google, Microsoft Corp, Amazon.com Inc, Facebook Inc, Intel Corp, Uber Technologies Inc, IBM Corp, Marriott International Inc and other top U.S. companies are listed as members, one of the documents shows. The push for this legislation comes after President Donald Trump's September decision to allow the Deferred Action for Childhood Arrivals (DACA) program to expire in March. That program, established by former President Barack Obama in 2012, allows approximately 900,000 illegal immigrants to obtain work permits. Some 800 companies signed a letter to Congressional leaders after Trump's decision, calling for legislation protecting Dreamers. That effort was spearheaded by a pro-immigration reform group Facebook Chief Executive Mark Zuckerberg co-founded in 2013 called FWD.us.

EU: No Encryption Backdoors But, Let's Help Each Other Crack That Crypto (theregister.co.uk)
The European Commission has proposed that member states help each other break into encrypted devices by sharing expertise around the bloc. From a report: In an attempt to tackle the rise of citizens using encryption and its effects on solving crimes, the commission decided to sidestep the well-worn, and well-ridiculed, path of demanding decryption backdoors in the stuff we all use. Instead, the plans set out in its antiterrorism measures on Wednesday take a more collegiate approach -- by offering member states more support when they actually get their hands on an encrypted device. "The commission's position is very clear -- we are not in favour of so-called backdoors, the utilisation of systemic vulnerabilities, because it weakens the overall security of our cyberspace, which we rely upon," security commissioner Julian King told a press briefing. "We're trying to move beyond a sometimes sterile debate between backdoors or no backdoors, and address some of the concrete law enforcement challenges. For instance, when [a member state] gets a device, how do they get information that might be encrypted on the device." [...] Share the wealth. "Some member states are more equipped technically to do that [extract information from a seized device] than others," King said. "We want to make sure no member state is at a disadvantage, by sharing the tech expertise among the member states and reinforcing the support that Europol can offer."

Apple's Tim Cook Shares What He Learned From Steve Jobs (businessinsider.com)
Speaking at Oxford, Apple CEO Tim Cook shared a lesson learned from the "spectacular" commercial failure of the Power Mac G4 Cube in 2000 -- and from his mentor Steve Jobs. An anonymous reader quotes Business Insider: "It was a very important product for us, we put a lot of love into it, we put enormous engineering into it," Cook said of the G4 Cube on stage. He calls it an "engineering marvel." At the time, Cook was Apple Senior VP of Worldwide Operations, recruited personally by then-CEO Steve Jobs... While the design was a hit, it was $200 more expensive than the regular Power Mac G4, a more traditional-looking PC with very similar specs. And some Cubes would develop cosmetic cracks in the acrylic cube casing due to a manufacturing flaw. In his talk, Cook says that Apple knew the Cube was flopping "from the very first day, almost..."
Ultimately, Cook says, it was a lesson in humility and pride. Apple had told both employees and customers that the G4 Cube was the future. And yet, despite Apple's massive hype, demand just wasn't there, and the company had to walk away. "This was another thing that Steve [Jobs] taught me, actually," says Cook. "You've got to be willing to look yourself in the mirror and say I was wrong, it's not right." In a broader sense, Cook says that Jobs taught him the value of intellectual honesty -- that, no matter how much you care about something, you have to be willing to take new data and apply it to the situation.
He advised his audience to "be intellectually honest -- and have the courage to change."

In a Cashless World, You'd Better Pray the Power Never Goes Out (mises.org)
schwit1 quotes the Mises Institue: When Hurricane Maria knocked out power in Puerto Rico, residents there realized they were going to need physical cash — and a lot of it. Bloomberg reported that the Fed was forced to fly a planeload of cash to the Island to help avert disaster. "William Dudley, the New York Fed president, put the word out within minutes, and ultimately a jet loaded with an undisclosed amount of cash landed on the stricken island. [Business executives in Puerto Rico] described corporate clients' urgent requests for hundreds of thousands in cash to meet payrolls, and the challenge of finding enough armored cars to satisfy endless demand at ATMs... As early as the day after the storm, the Fed began working to get money onto the island."
For a time, unless one had a hoard of cash stored up in ones home, it was impossible to get cash at all. 85 percent of Puerto Rico is still without power... Bloomberg continues: "When some generator-powered ATMs finally opened, lines stretched hours long, with people camping out in beach chairs and holding umbrellas against the sun." In an earlier article from September 25, Bloomberg noted how, without cash, necessities were simply unavailable:"Cash only," said Abraham Lebron, the store manager standing guard at Supermax, a supermarket in San Juan's Plaza de las Armas. He was in a well-policed area, but admitted feeling like a sitting duck with so many bills on hand. "The system is down, so we can't process the cards. It's tough, but one finds a way to make it work."

This Is the Week Wall Street Went Nuts Over Cryptocurrencies (bloomberg.com)
Wall Street banks that weren't already on the bitcoin bandwagon appear to be piling on, or least eyeing seats, after the cryptocurrency surged to all-time highs this week on the way to $6,000. From a report: Analysts are working to keep up with demand from clients for information. UBS and Citigroup published extensive explainers on blockchain technology, while senior executives at JPMorgan Chase warmed to the cryptocurrency during the bank's third-quarter earnings call. The digital currency has risen more than fivefold after trading at less than $1,000 as recently as December, breaking the $5,000 mark this week and already targeting the next thousand-dollar level. Throughout its rise, the cryptocurrency shrugged off tighter regulations, feuding factions and warnings from the likes of JPMorgan's Jamie Dimon of fraud and an eventual price collapse.

Twitter Is Crawling With Bots and Lacks Incentive To Expel Them (bloomberg.com)
An anonymous reader shares a report: On Wednesday, the exterior of Twitter's San Francisco headquarters bore an eerie message: "Ban Russian Bots." Someone -- the company doesn't know who -- projected the demand onto the side of its building. Bots, or automated software programs, can be programmed to periodically send out messages on the internet. Now Twitter is scrambling to explain how bots controlled by Russian meddlers may have been used to impact the 2016 president election. Twitter was designed to be friendly to bots. They can help advertisers quickly spread their messages and respond to customer service complaints. Research from the University of Southern California and Indiana University shows that 9 to 15 percent of active Twitter accounts are bots. Many innocuously tweet headlines, the weather or Netflix releases. After the election, there was little discussion inside the company about whether the platform may have been misused, according to people familiar with the matter who asked not to be identified because it is private. But the ubiquity and usefulness of bots did come up. At one point, there were talks about whether Twitter should put a marking on bot accounts, so that users would know they were automated, one of the people said. Yet most of the conversation after the election focused on whether Trump's tweets violated Twitter's policies, the person said.

Alphabet's Waymo Demanded $1 Billion In Settlement Talks With Uber (reuters.com)
An anonymous reader quotes a report from Reuters: Alphabet's Waymo sought at least $1 billion in damages and a public apology from Uber as conditions for settling its high-profile trade secret lawsuit against the ride-services company, sources familiar with the proposal told Reuters. The Waymo self-driving car unit also asked that an independent monitor be appointed to ensure Uber does not use Waymo technology in the future, the sources said. Uber rejected those terms as non-starters, said the sources, who were not authorized to publicly discuss settlement talks. The precise dollar amount requested by Waymo and the exact time the offer was made could not be learned.
Waymo's tough negotiating stance, which has not been previously reported, reflects the company's confidence in its legal position after months of pretrial victories in a case which may help to determine who emerges in the forefront of the fast-growing field of self-driving cars. The aggressive settlement demands also suggest that Waymo is not in a hurry to resolve the lawsuit, in part because of its value as a distraction for Uber leadership, said Elizabeth Rowe, a trade secret expert at the University of Florida Levin College of Law.
