I still dont see what makes people think they have the right to a fair trial from companies. If you use their product, you're subject to the terms and conditions that go with that product. If you feel such terms are illegal, do something. If you feel such terms are inconvenient and insulting, dont use their product.
Ever deal with a telecom A/R department? Ever try to convince them that charges are invalid? This is nothing new, read your fine print and make an informed decision. Complaining that one made the wrong decision isnt going to change anything.
Addendum: If you're so very sure on your legal information, file a case. If you feel you're too small to take on MS, build up support for a class action suit.

You are very presumptuous to assume that anyone who is complying with the law would not be offended at needing to PROVE it. If I am expected to trust you to examine my physical private property with nothing other than your word of honour that you aren't going to screw around with it, then you should be willing to accept my word of honour that I am not screwing around with your intellectual property. Something I do not understand is this feeling of entitlement with regards to not being offended. If its offensive, do not give them your business, if you're looking to convince people they SHOULD be offended, do so. I see nothing here that isnt "its too much of a hassle" type argument. I hate to break this to you, but honour and ethics do not go very far in court. If you're a business of any size, you best be ready to handle the risks associated with the software you choose. Opportunity costs exist.
If their solution is disagreeable, use other software. This isnt the home market we're talking about, this is peoples livelyhoods _depending_ on the software in question. If the time overhead of such a process is too high, perhaps you should be looking into a capital time investment to switch over to other software.

Sounds nice in theory, but i'd hate to think of the probabilities of a) a significantly advanced race able to do so b) a receiving race that is paying attention when the light and RF waves pass their planet, c) that they notice its non-random and d) the "data" sent in between is not mangled to death by the supernovae's shockwaves.

Well, having read the story, I have this strange feeling Sony's desire to release without being able to meet demand might...just might...have something to do with the Wii being released before this christmas. Keep in mind consoles are the kind of purchase that the general market views as cyclical purchases. Buy one new one every few years. The number of homes with multiple new consoles is MUCH smaller than the number of homes with one from each generation. Therefore, if Sony did NOT release for this Christmas (read: too soon) then a large number of people may end up buying the Wii as this Christmas's major gift, who then hold off till the next generation before considering a new purchase.
Marketing strategy is not for fanboys, they are already converted. Its the casual consumer that is the target 99% of the time. Plus, don't forget that the difficult to attain has a draw all its own with some people =) (think of the tickle-me-elmo-furby wars of the days of yore).

The issue is that the telecom companies are lobbying to ban the ABILITY for a city to decide this for themselves. plus keep in mind the number of people overall who would use net access arent going "DAMN MY 900MS PING IMPEDES MY FPSING" (despite rising popularity). The majority tends to rule, its rather the entire concept behind formng municipalities. And if the majority doesnt give a crap about their latency, why should they be forbidden to create such a network?
Its been said before, but i'll say it again...replace any instance of "Massives" or MMORPGs etc in any of these stories with "The Internet" and it still fits the same. Hell, even the C64's Quantum-Link service pretty much fit every description there, except perhaps the fact that social networking isnt as gain related as in a game.
