I was a stand in security and abuse coordinator for a little less than a year at Time Warner Cable. All it took was a subpoena faxed to the office for us to hand over any data request. A lot of times cops would get pissed because a police letterhead fax wasn't enough, but it takes no time to get a subpoena. Police would try to say they were afraid the data could get purged if they didn't get it now, versus a few hours from now which is BS. I would tell them I already pulled the requested data and had it right in front of me so no worries about it being purged, they were not amused.

If any expansion of power is needed it should be the ability to have a request to hold data while a subpoena is processed. That is a simple answer, but the government isn't interested in simple answers its intent is to chip away at privacy so it can do whatever it wants whenever it wants.

I'm going to try to inject as little politics into this as I can.
If there are 80,000,000 single family homes in the US, wouldn't it have been a far better use of that non-sense stimulus money (if it was to be spent at all) to buy a net metered solar system for all those homes? The US spent 1.2 T dollars on nothing. If you re-routed existing solar related federal funds to this program as well the feasibility gets even better. This would have created 'green' 'high tech' jobs while which makes everyone happy. This would have cut our 400,000,000,000 dollar oil trade deficit over time since energy demands would decline and domestic sources would make up more of a percentage of what we use. This would also please the global warming crowd by reducing C02 over time. Conservative minded people would not like the money being spent at all, but if it were to be spent this would be the most palatable (you could also tie in some opening of oil fields in currently locked out places to sweeten the deal). If people are still uncertain about the math, we spent 5.xx T in the past 2 years total so it's not like there isn't a piggy bank, but I think the stimulus and related funds would be enough.

    Any thoughts?

  10. Played the game as presented. on Man Arrested For Exploiting Error In Slot Machines · · Score: 1

This is probably how it will go down:

    A.
The gambler was playing the game as it was presented by the casinos with no knowledge of changing or changed configurations. In this case he again 'played the game as it was presented' and would be entitled to all his winnings. There was a case like this with video Keno where a RNG chip was not set or installed properly on the machines. The player was using chaos theory math to find the next outcome and hit more than a few jackpots in a row before the game was shut down. What the 'math whiz' actually stumbled on was that each night the keno machines were turned off and the RNG would start at the beginning of the same extremely long string of numbers. No chaos theory or math needed.
The outcome was that the man 'played the game as it was presented' and was entitled to his winnings.

Sorry about the gambling links, but this is the story. Link: http://www.blackjackforumonline.com/content/how_to_beat_keno.htm
    B.
Another way this could go is if the player had inside knowledge like a programmer telling him what combination of buttons to press to exploit the software. I had read of this happening and since the game was altered to change the outcome there was no entitlement to the winnings.
    C.
One story that I disagreed with the outcome to was a man (perhaps the same from example B, I don't remember) who did not have access to the particular casinos systems as he didn't work their, but wrote a program to predict the Keno outcome. It took a while, but he did finally win some big money and it was determined that he wasn't entitled to it because he used a computer program to 'guess'. If that computer program was taken from his 'old casino job' then fine, but if he just wrote a program and played the game he should have been entitled to the winnings.

Setting a precedent like this is not far fetched, I mean look at the new health care law (like it or love it) the federal government says it can make every US citizen buy a product because the precedent comes from the federal governments ability to regulate trade between states.

The constitution couldn't foresee computers or the internet (not that it needed to), but look at what the government does with individual rights when there is perceived uncertainty about peoples rights as it relates to data, we have none.

The ''up to'' loophole is an ISP standard, but after working at Verizon I can say they at least have technology that normally tests a hair above the customers cap. When a company sells a 20x5 connection and gets a 20x5 connection (even to off vz network), that might be some slight hope.
The funny thing is that the Feds were not going to let Verizon upgrade to their fiber network. The Feds were more concerned with controlling Verizon with SLAs than technology being upgraded. Feds point of view was they would rather control that 20 yr old copper wire than see Verizon have unregulated fiber. Verizon finally caved and Feds regulated the fiber too.
