The OEM appears to be driving this themselves. They didn't have to be sued to enable this and no one had to figure out how to load their own software on it.

It's going to be hard to tell the difference. I highly doubt they pay advanced developers to decompile/blueprint submitted apps, in an attempt to determine what compiler was used to create the executable.
Microsoft has never locked down a general purpose computing device and told me what I can or can't run on it. They may have made cross platform stuff difficult, but they never banned it outright with DRM lockdowns.

Apple thinks they know what you should run on your equipment, better than you do. Essentially, you rent your iPod, etc. from Apple.
