    From the article...

Full-length CDs: unit sales dropped 5.3% at mid-year 2001, $5.5 billion dollar value, a 2.7% decrease in dollar value.

DVD Video: 115.9% rise to 3,000,000 units. $70.1 million market in the first half of the year, an increase of 99.2 percent from $35.2 million at mid-year 2000.

Cassettes: down by 42.9% ($176,000,000). Dollar value down 41.9%.

LPs: Units up by 7.4%, a $12,900,000 value. Value is up 3.3%.
LP, Cassette and CD singles: down 38.3%, $70,000,000 value. Dollar value down 24.9%

    Full-length albums: down 8.4%, $5,700,000,000 value. This is a 4.7 percent decrease from mid-year 2000.

So prices have definately risen for most items, DVDs are definately eating into market share for everything else.

Now, is there anything else that may effect these figures?

Is there a recession or anything like that stopping people from spending their (very) finite dollars on music.

Have any other products been released onto the market in the past twelve months that could divert spending away fom music? *cough*Playstation2*cough*.

Have the record companies done anything that could cause the buying public to re-evaluate who they hand their hard earned to?

And finally, weren't mp3 downloads in decline for the larger part of this period?

  14. Re:More of the same on Code Red Refunds? · · Score: 2, Interesting

When thinking about all these new "issues" that are arrising out of our new technologies, I usually try to find parallel proceedures in existing situations to use as a guide for working out the new problems.

In this regard, I would look to a not-at-fault car accident, there are a lot of similarities.

Imagine this: a car stops. The car behind it hits it and sends it carreering into the car in front.
Now, if I'm in the middle car (the first one mentioned) the guy in the very front car, who was hit through no fault of his own, sues me. I, in turn, sue the car who hit me (who was at fault) and pass on the litigation from the front guy to the one who hit me (I was not at fault for either collision and the rear vehicle was for both.).

Now lets bring this back home, Microsoft sell a product which has faults. Qwest buys said product from Microsoft and use that as a basis for their own product. I buy the Qwest product and use it to create my own product (say, a website). One day, Microsoft's product stops working. Qwest's product as a direct result, stops working. My product then stops working because of Quest's problems.

My product cannot make me any money. I am running at a loss.

I think it would be fair for me to turn around to my supplier and ask for compensation for lost earnings (at the hands of Quest's product), or at least refuse to pay for the portion of the service that was not delivered. Quest then have that option of passing on their costs to their supplier (should they be liable).

On the other hand, I could just be being too simplistic.

  15. I tried... on MP3.com Sued for 'viral' Copyright Infringement? · · Score: 1

Last year, I wrote to the Australasian Performing Rights Association and explained that I, as an internet user, from time to time download the odd sound file. I also don't spend too much time investigating the copyright conditions of everything I encounter.

With all this in mind it occurred to me that my activities could be depriving artists of their rightly earned royalties. I asked for a new licencing category specifically for the end user. I explained that for a small annual fee, I would feel much better knowing that I could use any content I found on the internet without breaching anyone else's rights, and that I wanted that responsiblity to end with me.

All I recieved as a response was information that APRA was creating a new licence they were going to foist onto website owners (presumably they could only force this onto Australian sites).

Since fair use laws have been watered down to the effect that they virtually down't exist anymore, I felt it was important to mention to the powers that be that I still want access to copyrighted works available in the public domain without having to bend over for it.

In Melbourne, last September, we did not take to the streets smashing things, but as far as the media and now Joe sixpack are concerned, that is exactly what happened. The newspapers spent months trying to incite any violent kooks into coming into the protests for the promised violence. Funily enough, that's just what they've started doing now in the lead up to our CHOGM lead up meeting.

These protesters have very real concerns and are being ignored by the media, and subsequently the public at large.
