The ones who need to appear in court against all the companies are those who downloaded (clients) the software and stuff. You can't just say piratebay does store files on there servers and have them appear court, it doesn't make quite sense.
Bit torrent is NOT like all clients are accessing to one computer to download files. Its when each client connects to a client and keeps on going until that client has the file. So, why would one just make piratebay the victim?
