.. and apple is wrong, take it from an ex-patent examiner.

The way that patent examiners work is by number of actions on a case. Each patent application is a case and there are only at most 2 actions on a case: first action, usually a rejection for something; final action, either the patent is allowed or denied. Allowing a patent on the first round only gives you one action. The patent examiners are expected to complete a certain number of actions each week. As the patent examiner stays there longer they need to complete more actions. A new patent examiner, GS-5 or GS-7 would have to do about 4 patents every 2 weeks, where a GS-11 would have to do about 7 every two weeks. This never ever ever takes into account the complexity of the patent either. A 10 page patent application gets the same attention as a 150 page application. It does not take into consideration that the job is boring as hell unless you like dealing with lawyers.

Many patent examiners are not from the technical fields that they are working in and some are fresh out of college. Patent examiners are government employees and thus have the same lazy attitude that most government employees do.

Anyone who has been on /. for the past 5 years and seen some of the stupid issues that have come up because of patents would know that the USPTO (United States Patent and Trademark Office) is completely jacked up and not working.

  10. there is more to it than just that! on Why Linux Has Failed on the Desktop · · Score: 1
There are other reasons that Linux has failed on the desktop.

    1) Late to the market. Windows was on the desktop before Linux was even considered an operating system. It was not until the late 1990's that corporations started to look at Linux as a real operating system, and many did not adopt Linux until after 2000.

    2) The desktop part of Linux was more of an after thought in the late 1990's. It was X windows + window manager + applications + everything looked different and hardware support was sketchy (and for some hardware today it still is). There were no inexpensive prebuilt desktop systems for Linux like there were for MS Windows and Linux had not top end software like the Apple/Mac did. ( I'm still talking about back in the late 1990's ). GNOME and KDE were around, but in their infancies back then. They are usable now, but back then there were mediocre at best.

    3) You are guaranteed (almost) that if you go out and buy hardware that it will work under MS Windows or it will say what version of MS you need. Hardware rarely if ever says 'you need this version of Linux' (network cards are usually the exception). Go out and buy a web cam and then hope it works.

    4) No 'central command'. MS is a big corporation and you can find support on their site for most of your problems, or you can call someone ( it may be expensive and time consuming, but you can do this ). Apple has the 'genius bar'. Linux has ??? Well if you order from RedHat, or some other vendor, then you can pay for support otherwise you are online hoping you hit the right search term or find the right message board, etc.

I could go on, as there are other reasons, and maybe someone else could come up with a few more.

Now don't get me wrong I love Linux, I use it every day as my primary workstation and it is fine for me, but until someone starts selling Linux desktops like Apple does or Dell/HP+MS, it will be tough for Linux to make the inroads.

It actually takes 3 to 7 years to come up with a drug, get it tested, through the FDA and approved. Drug companies spend lots of money on research. Getting a patent ensures that if there is a need for their drug that they make their money back. Also drugs are sold fairly cheap compared to electronics. In order for people to buy drugs they must be cheap otherwise people wont buy them ( unless they absolutely have to [ diabetics, cancer, and so on ] ).

Software and hardware does not usually take that long to come to market ( not these days at least ) and do not have to be sold as cheap ( the iPhone is an example of that [ how many college students have used arm processor for their college projects ] ).

It takes about 2 years to get a patent, maybe longer in some cases, and if you are lucky you can do it in less time. That means that it is a 2 year investment, as well as there are patent fees and so on. For a drug maker having an exclusive lock on something is a good thing, because then they can recoup their initial investment. It will usually take someone else a few years to create a drug that does the same thing, so they can make money back that way. In electronics and software, it does not make as much sense, because usually people will not take as long to create a new program or hardware device ( thing gif / jpeg vs png ).

I think the issue now is, did we cause this climate change and if so can we reverse it. Personally I think we did cause this climate change, but convincing others can sometimes be impossible.

There are also two issues that are faced, if we want to push forward the idea that we caused climate change: 1) if we want to reverse climate change, what will be the impact to businesses; 2) what would be the religious implications, if we have that much control over the environment.

These are real issues that politics plays into. The republican party has a large religious following and corporate backing. This means that anything that affects either of these views is always considered taboo or bad.

So, if we have caused a climate change, and we want to undo climate change, corporate America and other nations need to change their ways. This has a huge economic impact ( although IMHO the alternative is global death ). These changes will cause businesses to loose money and in some cases go under. That is not acceptable to corporate America (I'm ok with weeding out bad companies, that are screwing us all).

On the religious side, if we are responsible for causing the world to 'end in fire' then the whole idea of 'rapture' suddenly becomes a 'we did it to ourselves' and possibly there is no god to save anyone. No god, means no rapture, which means all these people are screwed like the rest of us.
