In my experience, yes.
If it's a new torrent then everyone gets the file at the speed of the initial seeder's upload. If it's an older torrent then most of the swarm are seeders which small amounts of upload available, which adds up to a good download speed usually.
BT relies on a proportion of the swarm being good citizens and becoming seeders.

These cases will be heard in civil court where the decision is made on the balance of probability, and doesn't have to be beyond reasonable doubt. There is no assumption of innocence - the defendant has to actively prove themselves innocent.
For the majority of individuals the risk of losing is far too great to take this to court, even if you are certain of your innocence. If you get a letter you'd be a fool not to settle ASAP, IMHO. Unless you're about to go bankrupt anyway, I guess.

[ubuntu's package management]... as it's the same as Debian. Well, it uses the same system but I don't entirely agree with you in essence. Ubuntu offers modern packages in a stable format, which is far more labour intensive than Debian's 'old but stable' philosophy.
I'm not dissing Debian for their approach, but it is quite different to Ubuntu's even though they use the same package management.

If someone steals your car and runs someone down, you're not liable. Why should it be different in this case?
So much more likely will be that before such announcements, they will update like ten or twenty biographies, to mask which is the real one.
