While this would be true, it could still be argued (successfully) that the emulator would have a negative impact on potential future revenue of LucasArts products, such as a LucasArts Classics package for BSD.
There are 2 arguments that the scummVM ppl need to make. However, they only made one of these arguments.
1. ScummVM is an emulator, and was created using legally valid and sound reverse engineering techniques. (this agument they made)
2. ScummVM was created as an academic exercise in software and reverse engineering techniques. As such, ScummVM is not bound to the DMCA, or any other such laws, as it is considered a form of free speech, and is protected under First Amendment Rights.
With XBox sales slouching below predicted levels, it would be so terribly ironic if DivX, OSS, and hacking were to come to the rescue and SAVE MICROSOFT's product.
That's because there were _no grounds_ for the case.
This one will be tossed out just as quickly.
However, it is still a good thing. This kind of thing will get a LOT of attention.

I was hoping to see this!
This is the corporate Linux community's response to the recent paradigm shift from new software development --> increased security.
If "Unbreakable Linux" can get 'there' first, Microsoft is going to remain behind Linux in terms of security.
By 'there', I mean achieving a state where the OS is inherently *very* secure.
"Unbreakable"? Not really. But hey, it's marketing spin, and the Linux community is entitled to do some too. Hell, isn't that what we have this guy for?
To brush off the dust from a well worn expression:
That agreement is just a scrap of paper.
Though ReplayTV can initially claim the right to shut off your service, they have no legal grounds for altering your device, or changing your service simply because you bang/scratch/open/modify/mutilate your equipment, provided that you are not, in any way, affecting the service provided. You would need to do something to the effect of altering their advertisement storage mechanism in order for ReplayTV to have legal grounds for their agreement.
This is indeed a moment that will change the Linux industry, because, in the not too distant future, there will be only 3 major linux companies:
Red Hat
Mandrake
-otherGuy-
Where -otherGuy- is the final form of these companies who insist on putting together a "United Linux".
Within 1.5 years, we will see only 3 "major" players in the Linux distro market, with Mandrake taking a distant 3rd.
This is indeed a moment that will change the Linux industry, because, in the not too distant future, there will be only 3 major linux companies:
Red Hat
Debian
-otherGuy-
Where -otherGuy- is the final form of these companies who insist on putting together a single distribution base.
Within 1.5 years, we will see only 3 "major" players in the Linux distro market, with Debian taking a distant 3rd in revenue.

OK, so some roller coaster company builds a ride that may cause permanent brain damage, or kill, somebody. Big deal. Let the affected parties sue the amusement park/roller coaster company/etc. Chances are, if the company was truly negligent, there will be a big settlement, and the park/etc. will have to now take a proactive stance to prevent losing the shirt of their financial backing.:)
