    The innocent should be able to beat this without too much effort, but it will sadly cost them a lot of money and time to prove their innocence.


    THIS IS THE PROBLEM PEOPLE

    what happened to being innocent until proven guilty? they ASSUME you are guilty by default and it is even legally enforced at $10,000 as other people have mentioned herein..

    this doesn't even adress the fact that they b roadcast their signal through the air and it costs them NOTHING AT ALL for your equipment to be picking up the signals

    so not only are you guilty by default but you also have no rights as to what's in the air in your own fucking house

    that judge should be disbarred this is gross negligence on the part of the legal system which is supposed to protect people's rights not inflated corporate profit margins (as i recall it says by the people for the people not by corporations for the almighty dollar)

    yea it's a rant, yea i'm totally unaffected by this but shit like this makes me want to move to Soviet Fucking Russia where at least the criminals aren't trying to shove (their) morality down your throat while they're extorting you and threatening your family.

    perish the thought that one day the RIAA gets the ability to enforce their own copyrights or even worse that the gov't takes tehm seriously enough to devote some amount of law power to their assinine crusade to turn back the clock 10yeras when they could have done something about it

    people talk about ip tracing, my question is how long does the typical ISP keep a list of what mac address got what ip? cuase if they keep none i can switch my ip daily and the RIAA will only know that a lot of people on my subnet (read a 12 or 15 mile radius at least around me) are using these services.. i would assume the average /.er knows not only how to change their ips but probably has more than one card they could use to do it .. yea i know that your cable modem has a set MAC but if there is no record of a lease after it's 'expired' how are they going to trace it back to your modem? also unlike ashcroft's nazi league of anti-terrorists the RIAA would most likely need to get subpoenas and a variety of other legal ducks in order before they woudl even be able to do anything about it

    and all that tracking and lawyering is expensive.. i wonder how many people they will litigate before they bankrupt thsemlseves trying to get legal fees

    it's not like anyone forces them to use CD's for distribution, they could come up with their own propreitary players and formats and whatnot

    re-tooling the industry is their problem

    the gov't shouldn't enforce anything for them
    ISP's shouldn't have to give out customer informatin to anyone unless they want to etc

    the only people they have a legitimate claim against are the ones who are making cd's and re-selling them as originals (asia) for which they are actually losing *REAL* sales (pepole who DID ACTUALLY PUT DOWN THE MONEY instead of the RIAA claiming they would have)

    the whole thing is insane.. and it's sad that America has become the bastion for these litigious fuckwitted assclowns

    i've worked that friendly neighborhood computer store

    and i would rather pay for a dell than overpay 4x for an already outdated used machine

    trust friendly they are not, they're 2x as vicious as any oem because they have to be to survive.. they regularly lie thier asses off, grossly underpay for anything they buy and regularly fuck everyoen who comes in the door over

    i've worked for 2 different small computer stores and both worked the same way

    criminal? case in point, my best friend (yes the same one who got fucked by the Apple store if you read that post) is being chased by ebay/paypal right now, why you ask? because he sold a $2k laptop on ebay, what he didn't know was the asshole who bought it was using a stolen card so he took the money and now they're saying he's liable for the damages.. he's talked with several other people in other states who have been fucked over by the same guy.. i wonder if that guy got his information by doing something like this (he's been using stolen account information including CC#'s to rip people off all over the country from New Jersey)

    (there is actually a bit more detail to this story, the guy thought the laptop was mine because i was trying to help my friend sell it so he was actually trying to fuck me over as he's the friend of an IRC enemy.. yes sometimes the real and virtual world battles bleed together)
