  1. Re:It's been done before... on Microsoft Patents Interactive Entertainment · · Score: 1

Nope. Prior art has to be in the public domain. That's it. If I publish (over the internet will do, providing it can be shown that there was a real opportunity for people ro see it) something and the next day someone tries to patent the same idea, my prior art will invalidate that patent.

I can even publish by stapling my idea to a tree in Washington DC, providing I can prove it was there before the application date. Telling one of my mates whilst in the middle of the Atlantic in a small yacht where neither of us has no way to tell anyone else would not constitute public knowledge and wouldn't be prior art as the public in general had no access to the knowledge.

I could time a lecture at a comference to finish just 10 seconds before you file your patent and that chould be seen as prior art as I was telling those members of the public who would need to know..... Except we have a resolution of one day so in a case like this the information would be a little too late but with new online filing systems (as used at the EPO) this could change soon.

There are delays built in to the system whereby the searching of a patent application is delayed a few months so that all prior art publications can be collected together but anything published before the fioling date is valid prior art.

It doesn't work like that either.........

the Application IN IT'S PRESENT FORM should be rejected - but this always happens, during the granting process, the application will be rewritten to be different over the prior art. Tha applicant will always ask for more than they have inventied, just incase they get an examiner who is half-asleep.......

This is the fun bit where examiners get to fight with lawyers over what is and isn't new ;)

Obviously a bad examiner will let something through that's not correct whereas a good one will only allow patentable matter through.

It's actually a little more complex than that even, but remember that what you are reading is the application, not the granted patent which *should* have different claims, assuming there is prior art ;)

But CDMA is a waste of fucking money in that region because ALL their neighbours use GSM. Eventually the GSM people (i.e. Vodaphone et al.) will move in and people will change to GSM anyway just so they can use their phones when away from their own country. Even in the States you can use a GSM phone. Whilst CDMA is a better, newer technology than GSM it's losing out to GSM in the world, and GSM has an upgrade path to next genereation stuff.

So fine, install a hugely expensive CDMA network. The GSM people will move in anyway, people will buy GSM phones and your precious US network will go bust. That's the price for FORCING a choice on someone.

If they want a GSM network, build them a GSM network. They will still have to pay for it, you will still get your blood^h^h^h^h^hoil money and Bush will still get re-elected.

D GPS works, as described, by comparing it's known location with that received from the satellites and transmits - in real time - the correction factor, so the correction factor varies with the changing position give by GPS. It requires the DGPS station to be fairly close to the handset as it needs to be using the same satellites - and therefore to be receiving the same information. So non-systematic errors are equally well fixed, in fact the error is non-systematic, it's simply a less accurate measure of the time given by the atomic clock on each satellite (less decimal places) which leads to a larger "cocked hat" for the handset to be located inside (cocker hat from the old days of triangulation where you drew lines for the bearings of three places and assumed you were inside the small triangle where they intercepted.

Something I still practice when out sailing (or mountaineering etc) just in case my GPS packs up ;)

They also had a much more obvious clock with a real tick-tock to it where as the NOAA ones just went tick tick tick :)

We had a 1.5m dish made from chickenwire and an LMB made from a coffee jar, all connected to an HF receiver and a BBC microcomputer. As a kid it was quite spooky almost to listen for the clock pulses as the satellites came over the horizon - and then to watch the pictures build up line by line on the screen.
