    Being that U2 knows jack sh!t about theatrical productions and are only writing the score and lyrics, I don't see why they should be credited for anything more than that.

    Julie Taymore is a theatrical genius with many Stage and Film productions under her belt. And she will be the one responsible for bringing the work as a whole to fruition. Her artiistic vision will be driving everyting from costume and set design to cast selection and direction. And yes, she will even have a large say and input into the work that U2 produces for her production.

    I don't know if any of you have seen Titus, but I suggest you check that out, since she has a knack for giving her productions a strong artistic signature and I'm certain this wont be any different. Which means that quite a few die hard fans will probably hate it because it will not be literal from canon.

  3. Simple: Don't Sign any agreement you do not like on Crazy Non-Compete Contracts? · · Score: 2, Interesting

    Having 10 years experience providing development and architecture services to startups, I've seen plenty of conntracts, so I might have a couple useful tips for you.

    As far as non-competes go, you have to first look at what the laws of your State are.
    If you are in a Right to Work State such as California, you can safely sign an agreement that says you may not compete or work for a competitor who competes.
    This is because Right to work means just that, the State recognizes that you have the right to earn a living by your trade and that no entity save the State itself may revoke that right nor confine or restrict that right in anyway. So even if you do sign that document and you do go to work for or against the client later, there is nothing they can do about it.

    Now, if you don't live in a right to work state such as Washington, the State will allow a contracts terms to restrict you from plying your trade.
    In essence, they see you as the clients little bitch for signing such an agreement and your ability to be employed is now bound by those terms.
    Here, you will need to negotiate through those terms. Simply inform the client that while you would like to assist them, you are unable to sign the contract as it is currently written because it would effectively prohibit you from practicing your trade as a means of livelyhood and cause you significant harm.

    What do you do if they refuse? Then walk away. Personally, I've never had a client refuse to revise the contract to my liking.
    I've sometimes had a few days of ping pong and negotiations, but in the end I've always gotten exactly what I ask for.

    But there are other things to look out for as well.
    Ownership and Assignment are the first things I look out for, and the areas I read most closely.

    Look out for crap like this:
    "Subject to the terms of this Agreement, Consultant hereby assigns and transfer to the Client its entire right, title and interest, including without limitation all copyrights, patents, inventions, trade secrets, trademarks, trade names, service marks, trade dress, and all other intellectual property rights, in and to the Deliverables. To the extent that such assignment and transfer may not, by operation of law or otherwise, fully convey to the Client the foregoing rights, Consultant hereby grants to the Client a worldwide, irrevocable, exclusive, fully transferable, unrestricted right and license to use, execute, display, reproduce, distribute, modify, publicly perform, publicly display, sell, lease, license, sublicense, and otherwise transfer, and to authorize one or more third Parties to do some or all of the foregoing, with respect to the Deliverables in any form or medium, whether now known or later developed."

    Just a little one sided don't ya think?
    What the bolded bit means is that any pre-existing code I may allow to enter the code that comprises the deliverable is now theirs as if they had written it themselves. Additionally, anything I may generate while working on that project, I would never be able to again utilize. Now, enforcing that is a different matter... but I prefer to sign all of my contracts in good faith.

    So here is the language I provide as my alternative language if they are to engage my services:
    "Subject to the terms of this Agreement, Consultant hereby grants to the Client a worldwide, irrevocable, exclusive, fully transferable, unrestricted right and license to use, execute, display, reproduce, distribute, modify, publicly perform, publicly display, sell, lease, license, sublicense, and otherwise transfer, and to authorize one or more third Parties to do some or all of the foregoing, with respect to the Deliverables in any form or medium, whether now known or later developed."

    Essentially, it's theirs to use and abuse with my own interests and entitlements maintained.
    Not at all as strong as the GPL, but that's the point, they get the unfettered usage they want, but I maintain my ownersip of my existing code and any new knowl

    YES: Any corporation with Market Dominance will become complacent and anti-consumer. The question here is will they become anti-competitive? There are no laws against being anti-consumer, but playing dirty tricks o your opponents is a no no. The market assumes that consumers will leave even to a lesser rival if you walk all over your customers.

    NO: It's about mentality. Apple, even in their early 80's heyday showed that they could play well with others. They worked hand in hand with other software companies like Microsoft, licensing their products fairly and squarely. Microsoft on the other hand has shown a mentaility of backstabbing and treachery when it comes to dealing with everyone else. So in this respect, it's the corporate culture itself that dictates market behavior given an amount of power. And while a corporation may change with power, it's underlying clture will dictate just how totalitarian they become.

    MAYBE: Apple has always supported closed systems, enforcing a marriage of hardware and software, sometimes to the users disadvantage. But, there's been forrays into openess such as with the short lived Apple Clone program and Apple has played well with OSS. However, the real reasons for these moves are debatable.

    So on the whole, I think Apple would be a lesser of two evils. Since any corporation with market dominance becomes corrupted by that power, it's the degreee of corruption that will be fostered within the corporations culture that dictates just how bad it can get. And Apple has shown that they know how to play fair and tend to foster innovation, where MS has always shown they like to play dirty and trample other peoples innovation.

    I'm a very sex positive guy and have a total of 4 porno DVDs. These sit happily out in plain view within my collection of over 300 DVDs.
    Being that I am an above average DVD consumer, I really don't see where the Adult Entertainment Industry thinks they have any real clout in the DVD market.
    In fact, the only real use of a HD-DVD or BluRay disc I see that makes good sense for the adult sector is bundling movies in Standard Definition together on one disc to try to bolster disc sales I would imagine would be waning due to broadband video download becoming more obiquitous.

    The very notion of the adult sector claiming that they are somehow driving global DVD sales... that's a laughable notion at best.
    It really makes me wonder just how much drugs those guys shove up their nose in a day.

    Hey, if you're a telco that intentionally cripples the bluetooth features on its phones to the point of uselessness and still sells it as bluetooth even after a class action lawsuit, you've already created enough of a high abuse environment for me as a customer to never want to ever return.

For example, Bluetooth technology allows you to use a wireless headset to place and receive calls." ...While we all know that Verizon intentionally cripples the Bluetooth file transfer features to the point that you have to use Verizons pay per transfer cellular feature.

    So what self respecting /. user uses Verizon? And if you use it and pay for it out of pocket... WHY???
    My #1 use for Bluetooth is file transfer to store media on my 1G of built in storage on my phone as I would a USB HD, but transferable without the cables.

    I switched from Verizon to Cingluar a couple years ago and have been happy to transfer files from my desktop to my cell to my laptop or other peoples computers for years now. I can also plug it in and use it as I would a USB HD. But since I am in SF and so many techies here use MacBooks, because MacBooks lets Pros work like they want, it's just easier to have BT file transfer. BT is also great for syncing my Apple Address Book and iCal to my phone, infact, it syncs multiple computers via blutooth to my contacts and calendar. Verizons crippleware requires you plug in a USB cable and use proprietary software to do this. My Motorola and Mac just use iSync, which comes with my Mac from Apple with OS X for free.

    I tried switching to HELIO last month, but I found out after subscribing that their bluetooth was HEADSET ONLY. I unsubscribed within 30 minutes, that's how long it took me to get home and find that my workstation and handset could not talk to each other... my workstation could see the handset but the file browser was "FEATURE NOT AVAILABLE ON THIS DEVICE" and they wanted me to install some proprietary software/spyware. Not suprisingly, HELIO uses Verizons and Sprints networks. I'd be willing to bet $500.00 that there is a contractual arrangement for use of the Verizon network that requires HELIO (EARTHLINK) to cripple Bluetooth to headset only.

    And I am glad HELIO crippled their devices in this way without making it clear. I unsubbed, returned my eqpt and went back to Cingular with the only hitch that HELIO was playing games on my number being assigned back to CINGULAR (it took 3 days!!! While Cingular had the number to SPRINT/HELIO inside that 30 minute window) Because I am now just waiting for the Apple iPhone to come out and I will gladly drop cash for that.. ESP since SF will be wifi enabled withiin a year of the phones launch and will be one of the first cell/wifi phones on the market and by far the coolest.

    iPhone on Verizon????

    You'll have to install so many hacks on the iPhone to get it to work like Cingular users will have it work out of the box that you might as well just sign it off as "PWNED to some hacker in Beijing".

    Are you really so sure? I dropped out of highschool because all I was doing was memorizing and havig faith that what I was being told to memorize was actually factual knowledge. I left college after 1 year for the exact same reasons.

    Through my own initiative I researched and studied the subjects that most interested me and made a successfull career from that knowledge.
    But the "halls of higher learning" and those "hallowed halls" have quite a bit more in common than you think.

    Unless you could get this to somehow work with a holographic projection so you could see what you are doing in a realtime fashion, then, the pics in the article speak for themselves.

    And even if it did work, what about design details? It would seem not a truly optimal design solution, but an interesting 3D scratch pad concept

    Perhaps this would work if say, general shapes were queried against an object database or furniture catalogue.
    From the shape and dimensions specified, the best matches in the inventory could be selected and ordered with whatever options available. However, I would not see much of a market beyond interior designers and the like... but who knows.

    Firefox does not provide any reference to a dragdrop file from the users FileSystem.
    This is a HUGE issue as it prevents Drag and Drop file uploads for AJAX applications.
    Sure, there is a FF Extension to solve this, but requires the user to install for such a behavior to work.

    This should be a native solution. Can Firefox please reconsider their stance on this issue?
    For years, drag and dropping of files into application windows has been EXPECTED behavior.
    Firefox should allow AJAX applications the same sort of functionality.
    As it stands, Firefox is the only browser I can not create a strictly script based solution for.

    Below is an example. As we can see, the dragdrop event is useless except for preventing the dragdrop event from continuing propagation after we capture it.

    Also, firefox (on Mac at least) does not properly recognize an onBlur when I click on a non-firefox application window.
    onBlur only happens when we click on a 2nd Firefox browser window - bad bad bad.
    This and the above dragdrop issue means that Firefox is not properly supporting OS integration.
    Addressing these issues would be huge in more robust user experience and application capabilities for AJAX developers.

    They offer $90.00 a month for 10mbps DSL, VOIP phone and HD/Digital cable.
    Sweet deal, but here in SF they seem to be quite spotty as to what buildings have it.. to the point of being a joke.
    But I'm just bitter because the building across the street has it and my lofts I live in doesn't.
    Instead I have Earthlink DSL which gives me 8mbps and VOIP phone for $70.
    So I guess 2 out of 3 ain't bad.

    To dismiss the circumstantial evidence as meritless due to a lack of a corpse is incorrect. As far as circumstantial evidence goes, this is pretty damning. And it would be imprudent of the police not to have Hans arrested with the evidence they have. The prosecuter could make a good case for murder with the knowledge they have made public at this time.

    The fact that the books were bought after the murder means he probably would not be charged with murder in the 1st degree, but definitely 2nd degree. So it's likely he will not get a death penalty charge, but that's just a guess.

    Personally, unless the defense comes up with some exceptionally strong counter arguements, Scott Peterson is about to get a new buddy.

    Back in the day when networks were new and few people had the indepth understanding of what was still an arcane field, the recruiting of a blackhat made a lot of sense for trying to make more robust security solutions. But now, we have hundreds of thousands of qualified people and many IT Professionals are highly trained in the area of Network Security. And the blackhats these days by and large are either worm authors/botnet controllers or crackers who use scripted 'sploits to ply their trade. So no, I see no need for the Corporate Enterprise to open itself up to the liability it would face in the event of the "reformed" blackhat deciding to "play around" a little bit with employee data. There's already been enough fallout over loss of customer data and security concerns. Knowingly hiring a convicted felon to entrust that data to wold only serve to fuel lawsuits in the event a security breach did take place.

    If a blackhat is skilled and "reformed" and truly interested in security, they can offer their services as an outside consultant.
    Or perhaps the Military could make use of knowledgeable blackhats putting them on the front lines of electronic warfare.
    But I agree that in the workplace they should be treated as any other convict when applying for a position.

    I sold my iPod 4G over a year ago due to disuse since I work at home and don't get out much except for meetings or for nightlife, and an iPod is useless in a restaurant or a club.

    Anyway, I was looking into getting a 6G in the next week or two and read up on Zune.
    I had to say that even though it's a non-starter because it's PC only and wont work with iTunes or the iTunes music store, I found it very compelling.

    First off, it has a big screen.
    This is huge! One of my gripes and the reason why I never went in for the 5 or 6G with the photos and video stuff is because the screen is so frakkin tiny.
    I mean WTF? How could Apple, the kings of quality UI think that was sufficient? I know I'm not the only one, either. Remember the fake iPod mockups we saw online claming to be the 6G iPod, half of them showed a vastly increased screen size. Apple failed to significantly alter the display, ignoring the obvious flaw.

    Wireless!
    I can't tell you how annoying I always found it to have to take my iPod out of it's cradle that was jacked into my Home Theatre and have the music stop just so I could add some tracks/playlists to my iPod. With Apple having Airport/Airtunes and bluetooth it just seemed logical to converge that with iPod.
    Instead, Apple decided to go the cheap route and not include that sort of functionality. I mean, imagine a wifi or bt enabled iPod... sharing photos and files with other iPod users or those with BT enabled cellphones/handhelds/laptops. You'd think Apple would have seen the value in that.

    So it's good to see MS coming out with a strong offering in the MP3 player market. Apple needs a good kick in the pants to wake them up from their warm after sex glow they've had since taking the market by storm.
