    In a world where content managers from the MPAA and RIAA membership are screaming and whining that the sky is falling, Jim has seen the potential since beginning. His testimony at the Napster hearings, was the high point of the and actually gave me some hope. The same day, Lars Ulrich from Metallica was whining "Napster ripped me off," Jim Griffin was talking about increasing the size of the musical pie from $40 billion to $100 billion per year. Basically telling people to quit fighting over who gets what part of the pie, lets make a bigger pie, so everyone can get a slice. Every word he said that day, still applies today. It's well worth a listen.

    The other testimony that day was prompted me to found the boycott-riaa website, and later IMIRA.org after I left boycott-riaa in October this year. Jim's ideas may not be perfect but they are much better for all involved than the current situation.

    Senator Hatch is a songwriter, who stands to benefit from legislation like this. In 2002 he made $18,000 in songwriting royalties. He stands to benefit directly financially from any copyright legislation,

    Imagine the outcry from Jack Valenti or Cary Sherman if Wayne Rosso or Anne Gabriel were writing the legislation. The screams of the MPAA and RIAA would be heard around the world. The mainstream press would be doing their normal reporting by press release and Wayne and Anne would be run out of town on a rail..

    Is that copyright eventually expires, DRM doesn't. Under the DMCA after the copyright expires if you break the DRM you are still guilty of a felony. While this is moraly wrong, it is the current law. Get off of your rear and write you congresscritter to get this changed. NOW!

    Cary Sherman has stated before the money collected will go to the enforcemnt process, not the artists or even their masters, err labels...

    LA Times said in this story "The proceeds from any trials or settlements will be kept by the RIAA to cover the cost of its anti-piracy campaigns, rather than being used to compensate labels and artists."

    We've downloaded the amnesty documents from the RIAA owned Music United and made them available on boycott-riaa.com for those of you who don't want your ip grabbed by the borg.
    2 page PDF describing the program
    2 page PDFof the affidavit.

    Remember the RIAA only represents the interests of labels and performers and can only give amnesty for those rights. The RIAA doe NOT represent the copyrights of the publishers and songwriters who could still sue. And they could subpoena the RIAA for that information. This is a publicity stunt. If you accept the program, bend over and spread'em you're about to get screwed.

    Webcasters pay for performance royalties, terrestial radio doesn't.

    Webcasters have to pay the performance royalty based on the number of listeners, Terrestial radio doesn't pay performance royalites, period.

    Both have to have ASCAP, BMI, SESAC licensing.

    As an example when you hear Britneys Pears on the radio while driving, the songwriter gets paid (about 8.5 cents as I recall) no matter how many listeners are tuned in. When Britneys Pears is played on a webcaster, the song writer still gets theirs, but in addition Britney and her label get a royalty based on the number of listeners..Hence if you can afford the equipment, its cheaper to broadcast rather than webcast. (at least licensing wise)

    Actually you can ask the credit bureaus to put a code word into you credit report with the instructions to not issue credit to anyone who doesn't give the proper code word, saying that all potential creditors should contact you to verify credit applications

    I used to be a loan officer at a bank (on the phone) and we saw these warnings all too often. Usually the person will tell you up front about it, but from time to time they would play games with you, and make you ask. Those were the ones who raised my suspicions. We once nailed a guy trying to get a car loan for 25K by requiring him to visit the local branch to sign the paperwork. The "Loan officer" he met with was an FBI agent. I never heard what the result was, but I did get a thank you letter from the victim.

    I have to wonder as well. Here's why. I've lived in three different voting districts in my area in the past 8 years. Every person who was working the polls was 60+ years of age (common hair color was white or blue)and seemed very comfortable going through their printed out lists, I'm not so sure they would be very comfortable with a computer based voting system.

    I have to wonder how knowledgeable they would be about the setup, and how they would handle the problems that would invaribly arise during the voting. Power failures is the first to come to mind. Can my 78 year old mother read the screen? For that matter if it looks like a computer she'll probably leave without voting ("I don't know how to use the damn thing can you vote for me?" would be something like she would probably say.

    Me I would like to be able to vote from my pc at home, if they could just work out a way to get me my "I voted" sticker in realtime...

    Actions speak louder than words. By appointing Mr Mitch Bainwol as its new chairman and ceo, the Recording Industry Association of America proves once again that its members and board of directors will seek to continue to desperately shore up their antiquated business model through legislation instead of innovation. Rather than seeking someone who's respected by both sides to actively work for solutions, they've hired another Washington insider to push their myopic agenda in Congress. The RIAA often calls for a "Free Market Solution," but nonetheless continually balks at solutions, usually rejecting them out of hand. Its members are all for a "Free Market" - as long as they control it. So instead of celebrating a wind of change by calling off our protests on August 1 and 2, we'll re-double our efforts to make them dates the music industry in general, and the RIAA in particular, will remember.     If you have a ECF/Pacer account you access the court doucments you can find out. Just go to http://ecf.dcd.uscourts.gov). There is a liink there to open a pacer account. You need an account -- access costs a 7 cents per page, but is otherwise public via the web. The subpoenas include usernames.

    Three years ago, right after I started boycott-riaa.com. The RIAA called and wanted to "talk." I had a 2 hour conversation with the then Internet Evangelist, Karen Allen about this very thing...

    That the technology was there and it had non infringing uses as well as infringing uses. The Professional Photographers Assn. doesn't sue Nikon for making a product that could be used to copy copyrighted photos, but instead goes directly after the infringers.

    The RIAA has wasted 3 years, in actually getting artists paid for their work, while pumping hot air up congresscrittwers rears to get more and more control over the internet. They aready have approx. 85% of the physical distrbution, and now they are trying to grab the same thing with the internet..

    On a side note the RIAA actually took the time to fill out my contact script on boycott-riaa.com. They called and wanted to "talk." with the press release apprx 1/2 before they released it, which I have to admit surprised he daylights out of me..being as both Hilary Rosen and Amy Weiss (their PR flak) have my email address.
