    What you missed was that he listed an actual PowerBook on ebay - and actually SOLD said PowerBook on eBay to a legitimate buyer.

    Entertainingly, the guy who won the auction was also an illegitimate account that got shut down by ebay, IIRC.

    Yes I read the whole thing - he DID use paypal to get funds to ship the item.

    Yeah? He got the funds from other forum members for the purposes of sending a P-P-P-Powerbook... That sure is fraud!

    He DID use eBay to sell a real item but ACTUALLY shipped a fake item

    The 'sale' was made outside of ebay entirely. The scammer contacted him outside of the auction to make a sale independent of ebay. (also note, the actual winner of the auction was also a fraudulant account that was later closed down)

    He DID use fedex to ship a fraudulent item.

    He used Fedex to ship a P-P-P-Powerbook. It's not a fraudulent item if the guy isn't paying you. He didn't send his money to the screwy fake escrow site and never intended to pay. The item wasn't insured, only the customs value was set at $2000. Fedex was not defrauded in any way.

    He wasn't arguing on the phone. He was talking to the barbershop owner. I think you read Rhig's posting of the events wrong. He heard the barber on the phone. Then, after, he heard the eastern european reciever of the package talking to the barber about his packages.

    MyNameIsJeff didn't register it for himself. Forum poster Str8Dog bought it because he "couldn't help himself." I assume he did it to support the whole event when he wasn't really in a position to help in other ways.

    Who the hell cares if it was registered for a stupid reason. It's not like there's a huge demand for p-p-p-powerbook.com for other purposes.

    Perhaps people are being told to check it out because... I don't know... others are finding it amusing?

    No, wait. That's much too simple. It's obviously an elaborate conspiracy by dozens of completely independant people on the SA forums.

    I would hate to have a disc based portable. GBA carts are tiny and take a beating well. I put them in my pocket with change and keys and things and they're fine. I can drop them, and they're fine. It's hard to kill them. With a portable, you'll always end up losing cases and things sometimes. You can quite easily scratch your games to hell. Suddenly you have to carry around a bunch of little CDs in cases to have a few games with you. You'll never make them as small and durable as you can make a cart.

    I'm sure you can sell it if you make the advantage big enough to offset the problems, but cartridges are great for portable game systems.

    They're saying that the other allegations only have merit if VeriSign is found to be correct in its interpretation. Therefore it's idiotic to argue them while that point is still up in the air. ICANN's just saying that they should prove the underlying point first, and then come back and deal with the other stuff later if they're found to be correct.

    Fair use, btw, is granted permission by the copyright act and the copyright holder has no choice but to implicitly grant that permission.

    There's no fair use under Canadian copyright law. The Copyright Act has exceptions provided for what it termed 'fair dealing'. Canadian courts have specifically refused to use examples from American case law with regards to fair use, as the provisions under the two different schemes are different in fundamental ways.

    So in what world is putting a file that you do _NOT_ own the copyright on, and have not actually obtained permission from the copyright holder to copy for purposes beyond fair use, in a publicly shared folder for others to obtain _not_ a violation of the copyright act?

    The argument that was used is that placing files in shared folders is passive. Distribution, which is what is prohibited, is active. It seems to be comparable to someone who sends out a list of CDs they have, and then sends out copies to whomever wants them, but with a computer automating these steps on the user's behalf. This finding is contrary to what I assumed the courts would find on the issue, but I can at least understand the argument in this case.

    Canadian copyright law makes no distinction to private copies made to media that are covered by the levy and those that are not. The two sections of the Copyright Act are not directly connected. Private copies may be made to any recording media that is not specifically prohibited for copying (nothing, as far as I know, is currently prohibited, it's just standard language that gets thrown into acts so they don't need to rewrite the things if they want to change something small), while the levy is paid on specifically identified media types that are most likely to be used for music recording.

    So, to summarize, it doesn't matter if a medium is levied or not, you can still copy to it.

    The issue is that distribution of copies is prohibited under the act, as is transmission via telecommunications. This is why downloading is legal, as there are no sections of the act that prohibit how you go about copying, while uploading is not, as there are sections that specifically prohibit the action.

    Bwah? The uploading part is the easiest to prove. If someone sets up a query to find songs that are being shared, downloads them, confirms that they are in fact what they are labeled to be, then the guy's uploaded them, as he sent them to the guy that checked if they were what they said they were.

    Assuming they can prove actual identity, this part is easy.

    Except that the law specifically mentions that creating a copy for the purposes of transmitting via a telecommunications system is prohibited, as is transmittal of an original. The "It's not really a copy" argument doesn't hold water in light of this.

    Hate speech indeed should be discouraged but cannot and should not be a constitutional issue. It should be a municipal issue, that should be dealt with by the locals. Such as fun punishments like everyone gets to throw tomatoes at the racist bitch or lets spit on him punishment. But unfortunately our legal rights also protect against cruel and unusual punishement.

    Of course it should be a constitutional issue. If it weren't mentioned in the Charter it wouldn't be enforcable, as any laws abridging the free speech clause would be unconstitutional. Then we'd end up with either the judiciary striking down the municipal law or the use of the notwithstanding clause at the federal or provincial level.

    I don't like some of the specifics of the hate speech section, but it's definitely the right place to address it if it needs to be addressed.

    Limitations on free speech should not exist, unless the spoken words border on treason or racism. Even extremist political views should be allowed, as ridiculously conservative or communist they may get.

    I have no idea why you threw in extremist political views at the end of your post. I can't think of a single example where they'd fall under the hate speech clause unless they included something stupid like calling for genocide.

    Wing Commander 4 is a great game to show how difficulty levels work... If you play as a rookie, it's hard for anyone to die, but on Nightmare, it's almost impossible to beat the game.

    Just what you'd expect, and probably run the risk of the occasional light-runner, since there's no flashing red to tell you that it changed because someone is now crossing the road.

    You don't need one, because that's the only time a flashing green light will change in Vancouver.

    Lights that change on a regular schedule, along with being pedestrian controlled are normal solid green lights. Those aren't even really pedestrian controlled as far as I can tell, even if they have the button, although the crossing signal won't go on at some intersections when the light changes unless you press it.

    It's not like any of the old Wing Commander and Ultima makers were really involved anymore. The Maverick team that was working on Wing Commander got dissolved a few years back, for example. This has no real impact on later developments of these series, as new teams would need to be created anyway.

    Yeah... Because Wing Commander was sustainable with the horrible finances OSI had! Without EA there never would have been a WC3 or 4, as there's no way Origin could have funded them.

    I hope you'll also realize that the Wing Commander movie really had nothing to do with EA. When Chris Roberts left the company after Wing Commander 4 he negotiated for the movie rights to Wing Commander for a certain number of years. After that, there wasn't any EA involvement to speak of.

    Bullshit... while Wing Commander 2 is my favourite Origin game, you can't exactly call WC3 or 4 crappy... also, Privateer went through the end of its development cycle while OSI belonged to EA.
