    Didn't Creative say it used a similar menu system in its earlier MP3 players? If it did use a similar system at least 1 year before it filed for the patent, then its patent may be barred. In patent law, if you use your invention in the public or sell it, a one year clock starts in which you must file a patent for that invention. Otherwise, you are barred from patenting that invention. I've read some other posts saying Creative used a similar menu system in its Nomads dating back to 1999. That would clearly be more than a year before it filed this current patent (2001). Thus, Creative's patent may be barred by statute.

    Not exactly. In civil litigation, the plaintiff has to make a prima facie case, meaning he has to sufficiently plead his case. If he does that, then the burden gets shifted to the defendant. This goes on back and forth as both sides present evidence, testimony, arguments about the law, etc. At the end, whomever pushes the burden slightly past the 50% mark wins.

    I'm currently a first year law student. I majored in applied mathematics with a computer science emphasis. I have about 2 years of programming experience. I really enjoy law school and would love to someday work as in-house counsel at a software company. However, I really like the law and I don't necessarily have to end up doing something with software. My degree does not allow me to sit on the patent bar (I need 2 more semesters of physics). However, if your degree is actually CS, you can sit for the patent bar and become a patent lawyer. Patent lawyers, especially in CS and EE, are in HIGH demand. Finding a job after law school is very competitive but if you're a CS or EE major, you can find a job relatively easy, as long as you don't completely bomb law school. The pay is usually very high, starting about $125k-$135k right out of law school with bonuses from $10-30k. I've noticed some of my friends with EE degrees are able to get interviews with not as good grades much easier than those without an EE degree. Anyways, I don't think law school is nearly as difficult as math or CS, but the workload is extreme. I had to get used to doing tons of reading in a relatively short period of time and legal writing. I believe English majors have a pretty good advantage in law school, or any other major that requires lots of reading and writing. However, math and CS skills such as logical and analytical thinking do help out a ton. Enough rambling. If you're interested in law school, get started with learning how to take the LSAT. It's very "learnable," and having a CS background will help in the logic games section.

    [IANAL but I just finished my 1st semester of law school.] Nick doesn't have to be in California for a CA court to have personal jurisdiction. They just need to show minimum contacts and if Nick purposefully availed himself to CA. It seems likely that they will be able to show this since he specifically published trade secrets of Apple, which is located in CA and he did this for a period of 5-6 years. Plus, it was reasonable foreseeable that Apple would sue Nick since history shows that Apple is very sue happy. He probably can't move for change of venue or dismissal since those are usually granted based on convenience factors and I believe most courts don't consider it very inconvenient to take a plane from MA to CA.

    Actually, conspiracy requires that two or more people agree to commit a crime. They need to have intent to form the agreement and intent to accomplish the criminal objectives. Some states require an overt act, which clearly, in this case, the modding and putting on display of the xboxes, shows the overt act.

    Not exactly. Apple's stock price has gone up considerably over the past six months. It's stock price closed at $55.50 on Friday but six onths ago, it was $27-28. If we consider that the article was written during spring semester of 2004, the lastest that would be would be late May to early June, 2004 which is about 6 months ago. At that time, Apple was probably worth $11-12 billion. Another intersting note, EA's stock has gone down a bit since six months ago. It's worth around $14.5 billion now.

    People have been reporting problems with upgrading from 0.8 to 0.9. It seems like there may be a compatibility problem with older profiles that causes 0.9 to freeze. I think I may wait a while before upgrading since 0.8 works fine for me.

    Check it out. The 2004 Prius comes with Bluetooth to connect to mobile phones with Bluetooth. This will come in very handy with my Sony Ericsson T68i. I currently use a Jabra BT200 wireless headset while driving, but BT built into a car sounds way cooler.

    I thought IBM had a paid up perpetual license to include UNIX code in AIX that they bought from Novell. This means they don't have to pay ongoing royalties.

    It's not just Linksys that does this. I know of a couple other router manufacturers that for sure use Linux as the OS that make no mention of Linux or GPL. I'm sure there are quite a few more.

    The weird thing to me is that if SCO had approached IBM quietly and said: "hey, it looks like we have some IP problems here - why don't you buy us out and resolve those problems" then there is a good chance IBM might have considered it.
    I have a friend that works for SCO and I asked him the same thing. He told me that they DID approach IBM and IBM basically told them to go fly a kite.

    Being a math major myself, I can say that majoring in math does not imply being good at doing calculations in your head. I hardly ever use my calculator in class and on exams. Majoring in math involves more analytical thinking -- proving theorems, etc.

    I really like the system Apple's got for distributing songs electronically. How long before they come up with some system for distributing movies in a similar way and price them at $.99 or even $1.99?
