  1. Yes, but on SCO Code to be Protected in Closed Court · · Score: 1

While it is a trade secret, the code is presumeably already in the field. I mean, they are saying "Hey, this code is ours and it's out in the wild and we want compensation." Eventually, in order to exact license for this code they will have to disclose it to anyone they attempt to sue. It would seem to serve the better public good to disclose it now, since the kernel is already being distributed, supposedly, with this code. I would imagine that judgment will resume with this code held secret but that eventually it will come out regardless of the outcome. If IBM loses, then each subsequent litigation will include revealing this code to the otherside for SCO. More importantly, I don't see any judge saying "Okay, the code is in violation and now all you companies have to leave it there and pay SCO" when the OS movement is saying "Give us a chance to remove the code." No judge is going to just leave the opportunity in place for continued violation. If IBM wins, then it's going to depend on the summary of the issue. Either the code is SCO's but IBM didn't put it in the kernel or the code is not SCO and it is moot how it got in there.

Don't own a TiVo. I think they're great, don't get me wrong. But with cable running me $60mth for only 100 channels I can't see adding the subscription to TiVo anytime soon. There will always be a market for TV. The big 3 networks thought cable would kill them, and it didn't. PVR's won't kill TV either. This is the same paranoia that keeps the RIAA and MPAA pursuing 15 year olds for trading Britany Spears songs.

C'Mon. And I hate to break it to folks, but thousands of votes every year are thrown out and not just the ones that can't be read. If a state has left over ballots that total less than it would take to change the outcome, they often toss them (usually absentee ballots). This is why in a national election, you never really know the true total, only the total of what was counted. Some votes are going to be lost, but frankly I'd rather count every vote as is then try to "determine voter intent." Especially if the voter doesn't take the time to learn the system.

When someone tries to repeal that tax, they will be dubbed "uncaring" and "anti-children." Furthermore, we'll hear the usual "Who is going to pay for the e-mail tax cut!?"
