The real point of SCO having Unix was to prevent monoploy. After all, look at the other players: IBM, SUN, HP, SGI, etc..a who's who of mainframe computing. Imagine the hurt caused if any one of them had full claim to Unix--the AT lawsuits would fly! So they let a small, little guy have it instead of buying it from NEC/digital. Most of these company's Unices look nothing like SCO anymore. These companies have dumped 20+ years of their own research into Unix--and that work is theirs to place where ever they choose. Who's to say they can't take their own work and port it to something else!

That's clearly IBM's stand. From the stuff I've seen, they're not suing for outright patent or copyright infringement, but "license misapproperiation" type claims. In other words IBM learned stuff--not necessarily patented- and took it outside the family.

Wasn't SCO once the bad kid for porting Unix down to x86 so many years ago. Bought out by Caldera--who made their money developing Linux to beat SCO.

A massive game like Doom 3 is really cool, but they could have knocked out 2-3 smaller games that used better tech than Q3 by now. Also, the true PC game companies are ignoring large groups of players. There's a lot out there besides FPS. Even better games to be made using FPS engines--they are way under utilized. First, you and who's money is going to get that! Even the DOJ didn't get full access, only certian "specialists"! The point of disclosure, innovation if you will, is to get around the patent. Software is also copyrighted and DMCA'd. Without documents [even laid out specifications of operation], reverse engineering, or packet sniffing you won't get far legally! The most famous case of this type was the Xerox/Cannon Photocopier battles of the 80's. Xerox tried to patent all Photocoping. Cannon was able to look at the prints, schematics, machines and engineer a coppier that did not infringe. Xerox took them to court and lost the case because the judge was able to rule that the physical devices were different enough not to infringe. Software patents do not have that option.

My point is that the particulars are not disclosed in the patent before it is granted.

    Here's an example of a "software-style" patent:
Patent for a material transport device.
This device will transport a number of pieces or quantity of material beween two points in physical space.
The device or devices will consist of a number of wheels and/or other means of reducing of easing the motion of the device
The device or devices will consist of a container or containers of a various number of shapes and/or sizes in which to hold material.
The device would include attachments to one or more methods of powerment. This may include any combination of persons, animals, motors, or other material transport devices.
Devices may optionally be attached in a number of configurations including: Linear attachment and horizontal and/or vertical stacking.
anyway, you get the idea. These claims are the only thing attached to the patent! You can't see what I'm actually patenting to figure out how to get around it! My actual designs are protected by trade secret & copyright, so I don't have to submitt them.
If you haven't figured it out, I just patented pretty much every moving vehicle that carries stuff! wheelbarowws, wagons, ricshaw, dumptruck, train, pickup, ox drawn cart, etc... You have no recourse to prevent this from happening. You can't call up the PTO and tell 'um to stop. Once it's granted you cannot challange it or clarify it without paying huge court costs--quite often your own when I sue you! Common sense doesn't rule--the PTO refuses to take back poorly chosen patents, and the courts won't make them.

The problem is that no one has put arcade games, internet games, and rpgs together. The best example I can think of is Pokemon.

It was very nicely tiered across their line of products. You could take your handheld characters and use them to battle in 3D on the console! If you know anything about Pokemon, you'll understand what's next... It would have been the perfect arcade game! They attempted something like it with snap? but it was too low key. As an arcade game, they could have had big screen Poke-battles at the arcade, and connect them with the internet to other arcades. Then you could have standings, and lots of other stuff. And of course, you would take your original cart home and train up your monster after you lost horribily.

I think Id or EA could pull something like this off using PCs instead. Quake isn't really a general public style game--it's too violent. Something like Warcraft or Diablo would work. The key is to involve the spectators as well as the players! Lots of PC games would be cool to watch if you could see the big picture [a whole Quake, Warcraft, Diablo level at once] They would see things the players wouldn't notice.

The problem with software patents is lack of code disclosure. If the patent judges could compare line-by-line a MS .asp page feature with a php/apache page, they would laugh most of this stuff out of court. Unfortunately, they can't force them to include the patented code, because code is also protected under copyright and trade secret. The patent office is allowing a "black box" style patent--without even proof of a working system. They used to require detailed specs and proof of actual working devices. Now companies like Rambus can draw some pretty pictures and then prosecute the people who actually spend time and resources building the thing. This goes aginst 200 years of precedent!

That alone should be enough to get these thrown out, but patents don't work that way. They are assumed to be sacred, holy, creative genius by the courts until someone spends the time and money to strike each one down. [The flash ram would hold over reboots, and the CF card would store a little more stuff.
