    What about phishers, I can envision people callling asking for personal bank info and having the caller id ident them as calling from the bank in question! Very few things prompt me to be enthusiastic about regulation but this is one.

    That's the trouble with the internet and it's rapid and massive stream of information, some of it your not going to like. Find other ways than litigation to deal with it, as litigation just shines a 10 billion candlepower light on it for all the world to see.

    ISP's are private companys like ebay, ebay's policy is that they remove the an auction item if the IP of an item is questioned in any way (by anyone). No questions asked, no appeal. have your auctions questioned twice and they kick you off. Private company's are in it for the buck not to protect your rights, the real problem is the legal system that instills this level of fear in people and companys.
