Yes, clearly it was the politically connected Step-father who murdered the co-ed he was having an affair with.     Based on past Intel decisions, you're probably right on target;-)

    The reality is Intel is doing exactly what it is accused of doing. Make itself appear to be doing the same thing as OLPC, muddy the differences, and sow just enough confusion that OLPC, and AMD with them, tank. Its the same thing that Microsoft does on the software end, like their attempts to make Java "better."

    Most users don't know what the alternatives are. Though they know is that the bloated POS that they're using sucks, but they don't have the words or expertise to convey exactly how it sucks. I think what most users want is an OS that's fast, easy, works every time, and isn't ugly to look at.

    His dad is obviously a music pirate, otherwise the RIAA wouldn't be bringing the lawsuit. Since we all know that pirates' sons always takeover the family business, it doesn't take a genius to see that the only thing this kid needs from school is enough math to count all the billions of doallars he's going to steal from the hard working middle managers of the music business.

    They're doing him a favor. Really.

    You automatically lose the case.

    I may not be a lawyer, but I know this to be false. Don't give the RIAA any more power of fear than they already enjoy. Deponents can object, if a witness refuses the moving party can ask for a motion to compel, there are lots of rememdies other than automatically losing. The biggest problem isn't that the kid is going to miss school, its that they are attempting to take his deposition with only 24 hours notice. In my experience as a paralegal, again- IANAL, that is simply poor if not abusive practice.

    Cool. I did not know that and I am very much not a lawyer. Since almost all of my paralegal experience was civil litigation in Federal Court, and most of my Criminal Law knowledge comes from undergrad work, I did not know that. But I very much appreciate the information and will try and look into it further (especially since WA is just across the Columbia from me).

    IANAL either, but I don't think its entrapment, and it would not necessarily have happened at the Federal level. Since the spammer made the statements in open court, its his own fault for perjurying himself. That being said, in a Federal case both sides would disclose to each other the evidence they would be relying on for trial. So the Spammer would have listened to the audio beforehand and, hopefully, thereby avoid perjurying himself.

    This was small claims court though, and I don't think the rules of discovery are the same. At a higher court level in the state I'm sure they have discovery rules similar to those at the Federal level, but beyond that I don't know what the obligations are.

    Considering how much this guy hates spammers and sues them, I have every reason to believe that he knows the rules for the Small Claims court and followed them accordingly. But... perjury at any level is still perjury.

    IANAL, but I'd have to disagree. It is the DA's job to enforce the laws within their jurisdiction. Perjury is very much a crime, a felony even, and it would be within their purview to bring such a case.

    While I do have serious misgivings about the Judge in this case, I also realize that we're only hearing one side of the conflict. So I am hesitant to condemn her too much.

    So why then am I in favor of perjury charges against the spammer? Well, the spamemr's claims in court, and what he said over the phone are more factual in nature, so less given to being skewed. Plus the DA would be a gateway.

    If nothing else, I'd take what info you have of the Spammer case to the local DA. What the spammer did was perjury plain and simple. Even if Judge Judy doesn't say anything about it doesn't mean that the DA won't care. They're political animals, too. If you can generate some publicity as well, then its in the DA's best interest to "protect the community from such lies and charlatens."

    Several news sites are reporting that SCO has filed a lawsuit for $1.5 Billion against NASDAQ for harming their business model. "Our entire operation is predicated off of being able to pump and dump stock," CEO Darl McBride was quoted as saying outside the US Courthouse, "by threatening to delist our stock they are essentially claiming ownership over our business model."

    Technology experts Dan Lyons and Maureen O'Gara were also on hand to bolster SCO's claims. "We've seen all the SCO materials and while its far to secret to disclose, there is no doubt in our minds that NASDAQ is actually a front for Groklaw."

    Just wait a few months until they've spend 10x more time on the Wii than you have and I'm sure they'll be kicking your butt again. Will that mean the Wii controls have suddenly become less intuitive?

    Well... We've had it since December, and they already play it 10x more than I do. But, other than that, I'm sure you're right;-)
