    I believe that's more because the MS contract they have says something about not selling a system without ANY OS. So they just include something that's "technically" an OS... even though probably 98% of the people that buy them would never install it or use it.

    At least that's how I previously understood it.

    Yes. We know. And you usually have to go through about 50 pages to find them. Usually buried somewhere in the Business sections. MS doesn't want them to advertise systems without Windows.

    If this report is true, perhaps some in the industry are finally coming to their senses.

    I doubt that. It'll probably end up being them claiming it was their great idea all along and it's "best for the artists" and blah blah blah. They would never admit that DRM is a failure.

    How about a disclaimer in their Terms of Service (scroll down the the actual Disclaimer section)?

    Notably these sections:
    MySpace.com is not responsible for the conduct, whether online or offline, of any User of the MySpace Services.

    and
    Under no circumstances shall MySpace.com be responsible for any loss or damage, including personal injury or death, resulting from use of the MySpace Services, attendance at a MySpace.com event, from any Content posted on or through the MySpace Services, or from the conduct of any Users of the MySpace Services, whether online or offline.

    Usual IANAL... but does that do anything for their case in this situation?

    Another example of the RIAA looking out for what THEY believe are the interests of the artists... when really isn't the interest of their own pockets. The artists may get exposure from such tapes... but the RIAA doesn't profit from mixtapes... so they're bad.

    Who says they don't already have that transport? How would we know if they did or they didn't? Not that I know one way or another if there's any other life out there... but if it's possible there is not life elsewhere, isn't it also possible that there is life and that life that might exist possibly created some "exotic form of transport" already?

    I think the milestones are a little behind... the last they mention is 26 million. Last I noticed they're nearly 150 million. Maybe that was the last significant upgrade worth mentioning? TFA didn't seem to mention... or I skipped over it. Very possible.

    How is this fresh? That is... we knew it was an iPod, right? Did people think it would not have DRM just because it was a phone this time?

    This is the same argument every time a new iPod comes out... "hey, it only works with songs from iTunes" and "iTunes only works with iPods." No shit. We know this by now. This article really has nothing to do with the iPhone specifically, it's just another DRM bashing article. Which is fine, I'd love to see it gone as much as the next guy... but as far as DRM goes, Apple's is pretty "fair" IMO and definitely simple.

    I spend almost 2 hours yesterday trying to get my little sister's Sansa to work with some songs my mom bought for her from the Walmart music store. Now THAT is some crappy DRM. Crappy software. Crappy everything.

    Here's Cingular's insurance page. Seems one price to me. But... there seems to be an ineligible list (PDF!)... and with seeing the Treos and Blackberrys on there, I now fear that the iPhone might possibly be ineligible as well. We'll just have to wait for the final word I guess. I wouldn't get it without some sort of insurance.

    That's what the $4-5/month insurance is for. At least, I think Cingular offers something like that. I know Verizon does. It would be well worth the extra $$ for something like this, I think.

    Oh I definitely agree with all of that. It IS expensive for a phone. And price will always instantly turn some people away. But I think with something like this, there will also be a lot of people giving it a second look despite the price.

    That most people won't spend over $400 on a phone because there aren't any phones worth spending that much on? The high end market may be small... but there's no reasoning given for not spending so much... maybe it's just because nothing (until now, IMO) has been worth the extra $$?

    Even factoring the 2 year agreement in... that's not how any phones are EVER priced. So to call it a $2000 phone even for that reason is fucking retarded. You don't think of the "free" phone you get with your 1 or 2 year agreement as a $1500 phone do you? I don't think so. Most of a comment for the GP, but you get the idea.

    I thought it looked kinda big too... well, still thin, but height and width seemed large. Then I watched this video on CBS and it makes it look much more like a phone-sized device that isn't gigantic.

    To some they may. Especially if you're a part of a private tracker and enjoy the community. The good members will feel possibly obligated to share and remain a part of that community... so overall legality of the action aside, making sure your other community members get a crack at the file too seems like some moral principles to me.
