See the problem with doing away with probono work for medical cases is that it means that those who can least afford to take an incompetent doctor to court will be stuffed. If a poor family loses a family member through incompetence then they have no recourse.
In my opinion the best thing would be if the government took over the running of medical indemnity and damages were limited to actual expenses and lost earnings. In cases of death and permanent incapacitation this should be enough to send a warning out to Doctors that they can't take short cuts.
Microsoft may not have originally developed many features of computing that we take for granted today, but it is responsible for bringing them to the masses and making them popular.
Thats not innovation thats marketing, a completely different subject altogether.
As for the grandmother quote, I think the old girl might surpise you, considering the desktop distros out there.

I hate to tell you but "Too Bad, So Sad" does not cut it when you are dealing with Health. Mistakes made through incompetence can have no excuse and must be met with a message that says we will not tolerate incompetence in our medical practitioners.
Umm okay include a Media Player, but do NOT tie it directly into the bloody guts of the system, do not enable it to run code included in dodgy headers and for gods sake do not demand that to install bug fixes the user has to give MS access to anything and everything on the users computer.
The reason why Doctors can face litigation twenty years after the fact is because fuckups can take that long to surface.
Oh and in Australia the cost of Doctors Indemnity is going up because of law suits, the cost of Health Insurance is going up because the government is giving the Health Funds a free ride.
okay a couple of points, firstly most of the reason that people complain about the closed source apps from MS is because they aren't worth the money being charged, it sort of sticks in your gob when you pay $200 or more for an os only to find that it has giant gaping holes that can only be patched by third party applications (Viruses etc).
Secondly, no where in the OSS philosophy does it say that you are not allowed to make money selling software. Instead what it promotes is openess through the sharing of technology and standards. If you read the GPL you will find that no where does it say "Thou shalt not make a buck".
Thirdly many people do open source as a contribution back to the industry which has supported them. I am a network admin/developer/support guy and I tool around with code because a) I enjoy it and b) I'ld like to think that one day what I produce might help others. God know as the moment it aint worth crap on a stick but their ya go.
Umm I'll buy your Apple and Sun points but isn't IBM getting taken to court because they contributed to Linux?
Also how about Eclipse? That seems to have been open sourced as well. In terms of non Linux-distro companies contributing to Linux I think IBM is actually pretty high up.
See this where I see an opportunity. Sure the desktop isn't at the level where it could be and Linux distros are lacking tools to do things that you can do on Windows such as the Palm and phone synch, however it could actually be a market waiting to be tapped.
With linux desktop useage increasing their is going to be an increasing market for people to start producing software that can be sold and that meets the needs of various areas. Whether this software is closed or open is an issue for each individual company but I think it is something worth looking at.
Exactly. For myself I prefer Linux and its associated apps to the windows alternatives and not just because I like to play around with things.
I work in a regional media organisation and I would love to push for more Linux desktops in the workplace but considering at least one of my users believes your passwords are stored in the mouse I don't think it's quite there yet.
Umm I think you'll find that as a Server OS, linux has already achieved market acceptance, IBM wouldn't be pushing as hard as it is unless it thought it was on to a winner.
As for the desktop, I use it at work and home to write in all those languages you mentioned bar.NET and VB6/VBA. I am not an UberLinuxGeek by any stretch of the imagination, to install I just whacked the disc in and ran the install. Worked like a charm.
However I do agree with the sentiment as expressed by ESR, most GUIs for OSS projects do suck, and that is mainly because they are written by tech heads rather than UI specialists. However this is somewhat mitigated by the efforts of the Distro producers, Redhat, Mandrake and Suse all try to make things easier by redesigning interfaces, RedHat is a good example with its one widget set.
Linux is not ready for the mum and dad area of the desktop market, however as a high powered workstation I will put it up against Windows any day.
If you actually watch Bowling then you'll see that he is big on cause and effect. It's just that he points out the causes that many people don't want to hear about.
Umm there is a hell of difference between being a market leader and being a company convicted of abusing their monopoly position.
With one you can assume a reasonbly level playing field with the other the playing field has been tilted only to the advantage of the convicted company.
By this I assume you are talking about the SUSE distro they are distributing right?
I hate to break it to you but "Desktop" Distros have been out for a while now, this is just another one to add to the list.
Sun is playing games here, trying to keep their fingers in both pies, paying licensing fees to SCO (which Novell are currently waiting for) and releasing OpenOffice and the JDS. Basically they are your average 800 pound fence sitting Gorilla.

And yet when they are, they tend to die in a back alley because they can't afford two hundred grand for a transplant or a thousand dollars a month for vital medication.
Mind you with the American medical system this seems to happen anyway. Way to go guys
