    Anybody in that judge's hometown that can give him a cluestick for the 4th of July? It's almost like he thought:

    "Huh. IP Address. 172.24.50.24. Huh. Looks like a phone number! Aha! IP Number thingies make people able to call this guy's computer. Hot diggity, it's a phone number, I'm going to get my name in some law books! HEeeeeeyawwww!"

    (Ok, so I don't really know if the judge grew up in [redacted], but still.. geeez)

    Next thing you know we'll be taking our postal mailboxes with us.

    I see no updates on Bugzilla for any of the trees -- for the life of pete, that "intermittent" copy paste bug is awful. Every now and then copy/paste funtionality will just disappear. You can't copy anything.

    I can stand misrendered pages, I can stand missing URL's, I can stand a memory leak that might force me to restart the system every now and then -- but yee gods, if you mysteriously take my copy/paste away from me at inopportune moments.. madness! URL's hand typed! Monkeys flying out you know what comes next!

    I love the 'zillas to death and I am typing this on Firefox now. I'm not saying the bug forces me to abandon it.. it's just.. so... painful! Help me obi-developers, you're my only hope!

    lets analyze.

    Note I prefaced the term "misleading" with "a bit"

    "a bit"
    Defined as : A small portion, degree, or amount.

    So if we were to rework your statement to reflect the original context in which I used it:

    "Now, why was this a bit misleading?"

    I would say because "In Court Again" implies that they left court the first time. The phrase "In Court Again" implies there is a new reason for them to be in court. The reality is they never left, this is a continuation of the original case. Not wholely misleading, but "A bit" just the same.

    The headline is a bit misleading. Today is RIM's day in court for hearing on its appeal to the August 2003 decision where they were effectively slapped around.

    The Register and a few other newsies reported that RIM and NTP have tried to come to a royalty agreement, but so far have not budged.

    You can bet as soon as RIM loses this appeal (likely), they will very quickly come up with a royalty agreement for NTP, and life will go on.

    IANAL. I play one on slashdot.

    Um...

    However, fair use standards CLEARLY state that consumers are allowed to view copyrighted work however they please, as long as they have paid for it. There is no law or statute that allows copyright holders to force consumers to view their work only on certain devices.

    Where do they say this so clearly? I'm afraid you are only familiar with fair use rhetoric and not the actual law. Please consult EFF's Fair Use faq or better still Stanford's Fair Use resource page.

    To whit, all fair use legally defines thus far is the ability to briefly use snippets of creative work for one of 6 categories.

    The only legal extension that has occurred is under the VHS-Sony-Betamax court case the court argued that time shifting VHS material was a fair use.

    Outside of that there is no other fair use legalese language. It's all an "implied" sort of thing based on copyright law that has not been tested substantially in court.

    I know you're just trolling, it's very important to look at numbers because when you evalulate individual markets you find that Clear Channel does not own the "top 5" or "top4" or hell even top 3 stations. If you look at Arbitron rankers for Winter 2004 (latest book), you see it's just not there -- Cox, Ennis, Infinity all have stations and most of them beat CC.

    My point is that people keep labelling CC as the one bad mojo when in actuality stuff like this posted story talk about NAB -- the national association of broadcasters -- NOT just CC. It's about keeping an eye on the ball.

    According to the FCC, there are about 13,000-15,000 radio stations in the US broadcasting at any one time. At last count Clear Channel had 1,176 stations. That is near 10%, not exactly a monopoly. Clear Channel is the biggest single owner, but they are not the only one. Cox, Infinity, Ennis, are all players in this game, and they are part of a lobbying group that asked for this. Clear Channel did not ask for this, the lobbying group did. This is the problem I keep talking about -- people think CC is the only one wrong so they ignore the other people too. Sigh.

    Apparently Lucas was married/on his way to divorce in the middle of Eps IV - VI and it was her input on the editorial and post in the film that helped make them good. Apparently Lucas wanted to suck at those too but at every step there was her persistent "Uh, dear.." that got him to change his mind. I've never read up enough bio on the man to validate this gossip but it would seem to fit. Lucas channeled by others producing greatness, Lucas left to own devices slinging steaming turds.

    I love the AB Story, it's such a classic example of capitalism at its well oiled finest. (or sludgiest)

    Budvar, a Czech beer maker, had produced 'Budvar' or 'Beer of Kings' for a looong time. They were originally given the order to construct a new lager by the king of Czech centuries earlier... thus, Budvar, 'Beer of Kings', ta da.

    I don't know the finer details of whether people from Europe immigrated to America and started it up, or if people in America had been to Czech and thought it up, but it doesn't matter. Long story short not very many good lagers in America around 1860's, so AB comes up with a knock off recipee of Budvar and goes into production... relabelling it the "King of Beers".

    It gets better. Again you can google for the specifics, but 1900's come around and Budvar goes 'Hey! Wait a minute, wtf', and it's too late, because AB already secured protection and trademarks for 'Budweiser' and the like. So now here is AB with 'Budweiser', a product of Budvar, selling tall in America and Budvar can't legally enter the market. Huzzah, and all that.

    You need SpamBayes. The beautiful folks behind it have included an Outlook plugin. Now you can knock your bayesian filter self out with a self contained easily run end-client solution. In smaller words, no need for anything fancy from your ISP, just install, plug, and play. In the few days I have used it my spam has literally dropped to 0. Spams are nailed before I even see them show up in the INBOX (it's that fast).

    Go check it out. It's really, really, good, and free, as in, well, um, beer?

    I have spent too many hours building elaborate rule sets, banning Class A IP's, keyword filters, etcetera. The spam still gets through and it carries nasty payload half the time. Bayesian...bayesian... bayesian...

    Ok, I RTFA, and I dig totally what the guy's up to. It's a laudable goal and it looks like he found some very logical, rational ways on migrating it.

    But uh.. where's the, well, screenshot ? He froze a July 22 page and tried to re-create it. He talks about recreating it. He goes into detail on how it would work. But uh.. lemme see. Maybe I'm too visual, but I'd like to see what his friggin result was...

    They go through several lengthy notices when you move to download iTunes, and then to install it, that if you are already on Windows your MusicMatch software will no longer function.

    MusicMatch was a bandaid for Apple when they did not have a Windows software client.

My wife, a professional graphic designer, just shook her head and walked away. For such an awesome piece of software, you'd think they'd have a better piece of design on the webpage? Geeez... find a better pro bono designer! Mod me down, fine, but you shouldn't, because I don't want a flame war, I want to know what the fuck they were thinking. Kitsch is nice and all, but, geeeeeeeeeeeeezzzz......
