    The music industry now considers so-called 'schoolyard' piracy -- copies of physical discs given to friends and classmates -- a greater threat than illegal peer-to-peer downloading, according to the RIAA.

    Maybe this is an indicator that the ??AA are finally getting that DRM doesn't prevent music and movie sharing over the Internet. But they still want/need their precious DRM, because DRM is the key to controlling all legitimate uses of media and extracting maximum cash from consumers and advertisers. They are citing casual copying now - copying that doesn't involve a first copy originating from an expert who knows how to evade DRM - so they can keep DRM and induce legislators to mandate it.

    Note, however, that before peer-to-peer and before the Internet, this is exactly the same thing that the ??AA were citing as leading to their "destruction", despite the fact that the industries made tremendous gains during and after the widespread adoption of audio and video tapes.

    In that case, Wolf's unsubstantiated paranoia is hypocrisy incarnate:

    Government: There might be footage of people setting fire to police vehicles on that tape.
    Josh Wolf: The government might be trying to use my tape to track other activists.

    In the government's case, at least, they at least have proof that a crime was committed and that Wolf, with his camera, was there videotaping events. What evidence - not proof, just evidence of any sort - does Wolf have to back up his claims?

    Orrin Hatch was not "the" man who introduced the DMCA. That dubious honor goes to Howard Coble, with Hatch submitting a similar bill nearly a year later. Note that the Coble bill included only the anti-circumvention language we've all come to know and love, and was introduced to mollify WIPO regarding our treaty "obligations". The Hatch version also included the Internet copyright violation liability limitations for ISPs and the like.

    A post containing the actual encoded message might get deleted from Craigslist due to its content (or lack thereof). A cleverly disguised reference to a phone number where the message can be retrieved fits in with the natural flora of Craigslist.

    It's like doing the same thing on a restroom stall. "For a good time, call 202-555-3988" will probably get passed over as graffiti, but a large block of cryptic-looking numbers looks unusual enough to attract attention.

    Most developers would love to do something creative with the paltry time and money their publishers give them.

    But the publishers see only one thing: the bottom line. They are firmly convinced that making a guaranteed mediocre profit is better than taking a risk and possibly hitting the big time with a new, creative, fun idea.

    The DVD CCA doesn't let you download the CSS license without submitting personal details, but I have my doubts that they would sell Circuit City a license if they knew they were doing this. Then again, the DVD CCA announced yesterday that they're licensing keys now for the reverse process (burning copyrighted movies to CSS-obfuscated discs, allowing JIT publishing of movies and such at store-placed kiosks), so I guess anything's possible.

    Even more disturbing, IMO, is the suggestion in the article that Microsoft will become the ultimate arbiter of device driver safety in Vista, by preventing device drivers from being loaded that they haven't checked out and approved.... because we all know that Microsoft are the experts when it comes to detecting and correcting software vulnerabilities.
