    I can see you have never complained about food you have eaten in a restaurant. Because if you had you wouldn't know that it is very common not to pay for food you find unacceptable.

    I have never paid for a meal when I have complained to the manager of a restaurant how bad the food was, and exactly why it was terrible.

    Perhaps your one of those people who just thinks you should be lucky to be served in a restaurant and should never complain about anything, especially not in public. Sorry but that isn't me.

    You forgot that in the bad of every game manual is an address to send the game back along with your receipt for a full refund. This is required under law in most if not all states. Sure it's a pain in the ass but you can send your game back and get your money back.

    I think the main reason for this is the issue of EULAs. If I can't see the EULA until after I open it and try to install and I don't agree with the EULA where does that leave the customer/user? Which is why I think most states require it.

    If that has changed then fork the game companies. They sell me a package, but claim its a license/lease instead, then try to ignore the doctrine of first sale, and then add all kinds of crap to try and limit my rights that the courts have said I have for years, things like fair-use, reverse engineering for inter-operability, etc.

    It's messed up crap like this and the DMCA that makes people want to "pirate", steal, etc from big companies. Treat your customer like crap and don't be suprised when they return the favor.

    If they are going under, then for god's sake please release the server code to the community. There is nothing worse than having a game you play suddenly become unplayable with your friends because the company shut down the server.

    I wonder if users of the game could sue claiming breach of implied contract. That it was figured that the servers would be up at least 3-4 years, maybe longer, and here they are up what barely a year?

    And people wonder why the Open Source community hacks and creates clone servers? This right here is one of the many reasons that clone servers pop-up.

    The copyright laws were changed about...what...5-10 years ago. It is now illegal to copy copyright material even if it isn't for profit. They changed the laws back at the height of software piracy. Software pirates were trading and releasing software without any profit or sales involved. If you look at the FBI warning now on DVDs it mentions something about even distribution that is not for profit.

    So it used to be ok to give a copy of something to your friend, now it is illegal and punishable with huge fines reguardless off if there is profit or not.

    I would love to know if the students also had to pay for the class, just like they do for any other class. Also did the students get a full outline of the class before they signed up for it, like most other classes offer?

    Sounds to me like this is a case of double dipping. The school gets the corporation to pay for the class, and then they turn around and get the students to pay for the class as well. I'm sure every University and College would love to be paid double for each class they teach. Sounds like this is more about the greed of the school, than it is about actual teaching.

    Also where is the state on this? I don't know about their state but the state of Missouri has Sunshine laws. Basically if you take state or government money, then everything has to be open and clearly detailed about what you do with the money and everything associated with it. You can't have secret board meetings, or secretly spend the money on anything. Everything in the school has to be open and transparent, even school groups that receive money from the school, since they get it from the government.

    Sounds like a *HUGE* violation of the "Sunshine laws" to say that this whole review, etc. is an internal school matter. It certainly would not be the case in Missouri.

    This is a weird announcement considering some of the retailers had already gotten this unit in to sell about 2 weeks ago. I saw this come in at work but it didn't have a set spot on the self yet. Guess they wanted retailers to get the unit before they announced it. It seems like an ok setup/unit to me but I would want the hard drive add on to be able to easily download more arcade/casual games if I were going to purchase it.

    Microsoft used to include a bunch of GPL stuff in their UNIX for NT toolkit or whatever it was called. It had a bunch of stuff to run on NT that were UNIX applications to help UNIX admins move over to NT. Stuff like "grep", "C shell", and stuff like that. I think they still sell it.

    Windows Vista Enterprise and Ultimate Editions also contain the Services for Unix components, now called the Subsystem for UNIX-based applications (SUA), and Client for NFS v3.

    So it would seem that Microsoft does in fact sell a fair amount of GPL software, or at least did a one point. Not to metion it now seems to be a part of the OS by default for the server version.

    If you think Wal-Mart is going to get left out of the console launchs this fall and not demo any of the new systems at all this fall you are sadly mistaken. Wal-Mart is all about making money and they know that for new consoles, demo systems help sell new console launches. I don't know where you heard this but I suspect someone has led you astray. I know people who work at Wal-Mart who have been talking about the Wii and PS3 launches.

    I take it the author isn't all that familar with government security protocols at all. Because reading computer screens to read source code or secrets is actually something that the government does actually worry about in a number of their secure locations and even in hospitals and some doctors offices as well. I know some businesses also have issues about who can read their screens as well and use polarized filters on the windows and computer screens so that you can't read the screens from outside as well. So it isn't as far fetched as the author of the article seems to think.

    Defender the arcade game didn't have vector graphics. Defender had raster graphics. Take a look at Red Barron, Asteroids, Tempest, and some of the old Atari arcade games if you forget what vector graphics are. Better yet load up MAME and load the Defender ROMs if you forget how Defender looked.

    You might want to check the BNETD case since the court specifically held that that a EULA could prevent reverse engineering for interoperability. That was one of the key points of the case and the courts up held Vivendi's side that BNETD was not allowed to create a clone server of battle.net because it violated the EULA of the game software that they agreed to.


    So you would be wrong when you say a EULA can't prevent reverse engineering.

    I guess it wouldn't be too much of a stretch for Nintendo to offer up 3rd party developer download titles much like what Microsoft is doing, only with the Revolution since they have already said they are going to let people download the back catalog. Seems like a no-brainer to me for Nintendo to develop more 3rd party developers and build a bigger online download catalog much like what Microsoft is doing with their online Marketplace. I would be very suprised if Nintendo didn't offer 3rd party developers something similar.

    What strikes me as interesting is not so much how well the XBox 360 is or isn't selling but what consumer reaction to the new XBox Live Arcade/Market place has been. It seem to have been overwelmingly in favor of it and everyone seem to love the new market place and arcade download titles. So does this mark the new way of how all consoles are now expected to be online? If so does it mean if Sony doesn't offer something even somewhat similar that consumers will consider is a mark against the PS3 if Sony doesn't offer something similar? Since it would seem that Nintendo is going to offer some sort of unified online market place with the Revolution since they are going to be offering their entire back catalog of products for download somehow.

    It would seem that Sony would be the only next generation console maker without some kind of online market place and no content download function available for their next generation console.

    If your going to build a whole business on your own R&D then don't pick a license of software code that puts you in debt to someone else to build your business on top of it. You wouldn't complain about a commercial library that makes you pay royalties for each copy of a program you sold because you picked that software to build your software on top of...so why would you complain about the GPL license when you picked that license to build your software on top of? DUH! Common sense people! Know what license your building your software on top of and don't complain about the license your building on top of. If you don't want to build on other people's liceneses then build everything yourself from scratch...DUH!

    If you hate how the GPL license works then for GOD'S SAKE DON'T USE IT! You wouldn't complain how a commercial library had all kind of licensing fees if you used in a commerical product, yet your more than willing to complain about how you picked a GPL package and then don't like the license. If you don't like the license the easy answer is then don't use the code. DUH!!

    Is it just me or does this seem like a rehash of a PC game title that is still around?

    I'm not sure how many people recall the "Catz" and Dogz" series of virtual pet games that have been around for years. When I first saw this game that was the first thing I thought of, "Oh! They ported Dogz to the Nintendo DS....um and this is big why?".

    Ubisoft still makes/distributes the games/sims or whatever you want to call them. Check them out at:

    Add voice chat to a buddy list, so you and your friend can talk while you watch him play, or voice chat while you two play each other and talk smack talk and you have a winning formula if you ask me.

    Play retro Nintendo games over the internet against people plus voice chat while you play. That sounds like a possible winning combo to me. I don't need video chat though. Video chat just sound too boring and a waste of time for game playing.

    I would probably pick up a Nintendo Revolution if I could do that for cheaper than what the XBox360 or Playstation 3 are suppose to cost. If they sold it for like $150-200. I could spend $300 and end up with a half dozen downloaded games and 1-2 new games compared to what Microsoft and Sony would ask me to spend just for the console.

    If it is encrypted and doesn't decrypt itself automatically then it fails the stated purpose/use laws and doesn't function as it stated it would on the box and thus isn't fit for sale. It would be involation of consumer protection laws in almost every state of the US, reguardless of the DMCA.

    Its ok to make a game where you promote the idea of lying, cheating, and stealing, but god help you if you actually do it to them? hehe Sorry but that is the height of irony.
