    The first amendment doesn't apply to this. A private entity has the right to restrict what is transmitted or stored on privately owned property. If the server or service was located on governmental property of some sort, then yes, it would be a violation. However, it wasn't.

    This guy is out of luck, regardless. Google and Yahoo can get away with passing the information on without editing, as they serve as intermediaries, not initiators - at least they can in the US.

    The irony here is that a shyster can generally be determined by the frequency with which the attorney sues... so even if he does get to court and gives a compelling case, he's basically showing the characteristics of one by suing everyone he can find.

    It's not the amount of money that's an issue - it's the credibility factor, especially considering their IPO share pricing. Throw in the non-traditional auction format that they're using, and now the fact that they're essentially admitting that they weren't managing their shares properly... one's left with the question: "Is it worth $108+ a share? And can they be trusted?"

    I'm a big fan of Google's, but I can think of a better ways to instill investor confidence than this approach.

    Hey, the amount of stock that wasn't reported properly looks like it's roughly the same as the amount being offered for it's IPO... but who's counting?

    It's sure as hell not a good way to build investor trust - and it makes it harder to justify the overvalued IPO price.

    Churn in India may be a problem, but AIDS is a pretty big problem in Africa - which unfortunately will affect churn as well. A few stats on AIDS in Africa:

    * 5.4 million new AIDS infections in 1999, 4 million of them in Africa.
    * 2.8 million dead of AIDS in 1999, 85 percent of them in Africa.
    * 13.2 million children orphaned by AIDS, 12.1 million of them in sub-Saharan Africa.
    * Reduced life expectancy in sub-Saharan Africa from 59 years to 45 between 2005 and 2010, and in Zimbabwe from 61 to 33.
    * More than 500,000 babies infected in 1999 by their mothers -- most of them in sub-Saharan Africa.

    Considering the scope of the problem, the chances of locating anything but no-brainer jobs there is pretty slim. I can't see anyone betting on long-term (and skilled) career employees there. Bad for low-level jobs, but the loss of high-paying jobs seems pretty remote.

    Bad idea, now that VPN clients sometimes (if not always)route PC traffic via the corporate firewall. Thus, look at the reality:

    Some employees access their work via VPN using their home PCs. What do they do when their personal email on their personal PC won't go out?

    Don't suggest that companies should buy every employee a PC - that's not going to happen. Anyone that's spent a few years in the industry knows that companies don't do that generally.

    Calling that page a blog seems a bit far-fetched to me - it seems more like a news site. On news sites that I know of, people that write opinion pieces are called "columnists" or "contributors" normally. It's called an op-ed, not a blog entry.

    Does anyone else question the way this is being termed? After all, if I contribute maybe 10 articles to a news site, does that make my work there constitute a blog?

    I can see two positive things happening with this technology:

    1. People using this who accidentally hit people in the process will be sued, prompting them to stop using it.

    2. People using this may develop carpal tunnel or dislocations, prompting them to stop using it.

    Enough's enough. Just because you can do something doesn't mean you should - someone throw the engineer that came up with this off a cliff!

    I can think of a couple right off the bat:

    * XP doesn't hang when shutting down (at least in my experience)
    * Multi-user profiles
    * Built-in USB 2.0 support (SP1?)
    * System Restore (buggy though it can be, it's better than nothing.)
    * MMC

    I'm no fan of XP, but the issues and capabilities listed above make supporting XP (and 2000) a lot easier for us than 98 was.

    I just about choked when I saw the word "company" and "98SE" in the same sentence, here in 2004.

    I can see it happening on a couple of legacy systems spread around a company, but to have an entire company on it? Jesus - and I thought the company I worked for was behind!
