Could Orbitz claim that their URLs are their intellectual property, and forbid anyone else from using that property
Which makes absolutely no sense because there is no such legal entity as "Intellectual Property".
Well, how about URL's are a representation of their "unique compilation" of data and then fall under the database protection stuff we have been hearing about. It is a stretch but a well funded laywer could probably pull it off.
Please, lets keep in mind that these new restrictions are in the TOS. So they are conditions of use. E.g. if they catch you deep linking they can revoke you membership. Thats it. I have yet to hear of a case where damages were awarded for breaking a TOS.
...having their posts just be invisible to everyone else? The troll can still see their own posts and everything will appear normal, but it will seem like they are just being ignored.
yeah, totally, then you find out he was dead all along!
Once the founders of Google are dead, some new executive type will come in and see the potential for profit. Then, presto-chango, you've got the internet's version of Walmart. Starting out as the good guy. Change of leadership. The descent into evil.
hehe, this from the guy with the nick StalinsNotDead
Great. Now you should realize that what websters says has little bearing on whats enumerated in law. And honestly thats what matters not your definition, not mine and not websters(however websters may be close(r)). The lawful wording of theft is probably signifigantly different, enough so that talking about dictionary definitions because a moot point.
Well, let me know when people start being charged with theft instead of copyright infringement. Then maybe you will have a point.
I think I'll be cashing out my chips before I leave the casino. It makes me nervous knowing I could be unwittingly scanned by others after I leave the floor.
What a novel idea, cashing out your chips BEFORE leaving! I even heard they sometimes exchange money for them or something.
I am so sick of choosing leaders based on charisma instead of knowledge. I would rather have an ass who actually knows the issues even though that may slow the cause.
I'm speaking as "not a geek"
I would not call myself a geek.
but I'm not a programmer or a geek.
doesn't make me an OS "guru" or a geek.
If I'm not a geek, then he can't be a geek.
Methinks the Lady doth protest too much (brutalized shakespear reference, not bad you a girl joke).
I, personally, am proud to be a geek, bad shakespeare references and all.
To the average person Bill Gates might be a geek. But to a geek, he is not a geek.
Well, I for one have never programmed my own compiler....
Seriously though. I love these "could x be harmful?" articles, the answer is always yes. If you do too much of ANYTHING it will be harmful. With that out of the way maybe we can stop jumping up and down and screaming what about the children every time one of these articles comes out...
These guys weren't randomly standing in line telling lawyer jokes. They purposely and continually go to courts and heckle the lawyers.
The pair said that for years they have stood outside courthouses on Long Island and mocked lawyers.
I have a hard time imagining how that would be illegal. It is not illegal to be an asshole. The only difference here is that they were in line for the metal detectors. Now, if they were purposely preventing people from getting through said detectors there may be a point, but it is hard to tell exactly what happened.
I guess that is a question for the courts to determine, I just hope they get a fair trial. It is going to be hard to find an impartial judge since they are all lawyers.
As soon as I can use my mp3 player (creative) and my digital camera (fujifilm) I will switch in an instant. I tried these last year to no avail, lets see if 2005 is the year!
No shit, what is worse than copying others work without permission? Trying to pass it off as your own.
Crap, now how am I going to get all those +5 imformatives for posting links to Yahoo stocks in SCO stories??

Yes.

Yes, it's very difficult to make up specific situations which 'prove' your claim.
VHS vs. Betamax. VHS won because of market restrictions, not technical superiority. A specific example of the free market choosing the lesser tech.
The crack of the bat, the roar of the crowd, the swoosh sound of the joke rocketing over head.
meh, like any of us are going to die from old age anyway. More like heart attacks and liver failure...
I think of art kind of like murder vs manslaughter. It is all about intent.
By this logic you can weed out much of the feces including performers whose sole intention is money as opposed to creation.
As a liberal I am glad we at least control something!
How about mp3? Novel, useful, and revolutionary.
Playing devils advocate here, I personally think copyright is sufficient.

The thing about the list is it's obviously not based on the movie, but on the quality of the extras, transfer, packaging, etc.
If it is based on DVD quality why is Tron on the list. Damn thing won't even play on my PS2!
Is breaking into a person's server or blogsite and messing with the contents any different from breaking in to a person's house...
YES
Is defacing a website any different from spraying graffiti on someones walls?
