    Of course, his opinion on this seems utterly pointless to me. The man is a physicist, specializing in solid-state and quantum physics. He's no more qualified to analyze the science behind climate change than an electrical engineer is to build a bridge.

    Have you somehow missed the irony of your statement? I have no idea what your qualifications are to make that observation but they are undoubtedly less than the person you are criticizing. More to the point, none of us here have the qualifications to make a detailed assessment of the methodologies involved in examining projected climate change; we're all taking this on faith one way or another. Kind of smells like religion on both sides of the aisle to me which undoubtedly explains the religious zeal of those opining on this topic.

    Most companies lease or rent for tax reasons, at least in the US. Capital goods like cars and equipment have to be depreciated under US tax law. That means if you buy a car for your company, the expense incurred cannot be deducted against your taxable income in the year that you incur the expense. Rather, you can only deduct the amount the asset decreases in value each year according to rather unfavorable depreciation schedules set by the government. If you lease the same item, all your lease payments are immediately deductible against your taxable income as an operating expense. This is the main attraction for leasing capital goods and is the basis for the commercial leasing industry in the US.

    Off the shelf software like MS Office is not considered a capital good which must be depreciated. Rather, such software can be "expensed", i.e. the entire cost of the software can be deducted in the year it is incurred. As such there is no tax incentive to lease/rent software.

    That is incorrect on so many levels, I don't know where to start. First, there is no overarching "US law" regulating the admissibility in evidence of fax signed documents. That would be a matter for the rules of evidence in each of the fifty States. In general, a fax would have the same legal status as any other copy and the admissibility of any copy would be determined by whether or not you could authenticate the copy as an accurate copy of the original. When you have only a copy, there is always the potential of a dispute about authenticity, i.e. whether or not the copy is accurate. When you have an originally signed document, the only thing that can usually be disputed is the authenticity of the signature which is generally easier to resolve. The fax enjoys no special legal status in any jurisdiction that I'm aware of.

Steve Jobs is on first name terms with Satan. Bill Gates is Satan. I've got an iPhone and I love it. It really pisses me off that Apple has to put i in front of everything. Something about PPC versus Intel. Something completely without evidence comparing Apples and Oranges (pun intentional) proving PPC is and always will be better than x86. Something completely without evidence comparing Apples and Oranges proving x86 is and always will be better than PPC. GPL. Google. Linux. QNX. My Dad's harder than your Dad. My Nan's harder than your nan. Something anti-American. Angry riposte proving anti-American point. Thoughtful welll thought out riposte clearly disproving anti-American point that nobody will ever read because there's so much uninformed chaff above it.

    The main problem with EULA enforcement is it is a contract and contract law applies, including the need to prove actual damages. Exactly how are you going to prove any actual monetary damages because some guy is using your application in some arguably unauthorized way? In contrast, with copyright infringement draconian monetary damages are automatically awarded by statute upon a showing of infringement.

    You are exactly right. I'd just like to add that the bankruptcy court lifted the automatic stay thus allowing the Novell case to go forward for the sole purpose of liquidating Novell's claim. All other issues regarding Novell's claim have been reserved by the bankruptcy court. In particular, the issue of whether SCO held the licensing revenue in trust for Novell is going to be solely determined by the bankruptcy court. If Novell loses the trust argument, they'll just be another general unsecured creditor and will likely receive only pennies on the dollar for their claim against SCO.

    The only thing missing is the ability to make a profitable business from selling a desktop OS. This has never been about lack of functionality and the article makes it clear that the only objection is the lack of profit in this market for even excellently functioning linux desktop OSes that try to compete with MS's offerings. This is nothing new for RH; it's been their position since 2005 to stick with the server products.
