Linux is stable, rock solid. I can't crash it, I can't do anything to bring it down.
But that doesn't mean it WORKS. Just because it doesn't crash and it is stable, doesn't mean it WORKS. So what if your video card doesn't work, or your 3D acceleration doesn't work right, or you can't get 5.1 dolby surround on your SB Extigy, it doesn't crash!
Who cares if you are not crashing, if you are driving 5mph all the time, in the summer heat, with no A/C... Not fun.
I remember hearing "You've got mail" in tons of movies, including James Bond flicks.
Today you think of AOL in a whole lot of trouble, tomorrow you may ask the question "Oh, AOL is still alive?, I thought they were gone already", when you hear the obscure voice of an rare AOL'er stuck in his contract he has trying to cancel for years.
Have you ever tried to open a fedex (fiber/cloth) envelope without destroying it?... I can barely get them open let alone not destroy it including the shipping label trying to.
Of course there are always ways around anything in life. Every law was invented, every rule made up. Anything is circumventable.

He can do whatever he wants with HIS company as long as the rules allow him.
How would you feel if you owned something worth alot and you couldn't sell?
In this case, he didn't have majority share. But if he did, there is NOTHING wrong with selling your company, even if its not what the lesser-share-holders want. If you own majority (or others vote with you), then Its YOUR decision to do what you want with YOUR company. Period.
Open source model doesn't work for most (99%?) of military and government applications.
So, its wise to spend alot of time discussing methods when you can't just "LET THE WORLD SEE".
Sure the author could throw in a one-liner "Use open source model if you can.", and make you happy, but why bother.
