NDA agreements don't restrict your first amendment rights. The first amendment doesn't grant you the right to say whatever you want, rather it prohibits congress from restricting what you can say. Schools can disallow guns because there are no laws prohibiting them from doing so. The 1934 Communications Act, however, gives the FCC sole authority over regulating the airwaves meaning the FCC is the ONLY body that can tell people where they can, and cannot use antennas. If Congress passed a law saying the department of ATF has sole authority over regulating gun use the situation would be different.
Microsoft is filing all these patents recently is that they see themselves losing market share to Linux. They want to keep their profitability (stock) high by licensing/litigation revenue. I see it as a sign of *cough* (the year of Linux on the desktop) *cough*! Maybe that is a little ambitious, but I think MS is affraid!
The statistics are not based just on what web developers are using, but what users as a whole use. The information is aimed at web developers, so a developer knows their audiance, the information would be meaning less if only based on developer usage.

I don't know where you got the idea that all PocketPCs are clones of each other. Yes, Microsoft (used to) limit the screen size and has a few other restrictions, but it is not nearly as extreme as you suggest. Even just amongst HP there is a lot of variation accross the models. Just look at the new HX4700 which has a touchpad (with full cursor functionality, not just a 'touch wheel') a drastic departure from the standard d-pad. The Asus MyPals, Dell Axims and Toshiba PocketPCs all have their own unique feel/design. Just because there are a few IPAQ clones out there doesn't mean it is dictated by Microsoft.
Be careful what you wish for. Microsoft (which I don't believe has filed any patent infringement lawsuits to date) and IBM own patents on.. well, everything. To force them to file suits against everyone would certainly get rid of a lot of errneous patents, but it would hurt everyone in the short-term.
The Declaration of Independence has no legal standing in the US. Its simply a letter, no more no less. The constitution is the basis of our laws, not the declaration.

Apple's MacOS X is not open source. Also, MySQL makes money off their commerical license which is non-GPL.
A better example of a profitable GPL'd Open Source product would be Red Hat Linux.
