    Interestingly (or not for most people), there's no requirement for Consideration in Scottish law. Therefore you could sign a contract with legal jurisdiction in Scotland that said you were going to mow my lawn every Saturday for absolutely nothing. However since most EULAs will use Californian law, or law from another US state then it doesn't really matter. Maybe Microsoft haven't noticed this yet and will open a new legal HQ in Edinburgh, who knows.

    Also, this might have been mentioned, but you can't be coerced into signing a contract. There have been quite a few instances of contracts being revoked by courts, especially in the music industry, because people haven't had appropriate legal advice at the time and have either been strong-armed into signing or they were too dumb to see how bad a deal it was. The Stone Roses are a good example; one of them got an estate agent who sold their uncle's house to check the contract from their label over ("Looks fine to me lads! Good luck with the old rock 'n' roll, eh!"). Of course they got screwed, but when things got nasty later on the judge freed them from the contract because it was so bad and they didn't have appropriate legal advice at the time.

    Basically the label has to pay mechanical royalties to songwriters somehow and the removal of the agencies' monopoly means that they can go elsewhere to do it. It would be cheaper for EMI (or whoever it was) to pay mechanical royalties through SABAM for example because they had negotiated a better deal than the standard agreement with the MCPS in the UK. Sorry it's all a bit vague. I don't remember the details.

    AFAIK, this is already the case. I was under the impression that for the past couple of years the likes of record companies have been able to use collection societies from other EU member states. The whole point was to eliminate the monopolies that organisations like the MCPS/PRS have, and they were getting worried about losing business; I seem to remember one of the majors were going to defect to SABAM (Belgium).

    I noticed that Volvic bottles have a warning on the label saying "This bottle should not be refilled."

    I think it's probably just to encourage you to buy more Volvic rather than anything legally binding but it's disconcerting all the same.

    Not true. You only have to pay for a licence if you're receiving TV programmes (whether on a TV or a PC). When the guy from Licensing came to our flat, I told him that I did have a TV but that it was only used with a PlayStation; he seemed satisfied with that and we're exempt from paying for a licence.

    When I moved into my current flat over 2 years ago, we made a decison to not bother with TV; so we got the usual TV licence letter and my flatmate phoned them up to say, "we don't have a TV". They visited us to confirm this and that was it. More recently we did get a big TV but it's just hooked up to our media server; we're some of the episode downloaders in TFA.

    Mostly it's South Park which gets BitTorrented within hours of being on Comedy Central, an improvement on waiting months for Sky One which is worryingly terrible and expensive. Same goes for the Simpsons etc.

    I don't have a problem with the TV Licence actually; I think the BBC is worth it. I still use BBC News every day and when I move in with my girlfriend in a couple of months (no basements for me guys), I think we'll be getting TV TV (receiving stuff that is) so we'll have to get a licence. Admittedely, they sometimes produce rubbish too but stuff like the League of Gentlemen, news, sport and (sometimes) decent radio with no ads makes it worthwile.

    Mutant Macs (Cube, 20th Anniversary Mac, Color Classic, Portable)

    My first Mac was a Colour Classic and it's still one of my favourite Apple products. OK, it was basically an LCII in a different box; but it was a box that rocked. Years later I've had offers for it just because the Colour Classic is cool. If only they had given the initial version a bit more power, or released the Colour Classic II worldwide (or better yet a III with an LC040 or whatever), then it could have been much more successful. There are some interesting mods around too (all the way up to G4s).

    Fantastic. I always used to have a really old Control Panel on my pre-OSX systems that allowed me to move between apps and windows with keyboard shortcuts (I think it was from about 1994), I've missed being able to swap windows/documents from the keyboard.

    Bear in mind the State Department does think that US elections need to be monitored and that they invited the OSCE to do so. Also, saying "we don't need Europe" to do this is the wrong way to look at it; the point is that the OSCE is meant to be independent and objective, it doesn't matter where they're based.

    Any country with democratic elections should welcome monitoring of this kind whether they think their system has problems or not; even a system that appears to be perfect can be improved upon when looked at objectively.

    We seem to have a similar problem with excuses in the UK. The size of our country is much more comparable to the likes of Korea and Sweden than the US but we're lagging behind because we're stuck with the legacy of BT's monopoly. It's frustrating when the people who developed DSL in the first place aren't very good at supplying it. There's no reason why we shouldn't have cheaper, faster DSL but BT are still ignoring the comms authority and refusing to open up exchanges to other companies. It's getting better; 1mbit DSL is reasonably cheap now but of course I'm locked into a contract for 512k until December! Grr.

  18. CD burner vs. power drill on Abused, But Working Hardware Stories? · · Score: 1

    I've got a Formac firewire CD burner that my flatmate and I decided to upgrade to a DVD-RW. We started taking the enclosure apart but one of the screws wouldn't budge. Since we really wanted to try out the DVD burner we were getting a bit frustrated and tried giving the screw some thwacks with a hammer and a drill bit from the other side. This (understandably) didn't work so we thought of ways to loosen the plastic housing round the screw threads. Aha! we thought, we'll just drill a hole! So I put the enclosure on its side between my knees and attacked it with our Bosch drill. It felt very very wrong and the noises were horrible but it worked; I drilled enough plastic away to loosen up the screw and a few minutes later we had our shiny new firewire DVD burner installed. It doesn't even bear much of a scar.

    Also a few years ago when I got my PowerMac G4 I spilled a glass of orange juice on the keyboard about a week after it arrived. It killed the keyboard but I took it back to my local dealer (who I didn't even buy it from) and told them what a goombah I'd been. They gave me a new keyboard, free. Bonus.

    I remember hearing someone on TV refering to something selling like wildcakes. Maybe if Apple sold a Tiger-striped iPod, it might sell like those too.
