    I'm sure they are only telling part of the story. The truth will probably be something more like this: 1) student texting in class, 2) student refuses to give up phone to teacher, despite it being against school policy, 3) teacher calls in campus police because student not complying and being disruptive, 4) student resists (misdemeanor!) police and does not give up phone. The article leaves out that this girl is a problem in the class in the past. People will say, "Oh my god this is horrible she was only texting..." In reality, this is not the case, newspapers love to fry people on the first page and exonerate on the back page- it sells better this way.

    Well it's too bad they don't make stand alone digital cameras that would circumvent this law. Just another example of a well-intentioned, poorly thought out law.

    You might be on to a loophole for her there though. If the teacher were to define note taking as part of homework for the class, and grade it, and had a policy that homework is not returned to the student, then she could take all the notes at the end of the year...

    Technically, if you held on to your papers and they were pulled from your hand, it is now a robbery [in California, and probably more states have similar wording]. Robbery is defined as the felonious taking personal property from your person or immediate presence, and against your will, accomplished by means of force or fear.

    This is only true if the other party in discussion has a "reasonable expectancy of privacy." A professor does not have this- they are lecturing to students. This law does not apply as well if you are say at a restaurant and the two people are having a "private" conversation loud enough for everyone to hear, it can be recorded without their permission- because they have no reasonable expectation of privacy.

    Funny, but 2nd to last paragraph incorrect. You don't/can't serve jail time as a result of "Civil Penalties." Remember OJ [murder case], won criminally, lost civilly. No jail time, just broke. If you do time for it, it was criminal.

    I don't believe this is necessarily correct. Let me try an analogy. Say there is a gentleman who is born with average strength and average biceps. And then you have a person who was born skinny and with tiny biceps. The biceps are the analogy for the part of the brain that concentrates. Naturally, the person with smaller biceps can curl less than the person born with average strength. This is a physical [real] deficit. However, with physical training, and plenty of protein drinks, that small bicep deficit can be overcome and expand to a size greater than or equal to that of a normal person. Likewise, even though a smaller part of the brain of a person with ADD/ADHD [or similar size, but less efficient] is devoted to attention, it can be trained to work harder and overcome that deficit.

    A simple fact is that the photographer's argument that properly secured cuffs will not cause injury to the arrestee is bull. First and foremost, in most law enforcement circles, "properly secured" is defined as the one that is in place the quickest, causing less injury to the officer, and thus less injury to the suspect. Also, say the arrestee is a feeble old lady, and she kindly puts her hands behind her to be cuffed, and the officer takes all the time in the world securing the cuffs "properly" [the photographer says the proper way is to have the chain facing "out"- which doesn't make sense, cause either way the chain is both facing in and out], and makes them all pretty and perfectly comfortable. Well, this kindly old lady forgot to tell the officer she smoked some rocks just prior to arrest and now the cocaine is kicking in, and she's wigging out and fighting. Those "properly secured" cuffs are gonna cause injury, and it's all dependent on how much that arrestee chooses to struggle.

    The amount of available bandwidth per visitor at any given hacker convention should be calculable as follows: ABPVAAGHC= [The amount of available free wireless networks in the area]* [The average bandwidth of those networks]/[The number of attendees at that convention] They're hackers...why would they have their own service?

    Water is an extremely poor conductor (ultra pure water is basically non conductive). Everyone forgets that. I've been on the wrong side of the argument before. Technically, if the board didn't release anything into pure water (dust and whatnot), it would remain non-conductive.

    Did XBOX and PS2 really ever surge ahead of PCs? I don't really think so. The PS2 ran at 294Mhz (when released, 2000)and the Xbox CPU ran at 733 mhz (2002). I know these are decicated gaming machines and that a 733 mhz cpu here probably compares to something twice as fast in a computer (because it has to do more stuff in a computer), but computer CPUs at their release times were up to 4x faster. I'm pretty sure a computer built for gaming at the time of the game consoles respective releases would have trumped the consoles. Does anyone know if there are any overall measurements of pure processing power for xbox or ps2? That is, a number that defines "gaming power" and is empirically comparable to that of a computer? Thanks :-)

    I've noticed that at least up until recently, if you really wanted to play games with good graphics your best bet was a nice home built computer system. Game consoles were OK but it was always computer graphics that mesmorized me. Looking at the specs for the 360 and the PS3 now it looks like they are finally getting pretty competitive with gaming computers. Are we now at the point where the game consoles, built solely for pixel rendering greatness, are going to surpass computers for gaming experience?

    Just FYI, not talking about availabilty of games on one or the other. Talking about pure pixel/rendering power.

    That's a sweet deal. I really wish they did have phones out there without all that crap. All that extra stuff just makes the phone more likely to break down. I just want a really good reception, powerful, clear phone. I guess it really is a consumer market? Public saying they want video, camera, music...companies go where the money is. Ranting...I would love to pay $6.66/month like you did. That would be awesome.

    ...I'm sure they'll be able to figure out all they need to do is call forward their number to a friend's phone, and leave their cell phone where they say they are going. Oh shoot. I think that statement just made this technology...useless? At least to the parents who really need to worry about their kids. My kids are going to be bastards, I know it. That's why I'm gonna staple GPS devices to their backs.

    The guy who said I should not have called 911 IS a moron. He's potentially making people less likely to call 911 in the future. You must understand that people who make other people less safe out of their ignorance should not be treated lightly, hence the "moron." As well, I hope you are not likening me chasing down someone who stole my cell phone and tried to run me over with a car to someone who would pull someone over for going 5 MPH over the limit. Cause that would make you a moron.

    I would have, had I the chance. But I never knew the guy had a car. I thought he was on foot. Cause when he ran away from me he ran across the street (away from his car). The only way the police could then catch this guy was if I maintained obs on him. I saw him fleeing. I had to keep after him. It wasn't until when he ran back across the street did I notice he had a car. I noticed this at the point he hopped into it and tried to run me over in it. But truthfully you should always maintain obs on someone, from a safe distance. Who's to say if I got the plate that would do anything, cause if he had to beg for money and steal people's phones why would he be driving a decent car? Could have been stolen, in which case plates would mean nothing. I appreciate all the input though guys it's a fun discussion.

    Sorry to hear that buddy. Glad they got him. Yeah this guy that stole my phone turned out, as suspected, to be an old gangster. He looked pretty tough. But I guess I got lucky cause I'm decently big, was in his face, and there were lots of witnesses. At one point when he felt cornered he started toward me like he was becoming offensive but then I said, "You better get the f*ck out of here" and that worked cause he fleed rather than fought. One of those few moments in my life I wasn't scared cause I was prepared. Probably made my fiancee a little more nervous about what I'm gonna have to deal with as a police officer.

    I've worked for a police department for 4.5 years as a Community Service Officer. And soon will be working as a Police Officer in the LA area. A fleeing thief is an emergency, moron. He committed two felonies. How dare you tell people not to call 911 in such a case? You are SUPPOSED to call (that is, it is your civic duty) 911 if you see ANY crime being committed. Not only did this guy steal my phone, but he also tried to run me over with his car. You idiot. Would you really just let this guy get away because you got your phone back? I got someone off the street who'd probably been stealing from people for a while. Just a reminder people, 911 is there for you to call when crimes are being committed, no matter how petty you may think they are. P.S. Calling police on someone who takes your stuff is not "Revenge." You are a moron who could get a lot of people hurt by making them think, "Oh- he's just pounding on the door, it's not really a crime, oh, he just knocked down the door, it's not a crime, oh he's just threatening to kill me, police probably have something better to do...". Can someone please help me on this one? I'm having a hard time believing this guy would post something so ill-thought out.

    The subject is now in jail with 2 felony charges and some misdemeanor charges.

    Here's how it went down. A week ago I was at a gas station talking with my fiancee in the car while the tank was filling up. My phone was on the sidepocket of the door (the armrest thing on the door) and the door was open. I know, stupid move. But I had been really paranoid about losing it cause I had just bought it so I was checking on it every 30 seconds ago so I figured it was safe enough. The tank finally finished filling so I exited the car and that's when I noticed that my phone was missing.

    I did that whole thing where you check the ground and your pockets and begin to freak out. Then I remembered some dude had walked right by our car maybe 30 seconds before I saw it missing. I looked on the other side of our pump and there was this 40+ something Hispanic gangsta dude with tattoos all on his neck asking some people for money for his "Car that broke down."

    In his breast pocket I could see what appeared to be the outline of my phone. He saw me looking at him and approached me and gave me some cockeyed story about how he ran out of gas and if I could only spare a dollar or so it would really help him. I told him I was busy at the moment if he would wait for me "over there" (out of earshot) I would be with him and maybe I could help him.

    I looked at my fiancée and said, "Call my cellphone."

    She asks what's going on.

    I tell her just to do it.

    So she calls my phone.

    As I approach the guy I hear, clear as day, the techno ringtone coming from his breast pocket.

    Damn I love how loud that thing is.

    I get in his face and tell him to give me my phone back.

    He looks confused.

    I point at his pocket and say, "You stole my phone, give it now."

    He pulls it out of his pocket, gives it to me, and says, "Oh no man, I found this over there." (points to the opposite side of the gas station).

    "No you f*cking didn't. You stole that phone from me asshole. Don't play stupid fess up."

    "No man, I don't know what you are talking about. Look, can you spare me some money or what?" [he's trying to avoid the discussion]

    "You just f*cking stole my cell phone. You know how much that thing cost me? What, you think I'm rich or something?"

    At this point everyone in the gas station is looking at us cause I'm berating this punk and getting ready for a showdown.

    "Dude, if you don't want to help me that's fine."

    He starts walking across the street to another gas station to evade me.

    I look at my fiancée and say, "Call 911."

    I chase after the guy and call 911 myself and explain to the dispatcher what is happening. I'm no more than 5 feet behind this guy at all times while he's trying to evade me and people are wondering what's going on. At one point he comes at me in a threatening manner saying, "Man- Who you on the phone with!?" I tell him I'm calling the police.

    The dude runs back across the street and I run back after him weaving through traffic. He gets in a nice newer Nissan Maxima and I jump in front of the car and read off the plates to the dispatcher. The asshole tries to run me over with his f*cking car, peels out, and speeds away.

    By this time everyone in the gas station is in total awe looking at what unfolded before them.

    It takes forever to get the Sheriffs there but I'm pleased with the way they respond and handle the situation. They take a report from myself and witnesses. They later call me and tell me the license plate was registered to this guy's daughter. They went to her address and she told him to check at the ex-wife's. When they get there they find the dude. They discover heroin paraphernalia in his vehicle.

    They book him with Theft, drug, and assault with a deadly weapon (his car).

    What a day.

    The dude picked the wrong guy to f*ck with. In two weeks I'll be in police academy.

    Watch out for your stuff people. People are not always as they seem.

    Haha I love how "blog publishing" has been in Microsoft Word forever. It's called "Save as HTML." At least I'm comforted knowing my fellow slashdot readers are not gasping at this...
