  1. Fragmented markets cause pircay on MPAA Touts Record Year For Hollywood · · Score: 5, Interesting
No one is saying piracy is having a dramatic affect on film sales yet. It will eventually.

That's partly true I think but the drive in Piracy would be more due to the way the studios try to fragment their markets in different regions, to maximise their own profits.

The internet has made the planet a truly global community and they have to relase globally, not try to stagger around the planet with Theatrical releases/DVD Releases and even different dates for TV premiere's.

In Australia we still cannot get video/TV on iTunes because of this or get access to other such online content because its all being restricted, so many people resort to pirace to see what they want and not wait 3-6 months(Up to a year some times) later.

Like the music industry the movie industry will only end up hurting itself by trying to contain online content rather then let it flourish in an open market, the more they put online for fair prices the more people will pay. Just take phone ring tones as an example of how people are willing to spend money on absolute crap. If more people could get movies at those prices they would be making huge sales.

how is that crippling other software?

Everyone knows that Apple is the cool kid in the school ground, and everyone knows that when the cool kid brings a new shiny API to school every other program wants to use it.

These other poor little browsers are unable to use the new API and feel depressed, because they know they are not cool enough to use it. You know what happens to depressed programs, they work slower and tend to rebel against their users.

  6. This article is a bit late on Vinyl Gets Its Groove Back · · Score: 5, Interesting

I've been involved with club and event promotions in Melbourne for about 6 years.

When I first started out, all the DJ's across Trance/House would only DJ with Vinyl and CD's were unheard of. In the past 12-18 months though that's all changed. Vinyl sales are down as DJ's and enthusiasts are all moving to CD's. CDJ's are now excellent quality and offer much more dynamic mixing abilities with better effects, beat matching and looping and sampling.
At the same time, tracks being produced are instantly available on MP3 which allows DJ's to purchase fresh hits the day the producer is happy with it, other then having to wait for tracks to be pressed to vinyl.

I believe this trend has followed Europe where they have been progressively been moving away from Vinyl in the past 2-3 years.

Vinyl is still excellent, I still love to collect it, but technology has finally caught up in the club scene where MP3 and digital music now offers much much more advantage to the DJ, especially in price. Buying 5-6 new records per week to play in clubs is expensive, when you can buy the same tracks for 3-4 dollars each online and burn them to CD.

When I look at people's computers these days they have heaps of different software popping up asking for updates, its got to a point where people ignore it, because its much too common.

The thing that annoys me most about update alerts is they never give you a reason why the software should be updated. It would be nice if they would give you a link or a summary of simple reasons why you need to actually update their free crapware.

Java and adobe products are probably the worst with this.

Just recently in Melbourne a newspaper journalist lifted comments posted on a forum and reported them as fact in a sensationalised article, without confirming or verifying with the authenticity of the comments, when in fact some of the comments on the forum had been made as satire.

This was then published in Australia's highest selling newspaper.

People may write unsubstantiated rubbish, but as soon as some lazy journalist finds it and treats it is fact in mainstream media, it can be very damaging for an individual or business.

It causes windows to pretty much choak and die as it just consumes so many resources and provides so much irritation, but major products like Trend or Symantec have not been able to successfully protect or remove them, I have had to use custom written tools that you get off the net for free. They really dropped the ball with that one.

Is it any coincidence that Microsoft has done this? Piracy does help them to a certain extent, it pushes their products into markets where people cannot afford them, or just flat out don't want to pay for it, which still ultimatley counts towards their market share.

  15. Copy drug punishment on RIAA Must Divulge Expenses-Per-Download · · Score: 1

I don't think the laws have adapated to the fact that people are happy to give away copyrighted material for absolutley nothing.
There are two types of groups breaking copyright now.

The actual pirates, copying material and selling it for their own commercial gain, to the detriment of the owner of the IP, and then you have the kids, mothers, grandmothers, students and anyone else dabbling in copyright infringment for personal use.

As with many drug laws in many countries, they have developed laws to severley punish the dealers and producers trying to use drugs for commercial gain, and have a seperate set of punishments for users, only interested in getting high, not making a profit.

This should be taken into consideration in copyright law as well I think. Someone is not recieving fair legal judgment when they are brought up on civil claims designed to punish commercial copyright pirates, for freely sharing, not for profit.

People don't really learn a lesson when you send them bankrupt for sharing 3 or 4 songs with JoeSixpack up the street, they only end up resentful, and make a lot of loud noise which gives your company a very very bad public image.
