    Until ALI manages to work an acceptable take on the Uniform Computer Information Transfer Act, though, i think the court was right to keep to federal copyright precedent. Also, it seems like the reference to 'Congress' was less in terms of the sales transaction, and more in terms of clearly delineating whether a property interest is created in the sale of a copy of software.

    i was in beijing 10 years ago, and we visited an archaeological site, conveniently located just over an hour outside town, that claimed to house fossilized remains proving that China was actually the birthplace of the human race. it was pretty awesome.

    'social aspects' matter greatly to me insofar as i enjoy games w/ a local multiplayer component, if not the whole point of the game. I like a good rip through a beautifully rendered and well written fps campaign as much as the next guy, but wii sports and rockband make up at least 90% of my gaming hours.

    Actually it really depends on how heavily altered the 'normal' food one gets at the supermarket is. generally speaking, an onion is an onion (and i lived in walla walla eating sweets for 4 years) a bell pepper is a bell pepper and white rice is white rice. however, milk, eggs, and a lot of veggies and fruit that have been bred for size and shelf-ripening by agribusines (tomatoes and cucumbers spring to mind) are noticeably different. that said, since you can't tell the difference, continue shopping where you shop. unlike many of my fellow coop shoppers, i could give a less of a flying fuck what everyone else eats.

    you dont really understand the history of copyright. its the IP clause of the constitution that provides for copyright, so, we as a nation have had it for, well a while. like the whole while that we have been a nation under the constitution. and also, 'People recognized (the situation) as being unfair so they invented the idea of (insert law here)' isnt exactly a recipe for evil subjugation of the people. there's nothing inherently wrong with the idea of copyrights any more than there is anything inherently wrong with the idea of imposing any other laws on society. the application of the idea is totally fucked, and is having totally fucked repercussions in society, *that* is the problem. see pretty much any other area of constitutional interpretation for other examples of fucked up application of constitutional clauses that seem innocuous or even well-meaning. its not uncommon. so why don't you keep the history lecture for a subject on which you are actually mildly informed

    we have the technology, but as long as people have money to spend on games that do not require an online connection to be enjoyed, people will still want a physical means of conveyance for said game. I'd also hardly call console releases something to be clung to. carrying a highly profitable product isnt exactly a last-ditch effort, its a reasonable business model.

    while it may be written in plain english, it is hardly applied on the plain-word meaning on a regular basis. in fact, lately, if its being applied on a plain-words level, it is usually Scalia using the plain words to limit, rather than protect a given freedom or liberty. Particularly on this topic, you really dont want to advocate plain-words, given that the 4th amendment describes not a "right to privacy" but specific places in which the government cannot search without due process. The Supreme Court decision that does explicitly recognize a right to privacy speaks not of 'plain words' but of 'penumbras' from other constitutional provisions. Furthermore, if you're operating a purely intrastate netowork, that's one thing, but the rest of us use internets that transcend state and national boundaries...

    much like dune, some of the made up words are just substitutions for things we have, some were genuinely unique objects or concepts. I think a lot of the bitching is about each chap starting w/ a dictionary def of a new term. But perhaps these people are unfamiliar with Stephenson's tendency to begin all chapters with a quote or something similar as a way of setting the mood, pointing the direction he's going, etc. I was thoroughly unfazed by the arbre-speak, and some of it was very revealing about the nature of life on arbre. but whatevs, we dont all have to agree.

    the intentional infliction of emotional distress action is a civil action and not, strictly speaking, at issue in this trial. The unauthorized access isn't being construed as criminal activity in and of itself, but only in so far as it was committed to further a tortious act.

    So, no, it would not set the precedent you fear (unless you routinely share your wifi in the process of committing assault, or for the purposes of harrassment).

    That said, i'm not really comfortable with the precedent it *would* set either. Making a non-criminal act criminal simply because it happens in tandem with a possible civil breach is kinda fucked up. If we want there to be criminal charges for IIED cases that result in death, we should revise the criminal code to explicitly make such acts criminal rather than doing an end run like this.

    Tho i can certainly respect your take on it, i really feel strongly the other way. I'm feeling less and less reverent of the camp of my childhood. I watched the shit out of TOS and early bond when I was younger. I think trying to maintain that same spirit through so many generations was what lead to abortions like Insurrection, Nemesis, and The World is Not Enough. I like the idea of original series prompt, minus the camp. I like the idea of 'what was bond before the gadgets?' And just to really make it plain, to the at least 4 comments i skimmed on this page whining about canonicity, stow it. there are obviously several notable breaks from canon evident in the trailer; get the fuck over it. Tho the James Kirk Road Warrior intro looked pointless and dumb.

    shit, that's the funniest thing i've read in days. I have a friend who whenever the davinci code is mentioned has to interject an earnest, "its totally all true!!!1!" The nod -> eyeglaze routine is pretty well established now. Some people are just so stupid that they cannot tell the difference between critical evaluation of information and counter-establishment = true.

    Really the only shows i dont wait to netflix are Lost, Battlestar, and Heroes.
    My friends and i tend to just mute commercials and have the requisite 'omg, mind is blown' discussions then, even if we're watching it dvr'd.
    There's also always That Guy Who Can't Remember What Happened Last Week to contend with, and i much prefer dealing with that during commercials than missing more dialog just to confirm, yes, last week's ep involved X.
