Really though you cannot compare TIVO to cinema. TIVO is taking a previous selling point (commercial skip) and is essentially removing it. Can you imagine going to an Imax and once inside they just show the regular movie.
I do have sympathy for TIVO, the linking of provider boxes to the service needs to be stopped.

I read an interesting article about the South American drug trade couple months back (link) Apparently with the U.S. sponsered herbicide spraying farmers aren't able to grow legitimate crops. As a result the farmers had to switch to herbicide resistant cocaine.
Its civil, not criminal. NDAs are an agreement between two entities, in this case Apple and its employees. The blogger is a 3rd party who hasn't signed an NDA with Apple.
The only real way I can see the blogger responsible is if they entice someone to break the NDA. (ie, $$$) They aren't breaking a contract, an employee is.
Whether Apple should be able to force someone to reveal where they got the information is pretty grey.
I've heavily played MMOs since EQ came out at times for over 30 hours a week. Its not unusual for me to stop playing for multiple weeks and I don't miss it.
The comparison to TV imo is a very apt one, countless people spend diner -> sleep in front of one and think nothing of it. At least with games its interactive and can be beneficial. (Problem solving, etc.)
The plaintiff probably isn't suing due to the damage to his reputation in Ontario, Canada with stronger libel laws just provides a convenient way to to take revenge on the Post.
There is an important line in the article, "the Post had seven subscribers in Ontario when the article appeared", I believe that by accepting Ontario subscribers they would be considered as doing business in Ontario. If they do business in Ontario they have to abide Canadian libel law.
This isn't a freedom of speech on the internet case. This is news agency doing business in a foreign country and not wanting to abide to their laws.
Very few customers are competent enough to handle a file system change on their system. And if WinFS is as drastic a change as its been made out to be it could have unforeseen consequences across the board.
I can't see many people being willing to switch from DVDs at this point. I would bet 3-5 years before the industry manages to pick one and titles start showing.
And really, unless you have HDTV the new formats aren't going to be worth it.

Otherwise I agree, the purpose of the patent is to protect public available software from being run by authenticating both a user, and a PC. Apple's software doesn't seem to fall under this as authentication is not for 'software product' use, but for access to user specific data.
