Not in my experience. Also, 7zip's software is horrid compared to WinRAR. Also, there is a fully functional version of WinRAR available for free. They released it in a 1 day giveaway sometime last year I believe.
I see this often as a reason that our laws apply to everybody. If that were they case, our laws apply everywhere to everybody since it doesn't mention only applying in our country either.

No, there's a very simple solution for Apple there. They simply need to publish a list of compatible hardware. If they include several MB chipsets everything else will probably "just work". That's the biggest issue for building your own Hackintosh. If you don't use a MB with compatible hardware Apple doesn't support it.
Same with BMW. Great irony - it's cheaper for foreign auto makers to assemble here in the USA than it is for the Big Three...mostly because of overbearing union activity.
Just for your information Subaru is not a union facility and actually had to sue the UAW because they were putting up signs at the Indiana plant that insinuated that it was a union facility. My dad worked there for 13 year from when the plant opened. I did a little bit of PLC work on the production line for an outside firm. The quality of American labor is not a problem. The unions have destroyed what they were initially meant to protect.
I do have to ask...Are you all just ignoring the part where it says "can't exchange ideas with other developers" or do you just accept it? That will NOT stand up in court as it violates my rights. They can tell me not to discuss their SDK features, as that's their property, but they can't restrict my rights to discuss my own ideas. It doesn't matter if i signed a contract or not if it violates a constitutional right.
