  1. No win situation for MS?!? on Software Makers Lobby EU Against Microsoft · · Score: 1

    Microsoft has two options.

    1) Continue to produce a less than optimally secure product. Symantex thrives, and the world still bashes MS for putting out an insecure OS. Except now since Symantec legally FORCED them to release an insecure OS which they KNEW to be Insecure they can be sued for producing a known faulty product.

    2) Integrate better security to show you're trying to fix the problems in the OS (which is what Symantec has made it's livelihood doing for MS) and have Symantec sue you for being evil enough to produce a good product which makes theirs less needed or obsolete.

As for the Adobe part... If Adobe makes PDF an open standard, and MS implements the open standard then Adobe doesn't have a leg to stand on. Or will we see a new version of GPL licensing that says "anybody can use this, except Microsoft".

As for the article and topic. The question becomes will there be some measure to defeat this legislation before it becomes law there. And is this an effort by Australia to prove it's more media cartel friendly than the US, or just a play by the media cartels to see if they can test the waters there before bringing that same legislation here to the US.

  14. Re:In the realm of Video games, Nintendo INVENTED on Wii Hardware To Be Profitable At Launch · · Score: 2, Informative

I think you're confusing the concept of "razor and blades" marketing to "Intellectual Property" controlled marketing.

"Razor and Blades" is the concept that you sell the base unit (i.e. console or razor) at a loss becuase you sell the consumable (games or blades) as enough or a markup to make the money back and then some. Because once they buy a razor from you they have to come back and buy blades every week. In the long run that can be more profitable by giving the razor away.

"Intellectual property control" marketing is the process of licensing others to produce goods which work with your platform. This is what Nintendo did with the chips in the nintendo cartridges. Sony and MC both do this to developers of games for their respective platforms. In effect this is like patenting your razor, then charging the blade companies royalties to make blades for your razor.

Not that there's anything wrong with that. I can't wait to see that be possible, so that straight up MP3's can be beamed across. Of course the RIAA will not stand for that and try to have the technology declared a violation of the DMCA.

From the "how this could be used legally" department. Imagine being a local band, gigging around town. You have your little merch table where people can buy your CD's, shirts, g-strings, whatever. You also have your merch guy running a laptop which has a "zune distribution app" on it. Anybody with a Zune at the show get's a beep saying "Want to download a sample track of the latest CD for free?"

They are trying to push MS into a no win situation.

    A) MS doesn't include as complete and inclusive security as possible. This leaves the doors open for third party security developers, it also leaves the door open to the OS for malevolent people who will take advantage of the fact that many people won't think to add a product later for security.

    B) MS includes all the security they can, possibly making it so that people don't need third party software for security. BAM new anti-trust action because they aren't being fair to people who made a living covering bad MS security architecture in a previous version and aren't being given an equally bad architecture to help "protect" for a profit this go around.

People complain that MS releases insecure OS products, then complain when they want to include more security features?!? bah

I won't even get into how Apple is bundling everything they can under the sun into OS X when the same actions by MS would be tantamount to kicking the interwebs dog.

They will be deperately hard pressed to prove they innovated many , if any, of these business practices, and I believe some of their patents could actually be thrown out because of being brought to the light of day like this.
