  1. Re:can traffic shaping be proved in court? on Bell Canada Launches Its Own Online Video Store · · Score: 1

It's very difficult to prove that traffic shaping is taking place, but you can make a pretty definitive case with a little research.

Net traffic and spam generally only delay transmission time.
A disproportionate number of dropped packets and reset connections often indicates throttling.

If you use Azureus, there is a plugin (Network Status Monitor) that monitors these things in order to determine how your ISP is handling P2P traffic.

That is kinda like asking Americans if they think terrorism should be fought, and if so should it be done by the US DoD. That's an excellent analogy, because it infers a similar backlash against anyone who doesn't give the desired answer. Anyone who doesn't think that terrorism should be fought, and fought by the US DoD must be a terrorist or terrorist sympathizer. I doubt that real public opinion in China is quite as polarized into two neatly-defined camps as the survey would have us believe.

To everyone who is getting wet thinking about a mass of computers in a few US military installations flooding political opponents with connections: consider that the internet is basically a series of tubes. (Stay with me).

It doesn't matter how many water taps you have on side A, running at full pressure, if they are all connecting through a small pipe to get to target B. More taps and pressure are good, but the bottleneck is the connection. If the bottleneck is smaller than B's capacity to receive water (or sewage, or whatever you're sending through this awkward tube analogy), then B is not being flooded.

Why not adopt a Karma system? It's not like it's a new concept. (Hey... look: we have one here.)

People who're "new around here" or tend to troll tend to have their messages buried. The messages of established, insightful posters tend to float to the surface. A very lightweight and open system of moderation allows anonymous messages of value (like that of the parent) to be "modded" into higher visibility.

Additionally, giving certain "privileges" to quality posters allows you to retain the core discussion group. There's no need to set up additional barriers to your potential readership.
