I am surprised that some company (I have Apple in mind) isn't trying to sue everyone for the process of suing people for copying stuff that they, themselves, have copied. I just think it's the logical next step.

So, what if the data center isn't near a suitable reservoir. Even if it were, I am sure there would be hundreds, if not thousands, of people complaining that MicroSoft displaced them to put a reservoir there.
How is this any different from Google circumventing the default privacy settings in Apple's Safari? Google was sued here. Since Apache isn't a company, is this the way for the likes of Google and others to get their bidding done?

This is a penalty due to a contractual obligation. It's not a fine.
