"Paid" is a financial or transactional term, while "payed" is a nautical term (e.g.; "the rope was fully payed out").

But one big problem that sticks out in my mind is that ISPs want to enjoy the protections of Title II (the main one being no liability for information transmitted over its facilities) without having the responsibility and accountability of a Title II (common carrier) service.
