Perhaps this goes without saying, but the title is misleading. The Grand Jury did not indict Mr. Swartz on any copyright infringement or acts of piracy on the high seas. There are really only four indictments: wire fraud, computer fraud, unlawfully obtaining information form a protected computer, and recklessly damaging a protected computer.

The US federal government has awful, awful branding. It's just terrible. How could half of social program recipients believe that they have "not used a government social program"?
In Canada, the federal and provincial governments make sure you know what they're doing. Every advertisement/public service announcement from the feds has the Canada wordmark, a simple "logo" with the word "Canada" and a Canadian flag above the last "a" (on TV and radio ads someone always says "A message from the Government of Canada"). But it's not just media advertising -- movies and tv shows that get tax credits from the government show it, correspondence (taxes, welfare, etc.), worksites partially paid for by government funding, and it goes on and on.
That's not to say that the branding gets to politicians' heads: our stimulus had a massive amount of advertising that many thought was flagrant self-promotion of the current government's policy, as opposed to ads which are usually along the lines of "Don't bring things across the border you shouldn't" or "Here's how young people can get help finding a job" or "Come visit our national parks". The current government even made it such that anyone who accepted stimulus money had to purchase a sign at their own cost extolling the benefits of the stimulus and the plan, post it on-site and send two pictures (one wide shot, one close-up) back to the feds before getting the money.
But when I look south, I'm at a loss to figure out who's responsible. Is the national guard a state or federal program? Is the FDIC run by the banks, or is that freecreditreport.com site run by the government? Who funded that study I read online? And the US government's websites all look completely different, so you don't know if it's the government or some independent agency or someone else (.gov notwithstanding -- who looks at URLs anymore besides
/. readers?). Maybe if people knew all the services provided by government they wouldn't hate it as much (or maybe they would hate it more, but at least they would better understand everything they want to cut). It also lets you judge information more easily based on its source (your choice whether that improves your opinion of the information or the opposite).Up north, I see this great anti-speeding ad and the Quebec flag at the end of the word Quebec and I know where it's coming from. Or this anti-fraud ad. France has their wordmark/logo too.

No locate ? OSX manpages online says you're wrong. And Macports (formerly Darwinports) has been around since at least 2003 delivering all other goodies you can think of.
No offense but I think time and frustration may have warped your memory.

sifting through live shows
I was looking at my 2TB drive wondering where to start with that mess, let alone my 1TB with just Live Dead and Phish shows..
Why would you need to worry about the Dead and Phish stuff? It's all legally tradeable unless you were dl'ing ripped Dick's Pick and stuff from Phish Dry Goods!
The way to verify the shows would be: checking that the show folders and files conform to Etree naming standards, the presence of the info text file and MD5 checksum file or searching the Etree database or Archive.org for that show source. To date, the only downloads that I have seen that don't meet those criteria are the Grateful Dead complete SBD download torrents by year. If it was a case of getting stuff that was ripped from someone's collection, you can do individual file comparisons against known sources to determine which source a show probably came from, track times are usually a giveaway since it's rare that different sources get cut at the same place...
The most efficient model for consistent music distribution has been the one used by Etree.org/Archive.org. Each live show source was transferred, encoded and seeded with the MD5's generated at the time of encoding, earliest shows were done in SHN and later it was shifted to FLAC. A new show source was considered the equivalent of a Gold Master Disc and it was entered in a database at Etree.org. All subsequent copies of the SHN's and FLAC's were expected to check against those MD5's and if they failed they were considered bad and discarded so that they wouldn't get seeded in the future. It didn't matter what transport method was used for transferring the files, all that counted was that the files were bit perfect copies of the originals.
For example, here is a show I transferred and seeded in 2000
If you were to obtain a copy of those SHN files today, and you verified the MD5's, you know you have an exact copy of the files as they were encoded A DECADE AGO. Now if I were to transfer the master cd's again and encode it, the MD5's would not match, no matter how paranoid an attempt at DAE was made (this was proven back then for all digital transfers INCLUDING DAT>WAV) If you looked across the different formats available, even after 10 years there are still only 4 unique variants in the wild in spite of the show being copied by more than 5000 people. Those 4 variants are only a single format conversion removed from the initial transfer in 2000.
But this was a system that was conceived to preserve the audit trail and file integrity. The issue of legality was not a problem since the bands have given permission to allow for taping and trading of their shows.

To Know a Jedi
Reading this article I was strongly reminded of a Star Wars fan film I came across some years ago. To Know a Jedi follows a bunch of Star Wars fans who decide to try to make their own light sabre. Somewhat to their surprise they succeed, which gets them wondering; how much else of the Jedi mysticism is true?
The film is a full length movie and takes the unusual step of giving Star Wars a serious treatment in a real life setting (as opposed to "long, long ago in a galaxy far, far away"). It's made by a bunch of film students on a low budget, but is put together pretty well. Definitely worth a look.

Hell, there are dozens of local bands here in my city of 100,000 who have CDs of original content, most of which is far superior to the dreck that comes from the RIAA. Have a listen to some of my friends' music. Those are live shows, they have studio CDs as well.
There's no shortage whatever. The "shortage" has always been because of the fact that recording and filming were incredibly expensive. Today recording is dirt cheap, and the price of making a movie is coming down fast -- Star Wreck only cost a few thousand bucks and is better than 90% of the multimillion dollar dreck that comes from Hollywood (it's also hilarious, every Star Trek and Babylon Five fan should see that movie).

I don't remember the predictions requiring a certain percentage marketshare increase. They simply predicted that Unix(-like) platforms were gaining users and thus malware would be all over them.
The underlying premise for such predictions was always market share.
Though, frankly, I don't recall any predictions specifying hard terms. What I do recall are predictions such as "if Linux becomes popular, then it will have a lot of malware". If people were saying that it would be in 10 years, then either they had a very optimistic outlook of how Linux would develop, or did not understand the issue.

At the most fundimental level, popularity was a point. But there wasn't a prediction of X% market share being a tipping point. It was always simple increased popularity drawing the attention of malware authors. And indeed, there WAS additional malware. It just didn't bloom in to the predicted plague.
As for increased number of Unix/Unix-like users... good question. Linux has always been hard to track. But Apple posts numbers sales numbers. In May 2010, it was estimated that Mac OS X had a 7.83% market share. Forrester claimed a count of 1.2 billion personal computers in that time period so the Mac user population was about 93.96 million. Those numbers have increased over the last year.
The question is still the same: why would you target those machines, even if they are significant, if you can target 10x as much for the same money spent?
The only counterargument is that there is currently a lack of competition for botnets and such on OS X and Linux, so that raises the ROI somewhat. I don't know how it all stakes up, but I'm pretty sure that, given the current ratio, targeting Windows desktops is still way more profitable, and will likely remain so for years to come.
Why does it have to be either or? Sure - Windows is a nice big target. It's also a well-known target full of other players, anti-malware, dedicated support, etc. If the Unix install base is so ripe for the plucking, a big chunk of a smaller pie would fit nicely in to one's botnet along with all the usual victims.
The recent OS X malware story has been, frankly, blown out of proportion. This is largely because of a a stark contrast between it and Apple's rosy marketing materials (which strongly imply that there is no threat of malware on OS X, period), so most people focus on that, and there's a lot of downright gloating. But, rationally speaking, the threat of malware on OS X, while non-zero, is still minuscule. A clueless person is much more likely to get infected running Windows than OS X. So, yes, I stand by my assertion that OS X is "too small to worry about".
Too small to worry about yet still being targeted - I stll find that an interesting dichotomy. I do agree that the threat is blown out of proportions and so are the continued predictions of doom. Indeed - complacency would help bring about said doom. We should watch carefully. But I don't see any evidence to support that this is any sort of tipping point.
