Even worse, in a case like this where a man has been held 3 years now for his claim of forgetting a password not being believed, whether that was legitimate or not, if a password is even a little complex just going a few months without using it and you're likely to have forgotten, nevermind multiple years. So the longer they hold you the less likely compliance is, and a contempt of court hold is supposed to produce the opposite effect. That's why I'm always saying that it carries an effective possible life sentence for forgetting a password.
Since different courts are currently split, SCOTUS is eventually going to have to settle this, and unfortunately wiping your ass with any part of the Bill of Rights that interferes with law enforcement is the favorite passtime of the right wing*, who are now in control of the court.

A plan for emergency services would by necessity have to involve planning for contengencies during emergencies.

It was Verizon's policy to remove caps when contacted during emergency situations, and they did not follow that policy. Verizon has admitted that it was their mistake.

I bet that they are member of the Google android manufacturer club or whatever name they use like Open Hanset Alliance. There were a number of articles documenting Google trend to reduce Android fragmentation. It leads them to go away from the open source philosophy and values.

She's not suing CBP. That's pretty stupid since case law says she'd lose under all sorts of "protecting America" style laws.

She's filed a Rule 41(g) Motion instead, or "Motion to Return Property".

In other words, she's basically seeking to have CBP tu "return" all the data they collected from her phone - to not only destroy the images that were created, but any portions thereof, plus to have 3rd parties who many have accessed said image for any reason to again delete that data they may have collected.

Even more, she wants information on what happened to the data, including information on who it may have been provided to for what purposes and such (presumably also to verify that they too have destroyed/returned the data)/

If anything, it's probably a more unique case to go through the courts with and one where she may succeed - it wasn't necessarily wrong to collect the data, but now she's ordering its return and justification for keeping that data. And by "return", legally it means "full deletion" (remember the Waymo vs. Uber? Waymo wanted the "return" of the data which really meant the data was given back and destroyed).

It's currently an open question as to whether or not you can plead the 5th in the US. Some courts have dishonestly tried to claim a passphrase/PIN is more like a key than a combination to a safe, and therefore can be ordered to be used. It's frustrating now to the employer and has been this way for 20 years for the employee who does not have +10 years experience doing the exact same job with the exact same description with 3 managerial references who can attest that you really did do the exact same job as the one listed.

Steve Jobs would be doing help desk work or a janitor at Atari as he had no programming experience and employers don't want to train. They want someone to go at it full swing and stick around for +15 and never job hop or have a history of doing so.

There is no such thing as the ideal job for us. BUT there is no such thing as the ideal candidate either. If employers are willing to train then I will be happy to go to the next level in my career for them.
