Mark Cuban Declares War on GooTube
PreacherTom writes "Mark Cuban — the billionaire owner of the Dallas Mavericks, tech entrepreneur, and self-proclaimed 'blog maverick' — has always been outspoken in his ridicule of Google and YouTube. Now, it appears he's willing to put his money where his mouth is. Cuban is so convinced that GooTube will be a failure that he is in the process of acquiring the news agency owned by Robert Tur, currently involved in serious litigation with Google over copyright violations. With billions on both sides, this could be a real clash of the titans." -
FCC Meets To Investigate Cookie Abuse
PreacherTom writes to tell us BusinessWeek is reporting that the FCC and the Center for Digital Democracy plan to meet in order to discuss abuses with regard to cookies. From the article: "Online advertisers have a sweet tooth for cookies. Not the kind you bake, but the digital kind — those tiny files that embed themselves on a PC and keep tabs on what Web sites are visited on which machines. But cookies could have a bad aftertaste for consumers. Privacy advocates say the files are being force fed in large quantities to computer users, and they're demanding that the government put some advertisers on a diet." -
Making the Jump From Web To TV

Fighting For the Chinese Gaming Market
bart_scriv writes "While lots of ink is being spilled on the Wii/PS3 war, the real battleground for gamers may be in China, where companies Shanda and Netease are fighting for supremacy in the world's largest potential gaming market. The article looks at the companies' dramatically different business models (traditional subscriptions vs. virtual item sales), and offers screen caps of the companies' most popular online games: 'China is even expected to surpass tech-happy South Korea next year as Asia's biggest gaming market. China's overall Internet user base is enormous — about 120 million this year and growing fast. Yet it's a business in flux, and there is a huge debate among companies in this arena about whether to stick to a subscription fee model or go with a free-to-play one to build up a huge online consumer base. The lost revenues would be more than made up by sale of virtual goods (such as ammo for avatars, and so on) and also music and online movies to the legions of gaming fans attracted to its site — or so the theory goes.'" -
Top 10 List of Worldwide Internet Censors
PreacherTom writes "Reports of internet censorship are nothing new and are quite expected from countries whose leadership depends on controlling the popular worldview. Reporters Without Borders, a Paris group that does advocacy work for press freedom, puts a number to the trend with a list of the countries that it says go the furthest to censor the Internet. Photos document the worldwide protests and continuing struggles. Not surprisingly, China is described as the pioneer of internet censors, dedicating more resources than any other country to restrict online freedoms." Google Video Sued For Copyright Infringement
PadRacerExtreme writes to mention an Associated Press article about a lawsuit against Google Video over copyright infringement. The company provided no additional information about the case, which it disclosed in an SEC filing on Wednesday. Some analysts are viewing this as a preview of what may happen to the company after it completes its takeover of the YouTube site. From the article: "Because it indexes so much material owned by others, Google has become accustomed to fielding complaints about copyright infringement. Some of the disputes have triggered lawsuits for everything from Google's efforts to make digital copies of library books to its search engine's ability to display snippets of news stories and photos appearing on other Web sites. Those suits haven't become a big financial drain on Google yet, and investors so far appear confident the company's lawyers will minimize the damage from any claims brought on by the YouTube purchase." -
A Concrete Solution To Pollution

It is called TX Active: a concrete that literally breaks down pollutants in the air. The effects are significant: 'In large cities with persistent pollution problems caused by car emissions, smoke from heating systems, and industrial activities, both the company and outside experts estimate that covering 15% of all visible urban surfaces (painting the walls, repaving the roads) with products containing TX Active could abate pollution by up to 50%.' Even more significant is that the cost is only 30% over that of normal concrete. Remarkable." -
NTP Gets a Taste of Its Own Medicine
UltraAyla writes, "NTP's patent suits seem to have attracted the attention of Oren Tavory, a man who claims to have worked on a project with NTP founder Thomas Campana back in 1991. From the article: 'In September, Tavory filed a lawsuit against NTP in U.S. District Court in Richmond, VA, demanding that a judge issue a court order naming him as co-inventor on seven NTP patents, and accusing NTP of copyright infringement and unjust enrichment.'" -
Foundation Commissions $50 Million Online Study

Still, the MacArthur Foundation doesn't think that is quite specific enough. The private, grant-making institution is commissioning a $50 million, five-year study to investigate precisely how and why young people use the Net. $10 million in grants is going to to individuals and organizations to work on projects that stimulate research in digital media. Sign me up." -
Microsoft Announces TV and Movies for Xbox Live
PreacherTom writes "In the latest of several recent upgrades to their online service, Microsoft has announced that their Xbox Live service will begin offering movies and television on demand starting on November 22nd. All subscribers (including those using the free service) will have access to movies from Paramount and Warner Bros. along with TV shows from CBS and MTV. Prices haven't been officially released as of yet, but MS has stated that they are attempting to be competitive with similar services from iTunes and cable companies." Beyond 3G — Practical Cellular Internet Access
PreacherTom writes "For years 3G, or 'third generation,' denoted some future wireless utopia where voice, data, and video would all merge into a wondrous amalgam, marked by snazzy phones that do everything perfectly — and fast. There is indeed a new wireless utopia, and again, it's about merging voice, data, and all the other stuff at even faster speeds. It is known as High-Speed Downlink Packet Access, or HSDPA, and it has started appearing on wireless networks operated by companies such as Vodaphone in Europe and Cingular Wireless in the U.S. Meanwhile, South Korea's Samsung has even started building HSDPA-ready phones. The technology promises wireless speeds as high as 3.6 Mbps but in practice will be much slower than that — fast enough, though, to make wirelessly surfing the Web and downloading music and video well worth the effort." -
Cingular's Free Music
PreacherTom writes "Music on one's mobile phone is nothing surprising: in fact, it is the entire principle of the upcoming iPhone. Downloading it for free is a different matter; both Verizon and Sprint's service directs to a proprietary store and charges up to $2.50 per song. Cingular plans on taking another route, having announced that they are gearing up to offer free music downloads to compatible phones. They hope to make up the difference through fees from the music subscription services for each new reference. The catch: a $15 per month fee." -
Political Mudslinging Via YouTube, MySpace

One notable example: In the Virginia Senate race incumbent Republican George Allen held a comfortable lead over challenger Jim Webb until one of Webb's camera-toting aides captured footage of Allen making a racial slur during a campaign stop. The video soon held the number 1 ranking on YouTube and gained national attention. Allen has since taken a steep drop in the polls, and Republicans now risk losing a seat they thought secure." -
Does Offshoring Threaten Combat Software?
PreacherTom writes, "Pentagon officials report that 'maliciously placed code' could compromise the security of the Defense Department and, ultimately, hurt its ability to fight wars. The culprits: offshore programmers. While the Pentagon has stepped up its vendor screening and software testing of late, it's becoming more difficult and costly to test every line of software code on increasingly sophisticated weapons systems. The task force assigned to this issue will be soon presenting its report, and most likely will determine that offshoring presents too great a risk." -
NPR Finds XM's Achilles Heel
PreacherTom writes "In the ongoing radio wars, one only has to listen to 20 seconds of Howard Stern's language to know that the lack of regulation gives satellite radio a distinct advantage. Of all the challengers, it seems that NPR has finally found a weakness in XM, which supplements its satellite coverage with earth-bound transmitters. A recent test found that 19 of these transmitters were unlicensed and another 221 exceeded their authorized power level, giving NPR an opening to press with an apparently sympathetic FCC. It certainly doesn't help that XM's own filings support their case." -

theodp writes "Computerworld Editor-in-Chief Don Tenant expresses astonishment at HP's cluelessness in the wake of its boardroom leak investigation fiasco, noting that HP CEO Mark Hurd's choice for a new Chief Ethics Officer was Hurd's go-to guy at NCR when the boss wanted internal leaks investigated." From the article: "It seems incomprehensible that no one at HP could foresee that appointing a former Hurd colleague to the ethics oversight position might be perceived as a shameless attempt by Hurd to keep from being further sullied by the scandal. But there's another dimension to all this that's even more baffling. Nearly two weeks before HP announced Hoak's appointment, BusinessWeek ran a story that recounted how Hurd had to deal with a number of internal investigations at NCR, including probes of leaks of sensitive information on Yahoo message boards." -
What If Apple Made A Cell Phone And No One Cared?

He expects Apple to introduce the devices in January at Macworld, a conference for Mac enthusiasts where the company typically debuts new products. At least one of the phones will offer Wi-Fi connectivity and both will become available in the March quarter of 2007 ... but will anyone care?" -
A Brief History of Game Console Warfare
conq writes "BusinessWeek has a gallery on the history of console wars. Starting with the 1972 Magnavox Odyssey, all the way to the 2006 Wii. The details on the Magnavox Odyssey: 'This is where it all began. Game guru Ralph Baer's invention for Magnavox brought video gaming out of the arcades and into the living room. As the first home video game console, the Odyssey had no audio output and could only display black and white images. But the system came with translucent TV screen overlays to simulate full-color graphics in games like tennis and hockey. The Odyssey's sales were less than impressive: Magnavox had sold about 350,000 units by 1975.'" -
Apple Should Get Out of Hardware?
SQLGuru writes to mention an analyst recommendation being reported on ZDNet. Despite a BusinessWeek article about Apple's record breaking hardware sales, the folks at Gartner think Apple should get out of the hardware business. Calling for the company to license its hardware to Dell, the analyst company says that gains in Apple's hardware sales are simply not sustainable. From the article: "Apple's margins for its Mac business, currently around 40 percent, are only sustainable because component makers such as Intel choose to prop up the business, Gartner claimed. Given that HP has forced Intel to offer it comparable pricing to Dell, Intel is unlikely to continue to subsidise Apple, the analyst argues. 'As a result of permanently changed market conditions, Intel has been forced to restructure and, in our opinion, cannot go on supporting Apple (or any other customer) indefinitely.'" -
Peter Gabriel Wants You to Re-Shock the Monkey
PreacherTom writes "The party line for the music industry has been clear: discourage music downloads at all cost. However, singer Peter Gabriel is taking things in a different direction. In order to promote his own label, he is actually encouraging people to not only download his music, but also adapt it into something more modern. In doing so, he actually posted a sample pack of Shock the Monkey consisting of vocals and other pieces of the original multitrack recording. Some in the music business would call this the commercial equivalent of hiring kidnappers to babysit. In actuality, Gabriel is pleased with the results." -

PreacherTom writes "Online advertising is considered by many to be the most dependably trackable ad medium of all time, with revenues expected to grow to $16 billion in this year alone. However, companies are finding that competing methods of measuring web traffic are giving contradictory results. Since advertising revenues are based directly on the traffic developed, this news could mean serious trouble. For example, valuations for startups such as Facebook and YouTube appear to be doubling every few months, but those numbers are based on traffic figures that could be misleading." -
Companies Continue to Get a Second Life

Yesterday, Wired magazine opened their 1-acre digitized headquarters, complete with neon-pink sliding doors and a nouveau 50 person conference room. Businessweek takes a look at the new virtual offerings from Adidas, Toyota, Lego, and even Major League Baseball in their pictoral spread. 'We are this canvas that allows companies to do what they want to do in Second Life,' says David Fleck, Linden's vice-president of marketing. 'It mimics real life much more accurately.'" -

YouTube Leaves Google Vulnerable?
PreacherTom writes "Yesterday's big news was Google's $1.65 billion deal to acquire popular video hosting service YouTube. But will it be a good deal? The market thinks so, as Google's stock rose about $10 per share after the purchase. On the other hand, YouTube increases Google's risk of copyright infringement, opening the door for significant liability...if Google cannot solve this issue. Will their planned video 'fingerprinting' be enough, or just a billion dollar mistake?" From the article: "YouTube's policy is to remove copyrighted clips once alerted to their existence. Content providers say the company needs to be even more proactive ... Todd Dagres, general partner at Boston's Spark Capital, says that Google's large market cap of $130 billion makes it much more vulnerable to lawsuits than a private company such as YouTube. 'Once Google starts to apply its monetization machine, there is going to be more money at stake and people are going to go after it,' says Dagres. 'You cannot monetize other people's content without their approval.'" -
Bug Hunting Open-Source vs. Proprietary Software
PreacherTom writes "An analysis comparing the top 50 open-source software projects to proprietary software from over 100 different companies was conducted by Coverity, working in conjunction with the Department of Homeland Security and Stanford University. The study found that no open source project had fewer software defects than proprietary code. In fact, the analysis demonstrated that proprietary code is, on average, more than five times less buggy. On the other hand, the open-source software was found to be of greater average overall quality. Not surprisingly, dissenting opinions already exist, claiming Coverity's scope was inappropriate to their conclusions." -

Gap Between Google and Competition Widening

We've heard of many different kinds of search engines and many different companies entering the market but: '... Google keeps gaining share in the face of newly launched capabilities on other engines. In August, Google sites gained 6.8 percentage points of search share from a year earlier, according to researcher comScore Media Metrix. Meantime, Yahoo lost 1 percentage point, Microsoft's sites lost 3.3 percentage points, and Ask.com lost one-half of a percentage point.' All of this on the heels of recent news that A9 scaled back its features. Is it possible to think of a number better than a one with a hundred zeros behind it?" -
Venice Project Aims For TV/Web Convergence
PreacherTom writes, "The founders of Skype, Janus Friis and Niklas Zennstrom, are offering a sneak peak into their newest venture, The Venice Project, a video site that combines professionally produced TV and user-submitted videos with the interactive tools of Web 2.0. So, what will Venice offer to combat YouTube's dominance? Streaming video with DVD-like controls, on-screen menus of preset channels, and interactive tools to share video playlists are only the beginning. Venice's Beta will be expanded by the middle of November, with general release by New Year's Day." Calif. AG Files Felony Charges In HP Probe
PreacherTom writes, "Former Hewlett-Packard Chair Patricia Dunn, along with 'ethics chief' Kevin Hunsaker and others, was indicted yesterday on four felony counts by the California Attorney General. The charges, including wire fraud and conspiracy, carry a maximum penalty of 12 years in prison and $30,000 in fines. The indictments follow on the heels of an HP investigation of internal leaks that conducted "bugged" emails to C-Net reporter Dawn Kawamoto, illicitly obtained hundreds of phone numbers, and spied on HP board members." One of the indictments was for a private investigator retained by HP. The article has links to the complaints and warrants. -

Linux Taking Over Schools in India

In a country with a long history of corporate problems and financial issues, the inexpensive and flexible nature of open source software is gaining a lot of ground. Click Fraud — An Insider Look

It includes the record of a phone call the reporter had with someone calling themselves 'Kiss' who operates many pay to click and parked sites. From the article: 'Reached by telephone, Kiss says that his registration name is false and declines to reveal the real one. He says he's the 23-year-old son of computer technicians and has studied finance. He owns about 20 paid-to-read sites, he says, as well as 200 parked sites stuffed with Google and Yahoo advertisements ... He claims to take in $70,000 in ad revenue a month, but says that only 10% of that comes from PTRs. The rest, he says, reflects legitimate clicks by real Web surfers. He refrains from more PTR activity, he claims, because it's no good for advertisers, no good for Google, no good for Yahoo." -
Will the Wii Work?
Today BusinessWeek is running an article asking Will Nintendo's Wii Strategy Score? With the Tokyo Game Show this week, they run down the trials facing Nintendo's little-box-that-could both here in the States, and in Japan. From the article: "Few expect truly dedicated gamers to choose the Wii over the PS3 or Xbox. And ultimately, the advantage may go to Sony. Yuta Sakurai, an analyst at Nomura Securities in Tokyo, expects the PS3 to sell 71 million units by 2011, compared with 40 million units for the Wii. Microsoft, meanwhile, is planning a stripped-down version of the Xbox without a hard-disk drive and other accessories that will cost about $250 in Japan, where the U.S. software maker has endured disappointing results." -

Helping Other Big Brothers Go High Tech

On the one hand, there is the desire to increase exports to a country with which there is a trade imbalance. On the other hand, we face a situation in which the technology can be used to track dissidents and unauthorized religions. Restrictions have been enacted since the 1989 Tiananmen Square massacre to prevent exports intended to the Chinese security forces. However, the restrictions have been applied narrowly, and effectively prevent only low-tech exports such as handcuffs, helmets, fingerprint powder, and tear gas, while DB software, two-way radios, DNA analysis gear, and video probes, are allowed." -

Facebook Opening Up For The Public

Up until now, in order to join Facebook you had to be an alumnus from certain High Schools, Colleges, or companies. Soon, individuals living in any one of 500 'geographic regions' can sign up. From the article: "People who joined Facebook because it was primarily a school-focused network may feel that it's losing a key distinction. As with the 'news feed' announcement, reception to this overhaul will come down to how well Facebook communicates. For the average student at New York University, for instance, little changes. The only people who can browse his profile before were other NYU students and that will stay the same. The change simply allows for 500 new groups to form that all operate independently on the Facebook platform. No one can browse all 9 million registered users." Social Networking Goes Big Business
PreacherTom writes, "It is no secret that sites like Facebook and MySpace are big hits among students. Big business is catching on to their possibilities too. Even in the wake of online stalking scandals, companies such as JP Morgan Chase, Apple, and Burger King are building whole marketing campaigns around social networking sites, to the tune of an estimated $280 million in 2006. It appears to be working: take the King, for example, who has amassed more than 120,000 'friends' that opt (for rewards) to associate themselves with his profile." Unbox Too Restricted and Too Expensive?

Between the high cost of downloads, the sometimes-poor video quality and the restrictions required by movie studios, they're not predicting a huge hit. The service, called Amazon Unbox, offers downloads of movies and television shows, as well as digital movie rentals. YouTube Growing ... Like Cancer?

However, growth does not always equal profitability. Incorporation of ads risks their very base. If that were not enough, like Kazaa, they struggle with the Damocles' Sword of Litigation hanging over their head each day while bandwidth and server costs continue to rise. Is this phenomenal growth only rapidly killing our favorite video warehouse?" From the BusinessWeek article: "YouTube could easily alienate its users by overwhelming them with ads. And the startup has to figure out how to attract a broader group of marketers by filtering more for copyrighted or offensive videos and by creating more channels of similar content. Aware of the risks, YouTube co-founders Chad Hurley and Steve Chen are moving slowly to ramp up advertising. They have been wary of asking viewers to sit through a 30-second ad before a two- to three-minute clip. Instead, YouTube is developing new formats, like ones rolled out in August that let marketers build their own video channels or pay to place a video on YouTube's popular front page." -
Facebook Scrambles after Unexpected Privacy Fumble

This could be a case study for other social networking sites on how to avoid or deal with similar problems in the future." The letter goes on to say: "When we launched News Feed and Mini-Feed we were trying to provide you with a stream of information about your social world. Instead, we did a bad job of explaining what the new features were and an even worse job of giving you control of them. I'd like to try to correct those errors now.
When I made Facebook two years ago my goal was to help people understand what was going on in their world a little better. I wanted to create an environment where people could share whatever information they wanted, but also have control over whom they shared that information with. I think a lot of the success we've seen is because of these basic principles.
We made the site so that all of our members are a part of smaller networks like schools, companies or regions, so you can only see the profiles of people who are in your networks and your friends. We did this to make sure you could share information with the people you care about. This is the same reason we have built extensive privacy settings — to give you even more control over who you share your information with.
Somehow we missed this point with Feed and we didn't build in the proper privacy controls right away. This was a big mistake on our part, and I'm sorry for it. But apologizing isn't enough. I wanted to make sure we did something about it, and quickly. So we have been coding nonstop for two days to get you better privacy controls. This new privacy page will allow you to choose which types of stories go into your Mini-Feed and your friends' News Feeds, and it also lists the type of actions Facebook will never let any other person know about. If you have more comments, please send them over.
This may sound silly, but I want to thank all of you who have written in and created groups and protested. Even though I wish I hadn't made so many of you angry, I am glad we got to hear you. And I am also glad that News Feed highlighted all these groups so people could find them and share their opinions with each other as well.
About a week ago I created a group called Free Flow of Information on the Internet, because that's what I believe in — helping people share information with the people they want to share it with. I'd encourage you to check it out to learn more about what guides those of us who make Facebook. Do-It-Yourself Robotics

The fruit of a collaboration between Lego and the MIT Media Lab, the Toronto-based startup Playful Invention Company is offering the PicoCricket, "a kit of parts that can be used to build an infinite variety of robotic inventions. The kit contains an assortment of pom poms, pipe cleaners, and other craft materials reminiscent of a summer camp art period. It also includes a collection of Lego bricks and electronics: the Cricket "brain" and a motor, colored lights and a soundbox, a digital display, and an infrared beamer that allows the Cricket to communicate with a PC on which kids write the programs that control their invention's behavior. Perhaps the most important parts in the Cricket kit are the four sensors, which detect light, sound, touch, and electrical resistance. "It was lots of fun making things and controlling their action," says Grover Venkatasubramaniam (age 10). "The most fun was programming the robots. It felt like giving life to lifeless bodies."" -
Google to Sell Old News Articles
Krishna Dagli was one of a few people to note that Google is planning on selling old news. Or more accurately, scanning in 200 years of old newspapers, and selling people the ability to view the full text. They'll be using publications like the NYT and Time magazine. Summaries will be free, but the full article text will have a price. -
How Retailers Watch You
garzpacho writes, "With $30 billion lost to shoplifting and employee theft last year, retailers are turning to increasingly sophisticated electronic surveillance systems to fight theft. Some systems, like RFID tags, have been well-publicized by privacy advocates. Others are less well known: video surveillance systems are being tied to software that can recognize specific types of activity and identify individuals; and data-mining software is being used to analyze everything from shoppers' habits to irregular register activity." From the article: "Despite this revolution in retail tech, you won't find many stores bragging about their new security tools. No one wants to tip off shoplifters or advertise that they suspect their customers. That's why so much of the technology is hidden in the first place. But another reason stores don't talk much about surveillance is that they know it sparks concerns about privacy. Consumer groups and legislators have opposed the spread of RFID and video surveillance for just that reason."
