At one point, Richard Garriott declared himself to be ruler of the moon, based on him being the only non-government entity to own anything physically on the moon.

The key difference, in my opinion, is you purchased the property from somewhere, you didn't have the ability to claim unused land for a nominal registration fee.

this is appealing and horrifying on a number of different levels

I think that if humans don't destroy themselves first something will happen to Earth naturally. Maybe the government already knows what is going to happen and isn't telling anyone. Maybe the sky will start to fall. The movie deep impact comes into mind.
Exploration is key to survival. You never know what we'll find or how many aliens we'll talk to

How will they pull this off? They won't. The Zhti Ti Kofft would never tolerate it! Besides, I don't think they really intend to. It is just another plot to scam investors like buying land on the moon. Former California Governor Jerry Brown was nicknamed "moonbeam" for falling for that scam. They are looking for suckers, and there is one born every minute.

Re:Too hard, give up.If a private consortium were to build a lunar base for mining purposes (a la the old O'Neill plan) asswipes in, say, the U.S. government might come to the conclusion that they rule the moon as well as the United States. Governments on Earth have no business trying to extend their domain off-Earth. The last goddamn thing I want to see is some nation or group of nations on Earth trying to impose their rule across the entire solar system.
Luckily, there's a treaty about that - namely Article VI of the 1967 U.N. Outer Space Treaty. Although that doesn't mean that all sorts of people have tried to claim ownership:

Yeah, their backup plan is to sell land rights like this to other planets. Except that the moon is already taken, so SCO is going to sell plots on Uranus.
