Legally, there's not a lot you can do about it: Copyright protects your icon, images, other creative resources, and source code. You automatically have copyright protection, but it's easy to evade with minor variations. App stores don't enforce it easily unless resources have been copied exactly. Trademarks protect names, logos, and slogans. They cover minor variations as well, and app stores enforce trademarks more easily, but they're costly to register and only apply in narrow areas.
Only assholes get patents. They can be a huge PR mistake, and they're a fool's errand: even if you get one ($20,000+ later), you can't afford to use it against any adversary big enough to matter. Don't be an asshole or a fool. Don't get software patents. If someone literally copied your assets or got too close to your trademarked name, you need to file takedowns or legal complaints, but that's rarely done by anyone big enough to matter. The Impossible Dream of USB-C (marco.org)
Marco Arment, a prominent developer best known for co-founding Tumblr, explains things that are still crippling USB-C, despite being around for years and being used in mainstream products. Arment writes: While a wide variety of USB-C dongles are available, most use the same handful of unreliable, mediocre chips inside. Some USB-A dongles make Wi-Fi drop on MacBook Pros. Some USB-A devices don't work properly when adapted to USB-C, or only work in certain ports. Some devices only work when plugged directly into a laptop's precious few USB-C ports, rather than any hubs or dongles. And reliable HDMI output seems nearly impossible in practice. Very few hubs exist to add more USB-C ports, so if you have more than a few peripherals, you can't just replace all of their cables with USB-C versions. You'll need a hub that provides multiple USB-A ports instead, and you'll need to keep your USB-A cables for when you're plugged into the hub -- but also keep USB-C cables or dongles around for everything you might ever need to plug directly into the computer's ports. Hubs with additional USB-C ports might pass Thunderbolt through to them, but usually don't. Sometimes, they add a USB-C port that can only be used for power passthrough. Many hubs with power passthrough have lower wattage limits than a 13-inch or 15-inch laptop needs. Fortunately, USB-C is a great charging standard. Well, it's more of a collection of standards. USB-C devices can charge via the slow old USB rates, but for higher-powered devices or faster charging, that's not enough current. -
Developer Marco Arment Shares Thoughts On iPhone X's Notch (marco.org)
Developer Marco Arment writes about the infamous notch on the iPhone X, which Apple has told developers to embrace rather than ignore: This is the new shape of the iPhone. As long as the notch is clearly present and of approximately these proportions, it's unique, simple, and recognizable. It's probably not going to significantly change for a long time, and Apple needs to make sure that the entire world recognizes it as well as we could recognize previous iPhones. That's why Apple has made no effort to hide the notch in software, and why app developers are being told to embrace it in our designs. That's why the HomePod software leak depicted the iPhone X like this: it's the new basic, recognizable form of the iPhone. Apple just completely changed the fundamental shape of the most important, most successful, and most recognizable tech product that the world has ever seen. -
MP3 Is Not Dead, It's Finally Free (marco.org)
The commentary around IIS Fraunhofer and Technicolor terminating their MP3 licensing program for certain MP3 related patents and software has been amusing. While some are interpreting this development as the demise of the MP3 format, others are cheering about MP3s finally being free. Developer and commentator Marco Arment tries to prevail sense: MP3 is no less alive now than it was last month or will be next year -- the last known MP3 patents have simply expired. So while there's a debate to be had -- in a moment -- about whether MP3 should still be used today, Fraunhofer's announcement has nothing to do with that, and is simply the ending of its patent-licensing program (because the patents have all expired) and a suggestion that we move to a newer, still-patented format. MP3 is supported by everything, everywhere, and is now patent-free. There has never been another audio format as widely supported as MP3, it's good enough for almost anything, and now, over twenty years since it took the world by storm, it's finally free. -

Technology critic Marco Arment, who co-hosts an Apple-centric podcast called ATP with John Siracusa and Casey Liss, has shared his take on the design of the recently launched MacBook Pro models. Apple's decision to get rid of USB Type-A ports has irked many, with some saying that the company should have left at least a few USB Type-A ports on the computer, even if what it strives to do is lead the industry in how a computer should look like. Arment shares the sentiment. From a blog post: The new MacBook Pro is probably great, and most of the initial skepticism probably won't age well. But I want to pick on one aspect today. Having four USB-C ports is awesome. Having only four USB-C ports is going to hurt the versatility requirement of pro gear, because there's a very real chance that you won't have the right dongle when you need it. This is going to happen a lot, because even though USB-C is the future, it's definitely not the present. We've had the standard USB plug (USB-A) in widespread use for 18 years, and it's going to take a few more years for USB-C to become so ubiquitous that we can get away without USB-A ports most of the time. A pro laptop released today should definitely have USB-C ports -- mostly USB-C ports, even -- but it should also have at least one USB-A port. Including a port that's still in extremely widespread use isn't an admission of failure or holding onto the past -- it's making a pragmatic tradeoff for customers' real-world needs. I worry when Apple falls on the wrong side of decisions like that, because it's putting form (and profitability) over function."Design for the future, but accommodate the reality of the present," he adds. -

It's almost unbelievable today that BlackBerry ruled the smartphone market once. The Canadian company's handset, however, started to lose relevance when Apple launched the iPhone in 2007. At the time, BlackBerry said that nobody would purchase an iPhone, as there's a battery trade-off. Wittingly or not, Apple could end up in a similar position to BlackBerry, argues Marco Arment. Arment -- who is best known for his Apple commentary, Overcast and Instapaper apps, and co-founding Tumblr -- says that Apple's strong stand on privacy is keeping it from being the frontrunner in the advanced AI, a category which has seen large investments from Google, Apple, Facebook, and Amazon in the recent years. He adds that privacy cannot be an excuse, as Apple could utilize public data like the web, mapping databases, and business directories. He writes: Today, Amazon, Facebook, and Google are placing large bets on advanced AI, ubiquitous assistants, and voice interfaces, hoping that these will become the next thing that our devices are for. If they're right -- and that's a big "if" -- I'm worried for Apple. Today, Apple's being led properly day-to-day and doing very well overall. But if the landscape shifts to prioritise those big-data AI services, Apple will find itself in a similar position as BlackBerry did almost a decade ago: what they're able to do, despite being very good at it, won't be enough anymore, and they won't be able to catch up. Where Apple suffers is big-data services and AI, such as search, relevance, classification, and complex natural-language queries. Apple can do rudimentary versions of all of those, but their competitors -- again, especially Google -- are far ahead of them, and the gap is only widening. And Apple is showing worryingly few signs of meaningful improvement or investment in these areas. Apple's apparent inaction shows that they're content with their services' quality, management, performance, advancement, and talent acquisition and retention. One company that is missing from Mr. Arment's column is Microsoft. The Cortana-maker has also placed large bets on AI. According to job postings on its portal, it appears, for instance, that Microsoft is also working on Google Home-like service. -

iTunes Turns 13 Today -- Continues To Be 'Awful' (qz.com)
An anonymous reader points us to a link on Quartz: On April 28, 2003, Apple started up a revolution. Enter the iTunes Music Store, unveiled with a proud flourish by a beaming Steve Jobs. It was a digital jukebox, a music distribution game-changer, a record store to end all record stores -- and it did, in fact, kill off a great number of those. [...] For 13 years -- 15 if you count the two years the program was just a file-storing service -- users have grumbled loudly about iTunes' unwieldy interface, its bloated features, its inability to simply get better. [...] Instead of trying to streamline the service over the years, Apple has opted to stuff an overwhelming number of new features -- movies, television shows, podcasts, mobile apps, and most recently, Apple Music -- into it.The report mentions the following issues with iTunes: space-sucking size, slowness, ugliness, bloatware, lack of online or social integration, a wonky back-end, music isn't even its priority. Marco Arment, who is best known for co-founding Tumblr, and creating Instapaper app, noted some development-end issues with iTunes in 2015. He wrote: [...] The iTunes Store back-end is a toxic hellstew of unreliability. Everything that touches the iTunes Store has a spotty record for me and almost every Mac owner I know. And the iTunes app itself is the toxic hellstew. iTunes has an impossible combination of tasks on its plate that cannot be done well. iTunes is the definition of cruft and technical debt. It was an early version of iTunes that demonstrated the first software bugs to Grace Hopper in 1946. Probably not coincidentally, some of iTunes' least reliable features are reliant on the iTunes Store back-end, including Genius from forever ago, iTunes Match more recently, and now, Apple Music. -
Apple Launches MacBook 2016 With Intel Skylake Processor, Longer Battery Life
Apple, on Tuesday, announced a refresh for its 12-inch MacBook laptop. The 2016 MacBook comes with an Intel Skylake processor -- sixth-generation dual-core Intel Core M model, offering up to 1.3 GHz clock speed with Turbo Boost speeds of up to 3.1 GHz, faster 1866 MHz memory, and a 'rose gold' color variant. Apple assures 10 hours of wireless Web browsing time, or 11 hours of movie playback on a single charge. The new model will hit retail stores on Wednesday. It starts at $1,299 for the 256GB SSD and 8GB (up from 4GB) version, and goes all the way up to $1,599 for the top-of-the-line model which offers 512GB SSD.
A couple of points: the first-generation MacBook didn't fare well with reviewers and plenty of users alike. Second, today's announcement also hints that the MacBook Air and the MacBook Pro lineups won't be getting the Intel Skylake upgrade for at least a few more months -- which is really sad, because, at present, they come equipped with almost three-year-old processor and graphics chips. No wonder, Oculus executive made fun of Apple's computers. -

Ad blocking apps rocketed to the top of the store's rankings, led by Marco Arment's Peace. A day afterward, Arment talked about the cognitive dissonance he felt from having his software blocking the (admittedly well-behaving) ads on his own website. Now, Arment has pulled Peace from the App Store, saying its success "just doesn't feel good." He continues, "Ad blockers come with an important asterisk: while they do benefit a ton of people in major ways, they also hurt some, including many who don't deserve the hit. Peace required that all ads be treated the same — all-or-nothing enforcement for decisions that aren't black and white. This approach is too blunt, and Ghostery and I have both decided that it doesn't serve our goals or beliefs well enough. If we're going to effect positive change overall, a more nuanced, complex approach is required than what I can bring in a simple iOS app." Arment also posted a link with detailed instructions on how to get a refund, if you already bought the app. -

One Day After iOS 9's Launch, Ad Blockers Top Apple's App Store
HughPickens.com writes: Sarah Perez reports at TechCrunch that only one day after the release of Apple's newly released version of Apple's mobile operating system, iOS 9, ad blockers are topping the charts in the App Store and it seems that new iOS 9 users are thrilled to have access to this added functionality. The Top Paid iOS app is the new ad-blocker Peace, a $2.99 download from Instapaper founder Marco Arment. Peace currently supports a number of exclusive features that aren't found in other blockers yet. Most notably, it uses Ghostery's more robust blocklist, which Arment licensed from the larger company by offering them a percentage of the app's revenue. "I can't believe how many trackers are on popular sites," says Arment. "I can't believe how fast the web is without them." Other ad blockers are also topping the paid app chart as of today, including the Purify Blocker (#3), Crystal (#6), Blockr (#12). (Ranks as of the time of writing.) With the arrival of these apps, publishers and advertisers are fretting about the immediate impact to their bottom lines and business, which means they'll likely soon try to find ways to sneak around the blockers. In that case, it should be interesting to see which of the apps will be able to maintain their high degree of ad blocking over time.
It's no surprise that advertisers and publishers who make their money from advertising aren't exactly fans of blockers. What is surprising is that no one seemed to disagree with the argument that online ads have gotten out of control. "I think if we don't acknowledge that, we'd be fools," says Scott Cunningham, "So does that mean ad blockers are good or right? Absolutely not. Do we have an accountability and responsibility to address these things? Absolutely — and there's a lot that we're doing now." Harry Kargman agrees that in many cases, online ads have created "a bad consumer experience — from an annoyance perspective, a privacy perspective, a usability perspective." At the same time, Kargman says that as the industry works to solve these problems, it also needs to convince people that when you use an ad blocker, "That's stealing. It's no different than ripping music. It's no different than pirating movies." -
Tumblr Co-Founder: Apple's Software Is In a Nosedive
mrspoonsi writes Respected developer Marco Arment is worried about Apple's future. In a blog post, he writes, "Apple's hardware today is amazing — it has never been better. But the software quality has taken such a nosedive in the last few years that I'm deeply concerned for its future." Arment was CTO at Tumblr, before he left to start Instapaper. "Apple has completely lost the functional high ground," says Arment. "'It just works' was never completely true, but I don't think the list of qualifiers and asterisks has ever been longer." He blames Apple prioritizing marketing for the problems with Apple's software. Apple wants to have new software releases each year as a marketing hook, but the annual cycles of updating Apple's software are leading to too many bugs and problems, he says: I suspect the rapid decline of Apple's software is a sign that marketing has a bit too much power at Apple today: the marketing priority of having major new releases every year is clearly impossible for the engineering teams to keep up with while maintaining quality. Maybe it's an engineering problem, but I suspect not — I doubt that any cohesive engineering team could keep up with these demands and maintain significantly higher quality." -
The Subtle Developer Exodus From the Mac App Store
An anonymous reader writes: Milen Dzhumerov, a software developer for OS X and iOS, has posted a concise breakdown of the problems with the Mac App Store. He says the lack of support for trial software and upgrades drives developers away by preventing them from making a living. Forced sandboxing kills many applications before they get started, and the review system isn't helpful to anyone. Dzhumerov says all of these factors, and Apple's unwillingness to address them, are leading to the slow but steady erosion of quality software in the Mac App Store.
"The relationship between consumers and developers is symbiotic, one cannot exist without the other. If the Mac App Store is a hostile environment for developers, we are going to end up in a situation where, either software will not be supported anymore or even worse, won't be made at all. And the result is the same the other way around – if there are no consumers, businesses would go bankrupt and no software will be made. The Mac App Store can be work in ways that's beneficial to both developers and consumers alike, it doesn't have to be one or the other. If the MAS is harmful to either developers or consumers, in the long term, it will be inevitably harmful to both." -
U2 and Apple Collaborate On 'Non-Piratable, Interactive Format For Music'
Squiff writes U2 and Apple are apparently collaborating on a new, "interactive format for music," due to launch in "about 18 months." (A direct interview is available at Time, but paywalled.) Bono said the new tech "can't be pirated" and will re-imagine the role of album artwork. Marco Arment has some suitably skeptical commentary: "Full albums are as interesting to most people today as magazines. Single songs and single articles killed their respective larger containers. ... This alleged new format will cost a fortune to produce: people have to take the photos, design the interactions, build the animations, and make the deals with Apple. Bono’s talking point about helping smaller bands is ridiculous ... There's nothing Apple or Bono can do to make people care enough about glorified liner notes. People care about music and convenience, period. As for “music that can’t be pirated”, I ask again, what decade is this? That ship has not only sailed long ago, but has circled the world hundreds of times, sunk, been dragged up, turned into a tourist attraction, went out of business, and been gutted and retrofitted as a more profitable oil tanker." -
Is the App Store Broken?
A recent post by Instapaper's Marco Arment suggests that design flaws in Apple's App Store are harming the app ecosystem, and users are suffering because of it. "The dominance and prominence of 'top lists' stratifies the top 0.02% so far above everyone else that the entire ecosystem is encouraged to design for a theoretical top-list placement that, by definition, won’t happen to 99.98% of them." Arment notes that many good app developers are finding continued development to be unsustainable, while scammy apps are encouraged to flood the market.
"As the economics get tighter, it becomes much harder to support the lavish treatment that developers have given apps in the past, such as full-time staffs, offices, pixel-perfect custom designs of every screen, frequent free updates, and completely different iPhone and iPad interfaces. Many will give up and leave for stable, better-paying jobs. (Many already have.)" Brent Simmons points out the indie developers have largely given up the dream of being able to support themselves through iOS development. Yoni Heisler argues that their plight is simply a consequence of ever-increasing competition within the industry, though he acknowledges that more app curation would be a good thing. What strategies could Apple (and the operators of other mobile application stories) do to keep app quality high? -
MplayerX Leaving Mac App Store
New submitter technonono writes "MplayerX, a popular and free video player app on Mac OSX, is now leaving Mac App Store 'after arguing with Apple for three months.' The developer claims that Apple's sandboxing policies would strip the app into 'another lame Quicktime X,' which is unacceptable. The app is releasing updates on its own site, where users who bought it from the App Store would most likely never notice them. The situation was 'foretold' by Marco Arment, at least for one app." -
Twitter Restricts Client Developers
New submitter atsabig10fo writes "Twitter has finally released the hinted-at changes to their API, which include limiting the number of users for third party clients, per-endpoint rate limiting, and restrictions on how tweets can be displayed and posted. Twitter's Michael Sippey wrote, 'One of the key things we've learned over the past few years is that when developers begin to demand an increasingly high volume of API calls, we can guide them toward areas of value for users and their businesses. To that end, and similar to some other companies, we will require you to work with us directly if you believe your application will need more than one million individual user tokens.' Third party app developers are certainly going to be sweating these changes, and it puts the future of new development in question." -

And nearly everyone who’s been burned by sandboxing exclusions — not just the affected apps’ developers, but all of their customers — will make the same choice with their future purchases. To most of these customers, the App Store is no longer a reliable place to buy software.' OS X Mountain Lion Review

Quoting: "Despite the oft-cited prediction that Mac will eventually be subsumed by iOS, that's not what's happening here. Apple is determined to bring the benefits of iOS to the Mac, but it's equally determined to do so in a way that preserves the strengths of the Mac platform. Where we Mac nerds go wrong is in mistaking traditions for strengths. Loss aversion is alive and well in the Mac community; with each 'feature' removed and each decision point eliminated from our favorite OS, our tendency is to focus heavily on what's been lost, sometimes blinding ourselves to the gains. But the larger problem is that losses and gains are context-dependent. A person who never uses a feature will not miss it when it's gone. We all pay lip service to the idea that most users never change the default settings in software, but we rarely follow this through to its logical conclusion. The fact is, we are not the center of the market, and haven't been for a long time. Three decades ago, the personal computer industry was built on the backs of technology enthusiasts. Every product, every ad was created to please us. No longer. Technology must now work for everyone, not just 'computing enthusiasts.'" App Store Bug Corrupts Binaries; Angry Birds Crash

Throwing Out Software That Works

Should this succeed, cautions Dave Winer, we may be entering an era of deliberate degradation of the user experience and throwing overboard of software that works, for corporate reasons. Already, Winer finds himself having to go to a desktop machine if he wants to view web content that's inaccessible with his iPhone and iPad. 'There was no bottleneck for software in the pre-iPad netbooks,' he writes. 'It matters. What I want is the convenient form factor without the corporate filter. It's way too simplistic to believe that we'll get that, but we had it. That's what I don't like — deliberate devolution.'"
