Time to Review FAA Gadget Policies
Nick Bilton, Lead Technology writer for The New York Times Bits Blog, called the FAA to complain about its gadget policies on flights and got an unexpected reply. Laura J. Brown, deputy assistant administrator for public affairs, said that it might be time to change some of those policies and promised they'd take a “fresh look” at the use of personal electronics on planes. From the article: "Yes, you read that correctly. The F.A.A., which in the past has essentially said, 'No, because I said so,' is going to explore testing e-readers, tablets and certain other gadgets on planes. The last time this testing was done was 2006, long before iPads and most e-readers existed. (The bad, or good, news: The F.A.A. doesn’t yet want to include the 150 million smartphones in this revision.)" -
After 244 Years, the End For the Dead Tree Encyclopedia Britannica

How To Crash the US Justice System: Demand a Trial
Hugh Pickens writes "The U.S. Bill of Rights guarantees the accused basic safeguards, including a fair and speedy jury trial, but in this era of mass incarceration — when our nation's prison population has quintupled in a few decades — these rights are, for the overwhelming majority of people hauled into courtrooms across America, theoretical. More than 90 percent of criminal cases are never tried before a jury, in part because the Supreme Court ruled in 1978 that threatening someone with life imprisonment for a minor crime in an effort to induce him to forfeit a jury trial did not violate his Sixth Amendment right to trial. 'The truth is that government officials have deliberately engineered the system to assure that the jury trial system established by the Constitution is seldom used,' says Timothy Lynch, director of the criminal justice project at the libertarian Cato Institute. Now Susan Burton, head of 'A New Way of Life' (PDF), is helping to start a movement to demand restoration of Americans' basic civil and human rights by asking people who have been charged with crimes to reject plea bargains, and press for trial. 'Can we crash the system just by exercising our rights?' Burton says if everyone charged with crimes suddenly exercised his constitutional rights, there would not be enough judges, lawyers or prison cells to deal with the ensuing tsunami of litigation." -
Open Source Advocates' Attitudes Toward Profit

Nuclear Disaster In Japan Could Have Been Mitigated, Say Industry Insiders
Hugh Pickens writes "Some insiders from Japan's tightly knit nuclear industry have stepped forward to say that Tepco and regulators had for years ignored warnings of the possibility of a larger-than-expected tsunami in northeastern Japan, and thus failed to take adequate countermeasures, such as raising wave walls or placing backup generators on higher ground. 'March 11 exposed the true nature of Japan's postwar system, that it is led by bureaucrats who stand on the side of industry, not the people,' says Shigeaki Koga, a former director of industrial policy at the Ministry of Economics, Trade and Industry. Eight years ago, as a member of an influential cabinet office committee on offshore earthquakes in northeastern Japan, Kunihiko Shimazaki, professor emeritus of seismology at the University of Tokyo, warned that Fukushima's coast was vulnerable to tsunamis more than twice as tall as the forecasts of up to 17 feet put forth by regulators and Tepco, but government bureaucrats running the committee moved quickly to exclude his views from debate as too speculative and 'pending further research.' Then in 2008, Tepco's own engineers made three separate sets of calculations that showed Fukushima Daiichi could be hit by tsunamis as high as 50 feet. 'They completely ignored me in order to save Tepco money,' says Shimazaki." -

At the wedding reception the next day, Mama Garriott shook her robootie on the dance floor, encircled by kids and family. Telepresence robots aren't just for the likes of Sergey Brin anymore — companies like VGo, Xaxxon, Willow Garage, and iRobot have introduced personal-presence robots that range in price from $270 for a simple model to $50,000 for a machine that allows doctors to diagnose illnesses remotely. Japan's Nuclear Energy Industry Nears Shutdown

With the last operating reactor scheduled to be idled as soon as next month, Japan — once one of the world's leaders in atomic energy — will have at least temporarily shut down an industry that once generated a third of its electricity. With few alternatives, the prime minister, Yoshihiko Noda, has called for restarting the plants as soon as possible, saying he supports a gradual phase-out of nuclear power over several decades. Yet, fearing public opposition, he has said he will not restart the reactors without the approval of local community leaders." -

Hugh Pickens writes "The NY Times reports that people who read ebooks on tablets like the iPad are beginning to realize that while a book in print is straightforward and immersive, a tablet is more like a 21st-century cacophony than a traditional solitary activity offering a menu of distractions that can fragment the reading experience, or stop it in its tracks. 'The tablet is like a temptress,' says James McQuivey. 'It's constantly saying, "You could be on YouTube now." Or it's sending constant alerts that pop up, saying you just got an e-mail. Reading itself is trying to compete.' There are also signs that publishers are cooling on tablets for e-reading. A recent survey by Forrester Research showed that 31 percent of publishers believed iPads and similar tablets were the ideal e-reading platform; one year ago, 46 percent thought so. Then there's Jonathan Franzen, regarded as one of America's greatest living novelists, who says consumers have been conned into thinking they need the latest technology and that e-books can never have the magic of the printed page. 'I think, for serious readers, a sense of permanence has always been part of the experience. Everything else in your life is fluid, but here is this text that doesn't change.'" -
Chevy Volt Meets High Resistance, GM Suspends Sales

Back when GM launched the beleaguered electric car, it boldly targeted sales of 10,000 in 2011 and 60,000 in 2012 but GM only sold 7,671 Volts in 2011 and just 1,626 so far this year. 'We needed to maintain proper inventory and make sure that we continued to meet market demand,' says GM spokesman Chris Lee. 'We see positive trends, but we needed to make this market adjustment.' Although President Obama promised he would buy a Volt 'five years from now, when I'm not president anymore,' the Volt has come under criticism from Republicans in Congress because of reports of its batteries catching on fire during testing. Ironically, the shutdown comes as gas prices are soaring, exactly the time when an electric car should be an easy sell." If it's still true that GM was taking a loss on every Volt sold, perhaps this is a blessing in disguise. -

FCC Inquires Into Its Own Authority To Regulate Communication Service Shutdowns
New submitter DnaK writes "The Federal Communications Commission is reviewing whether or when the police and other government officials can intentionally interrupt cellphone and Internet service to protect public safety. A scary proposition which will easily become a First Amendment issue. Does the FCC have the authority to [regulate local or state authorities' decision to] take down cellular networks if they determine there is an imminent threat? The FCC is currently asking for public input (PDF) on this decision." According to the article, "among the issues on which the F.C.C. is seeking comment is whether it even has authority over the issue. The public notice asks for comment on whether the F.C.C. itself has legal authority over shutdowns of wireless service and whether it can pre-empt local, state or federal laws that prohibit or constrain the ability of anyone to interrupt service." Maybe they just don't like being upstaged by BART. -
In Theory And Practice, Why Internet-Based Voting Is a Bad Idea
A few countries, like Estonia, have gone for internet-based voting in national elections in a big way, and many others (like Ireland and Canada) have experimented with it. For Americans, with a presidential election approaching later this year, it's a timely issue: already, some states have come to allow at least certain forms of voting by internet. Proponents say online elections have compelling upsides, chief among them ease of participation. People who might not otherwise vote — in particular military personnel stationed abroad, but many others besides — are more and more reached by internet access. Online voting offers a way to keep the electoral process open to them. With online voting, too, there's no worry about conventional absentee ballots being lost or delayed in the postal system, either before reaching the voter or on the way back to be counted. The downsides, though, are daunting. According to RSA panelists David Jefferson and J. Alex Halderman, in fact, they're overwhelming. Speaking Thursday afternoon, the two laid out their case against e-voting.

Jefferson and Halderman have impressive credentials as analysts and critics of internet voting. Jefferson, a computer scientist at Lawrence Livermore National Laboratory, is chairman of the board of the Verified Voting Foundation, an NGO focused on promoting election integrity, and coauthor of a report that spurred the Department of Defense to withdraw for further consideration its then-plan for online voting, called SERVE, in 2004. Halderman takes a different, hands-on approach, demonstrating (along with his grad students at the University of Michigan) just how polling-station election machines and online voting system can be compromised. "I've probably hacked into and otherwise found vulnerabilities in more polling places than anyone else," he says.
Jefferson and Halderman are careful to define the key element of elections they're trying to expose as unfixably broken: namely, the delivery of completed ballots over the internet, whether that means a web app, email or some other conduit, without a voter-verified paper audit trail. Some kinds of election technology can move from the voting booth to the online world with less risk to the integrity of the election itself — for instance, distribution of blank ballots, or even online voter registration. "This isn't about keeping score of primaries, or gathering information about candidates, but actually voting," said Jefferson. The risk of hacked elections isn't just the possibility of political rivals trying to out-do each other, he said; ultimately, vulnerable election systems compromise national security and ballot secrecy. Even a few hundred votes may suffice to swing a House or Senate race, and that can have cascading consequences for control of elected bodies themselves. "Wherever there's a concentration of votes sufficient to swing a major election, there's a national security concern."
Why assume that election systems can be manipulated? And since paper ballots are not immune to questionable or downright fraudulent counts, why call out the electronic version in particular? In part, he says, because the structure of an electronic voting system is inherently complex, and because it's difficult if not impossible to roll back results if a compromise is suspected. Unlike paper ballots (and in the absence of a paper audit trail backing an electronic voting system), online vote gathering offers no good way to re-count. Jefferson laid out four major and overlapping areas of likely attacks on internet voting systems, any one of which could taint the results of an election.
First, individual voting jurisdictions are vulnerable to attack. (In the U.S., for federal elections, that essentially means counties, totaling more than 7000.) Even in local races, there can be billions of dollars at stake in high-population counties like Cook County or L.A. County. Vendors, both their networks and their source code, are also at risk. Assuming that even best efforts can keep the source code behind the handful of election-system vendors safe is a sucker's bet, Jefferson says. Even large companies with enormous security resources have been hacked, with source code a prime target, as happened to Google and 25 other firms in 2010 in a breach attributed to Chinese operatives. "Who knows if those [online voting software] vendors have already been penetrated? You wouldn't have any idea," said Jefferson.
Even if both local voting authorities and e-voting software vendors were themselves able to deflect all attacks, voters using an online voting system on their home or office PCs would still be at the mercy of the weakest link of the chain — the security of the machines available to them. Targeted malware could be used to present a different set of on-screen options to a voter than it actually sends back to the election counters. Because one of the protections of a secret ballot is to make available to voters proof that they voted but not how they voted, individuals who intended to selected candidate A would have no reason to know their vote was cast for candidate B instead. Malware could also simply vote without user interaction. It may not be election related, but a large fraction of PCs are already infected with some kind of malware, showing how big a problem this could be.
Finally, pure network attacks (or even errors) could disrupt the integrity of an election; exactly that kind of attack brought much of Estonia's online traffic to a halt in May 2007; lucky for Estonians that was not during an election, because Estonia is one of the few countries that has fully adopted online voting. Perhaps more chilling is the brief re-routing in April 2010 of 15 percent of the world's internet traffic through China.
Insecurity on the internet is itself a long-standing problem, so why the fuss? Unlike financial crime, such as credit card fraud, election fraud is hard to detect, and even harder to correct for, in large part because ballot secrecy is key to fair elections.
Voting is different. "Superficially, you'd think the transactions are very similar [to financial transactions], but underneath, all the issues are completely different. The privacy requirements are completely different, for example," says Jefferson. To prevent coerced voting, or simple vote selling, "You're allowed to tell anyone how you voted all you want, but you're not allowed to have proof of how you voted." Rolling back results to investigate suspected breaches is impossible, Jefferson says, without exposing the actual votes of individuals, at the very least to election officials.
Investigating financial crime online is the opposite; there, figuring out exactly who did what and when is the whole point, and the evidence is easy to find: if banking credentials are stolen, he said, "some account will go to zero." But in the case of elections, it's more likely that "the wrong people take office, and life goes on, and it's just never discovered."
And while no election fraud has yet been attributed to it, the trend is growing to institute the version of online voting that Jefferson calls "the worst idea ever" — voting by email. 33 states have modded their voting systems to accept in some cases PDFs of scanned ballots through ordinary e-mail to be entered by election workers. The numbers may be small (typically, this form of voting is limited to overseas voters, and in some cases voters are asked to acknowledge that their vote cannot be kept secret), but this allowance means that "e-mail voting is very widespread in the United States."
While Jefferson works through Verified Voting to influence policy makers to lay out the case against online voting, J. Alex Halderman, in his role as an assistant professor at the University of Michigan, turns theory into reality: he and his students break election systems (devices as well as software) in the U.S. and abroad to show just how easily a malicious attacker could do the same. He offered as an example of several of the ways electronic voting can fail his successful attack on an internet voting plan (see this earlier Slashdot story) that was to have been implemented in 2010 in the District of Columbia. The District had, with Federal grant money, designed an online voting system and already put it nearly into production, and had mailed PINs and voter ID numbers to voters in anticipation.
To D.C.'s credit, Halderman says, the election officials at least asked first for advice from security experts around the country, and invited them to test it in advance of using the system in an actual election, though mere days before the system was to have gone live. "It's not every day you're invited to hack into government computers without the threat of jail hanging over your head," says Halderman, who was attracted to the challenge of investigating the system itself, as well as curiosity about how the D.C. officials would respond to a system compromise.
Though Halderman says the Ruby on Rails-based system was written in "generally clean code," his team discovered a shell injection vulnerability which gave them access to the D.C. system (see his full paper as a PDF for the details), and immediately set about playing.
Web apps tend to be brittle, says Halderman, and D.C.'s was no exception. "App frameworks are written in ways that allow small mistakes to have big consequences," especially when vulnerabilities are often widely disseminated soon after discovery, and not always by white hat hackers like him.
"The first thing we did was steal all the important stuff," he says — credentials, keys, and more. Simply snooping on the data wasn't enough to fully demonstrate the problems in the system, though; the team replaced the information on all of the ballots as well, replacing the actual candidates with ones of their choice, offering up options like Hall 9000, and Bender for school board, and forced client machines to play the University of Michigan's fight song, before erasing the logs that would have allowed their intrusion to be properly analyzed by the system's administrators.
Their attack also led them to gain full access to a terminal server on the same network, and after they'd hacked into this ("using the default password from the owner's manual," Halderman notes) they noticed there was evidence in the logs of other attacks. In particular, some of the attacks appearing to originate in Iran and in China. While Halderman doubts these represent an attack specifically on the DC system voting system, the evidence of such attacks is "an illustration of how vulnerable things are."
Halderman acknowledges that voting in person, especially by electronic means, is far from foolproof, but he joins Jefferson in saying that online voting is categorically worse, and suggests that everyone who takes an interest in security or the mechanics of democratic elections raise the issues of privacy and security. His conclusion and advice for election officials in the U.S.: Voting online is a bad idea, and it simply can't be fixed in the foreseeable future. All the security problems of e-voting machines at polling stations apply directly to internet voting, too, which means that anyone on Earth can attack an online election.

The Specter of Gasoline At $5 a Gallon
Hugh Pickens writes "The NY Times reports that gas prices are already at record highs for the winter months — averaging $4.32 in California and $3.73 a gallon nationally. As summer approaches, demand for gasoline rises, typically pushing prices up around 20 cents a gallon. But gas prices could rise another 50 cents a gallon or more, analysts say, if the diplomatic and economic standoff over Iran's nuclear ambitions escalates into military conflict or there is some other major supply disruption. 'If we get some kind of explosion — like an Israeli attack or some local Iranian revolutionary guard decides to take matters in his own hands and attacks a tanker — than we'd see oil prices push up 20 to 25 percent higher and another 50 cents a gallon at the pump,' says Michael C. Lynch, president of Strategic Energy and Economic Research. A sharp rise in the prices of oil and gas would crimp the nation's budding economic recovery would cause big political problems at home for President Obama, who is already being attacked by Republican presidential candidates over gas prices and his overall energy policies. On the other hand, environmentalists see high gas prices as a helpful step toward the development of alternative energy. Secretary Treasury Steven Chu notably said in 2008 'we have to figure out how to boost the price of gasoline to the levels in Europe' to make Americans trade in their 'love affair with the automobile' for a marriage to mass transit. In the meantime President Obama is in a bind because any success in tightening sanctions on Iran could squeeze global oil supplies, pushing up prices and causing serious economic repercussions at home and abroad." -
Rearview Car Cameras Likely Mandated By 2014
Hugh Pickens writes "Every year around 17,000 people are injured and over 200 die in backover accidents involving cars, trucks and SUVs. Now the Chicago Tribune reports that the National Highway Traffic Safety Administration will send Congress a proposal mandating a rearview camera for all passenger vehicles starting in 2014. 'Adoption of this proposal would significantly reduce fatalities and injuries caused by backover crashes involving children, persons with disabilities, the elderly and other pedestrians,' says NHTSA in its proposal. But the technology won't come cheap. In its study, the NHTSA found that adding a backup camera to a vehicle without an existing visual display screen will probably cost $159 to $203 per vehicle, shrinking to between $58 and $88 for vehicles that already use display screens. Toyota of Albany Sales manager Kelvin Walker says he believes making backup cameras standard on cars made after 2014 is a good idea. 'If you want to get a backup camera with a mirror in it now, it may cost you $700 to $800 as an additional dealer option or you have to purchase a navigation which is about $1,500 to $1,600. So $1,600 compared to $200? You do the math.'" -
Yahoo Unfriends Facebook With Aggressive Patent Demands

Yahoo, unlike the Sopranos, is using IP as its muscle to collect its IPO-protection money: 'We must insist that Facebook either enter into a licensing agreement [for 10-20 Yahoo-owned patents] or we will be compelled to move forward unilaterally to protect our rights,' Yahoo explained in a statement alerting the NY Times to its demand. Yahoo issued a similar last-minute threat to Google on the eve of its 2004 IPO, prompting Google to pony up 2.7 million shares to settle Yahoo's patent lawsuit. Inventor of the Modern Pinball Machine Dies At 100

NYC To Release Teacher Evaluation Data Over Union Protests
langelgjm writes "Bringing a lengthy legal battle to a close, New York City's Department of Education will today release detailed evaluation reports on individual English and math teachers as a result of a request under public information laws. The city's teachers union has responded with full page ads (PDF) decrying the methodology used in the evaluations. The court's decision attempts to balance the public interest in this data against the rights of individual teachers. Across the country, a large number of states are moving to evaluate teachers based on student performance in an attempt to raise student achievement in the U.S." -
Mozilla Partners Up With LG To Combat Apple and Google

While the Marketplace will play an important role in keeping Firefox in step with Chrome, these apps will actually play a far more important role: Boot to Gecko (B2G), Mozilla's upcoming smartphone and tablet OS, will also use the Marketplace. For B2G to succeed it must have apps, and to create apps you need developers. That's why, at MWC, according to a source close to the matter, Mozilla will also be announcing that it has partnered up with LG to make a developer-oriented B2G-powered mobile device. Even more interestingly, Brendan Eich, Mozilla's Chief Technology Officer, says that it will unveil other partners at MWC as well — probably carriers, who are eager to use the open B2G and its Marketplace to escape the huge control that Apple and Google currently exert in the smartphone space." -

Are Smartphones Starting a Boom In DIY Medicine?

The NY Times has an article about attachments to the iPhone for tracking blood sugar and blood pressure. There are also glorified web cams that take pictures of your ear drum, teeth or eyes to save you a trip to the doctor's. Some people are tracking the changes in their moles with an iPhone App. Is this the beginning of Med 2.0?" Odd as it sounds, I was able to be more quickly and reliably diagnosed with Lyme disease last fall because I'd taken some pictures on my phone of the lesion I'd wrongly thought was the result of a spider bite. Any camera would have worked, but I had my camera-equipped phone with me, rather than any other kind. -

Hugh Pickens writes "BBC reports that a growing body of evidence from both science and history suggests that eight-hours of uninterrupted sleep may be unnatural as a wealth of historical evidence reveals that humans used to sleep in two distinct chunks called first and second sleep. A book by historian Roger Ekirch, At Day's Close: Night in Times Past, unearths more than 500 references to a segmented sleeping pattern — in diaries, court records, medical books and literature, from Homer's Odyssey to an anthropological account of modern tribes in Nigeria. 'It's not just the number of references — it is the way they refer to it, as if it was common knowledge,' says Ekirch. References to the first and second sleep started to disappear during the late 17th Century with improvements in street lighting, domestic lighting and a surge in coffee houses — which were sometimes open all night. Today most people seem to have adapted quite well to the eight-hour sleep, but Ekirch believes many sleeping problems may have roots in the human body's natural preference for segmented sleep which could be the root of a condition called sleep maintenance insomnia, where people wake during the night and have trouble getting back to sleep. 'Our pattern of consolidated sleep has been a relatively recent development, another product of the industrial age, while segmented sleep was long the natural form of our slumber, having a provenance as old as humankind,' says Ekrich, adding that we may 'choose to emulate our ancestors, for whom the dead of night, rather than being a source of dread, often afforded a welcome refuge from the regimen of daily life.'" -
Google Heads Up Display Coming By the End of the Year

According to the NY Times' sources, the device will be available later this year, and sell for prices comparable to smartphones. 'The people familiar with the Google glasses said they would be Android-based, and will include a small screen that will sit a few inches from someone’s eye. They will also have a 3G or 4G data connection and a number of sensors including motion and GPS. ... The glasses will have a low-resolution built-in camera that will be able to monitor the world in real time and overlay information about locations, surrounding buildings and friends who might be nearby, according to the Google employees. The glasses are not designed to be worn constantly — although Google expects some of the nerdiest users will wear them a lot — but will be more like smartphones, used when needed.'" -

Now Laurie Tarkan writes that as eyes age, less and less sunlight gets through the lens to reach key cells in the retina that regulate the body's circadian rhythm, its internal clock that rallies the body to tackle the day's demands in the morning and slows it down at night, allowing the body to rest and repair. 'Evolution has built this beautiful timekeeping mechanism, but the clock is not absolutely perfect and needs to be nudged every day,' says Dr. David Berson, whose lab at Brown University studies how the eye communicates with the brain. Dr. Patricia Turner, an ophthalmologist who with her husband, Dr. Martin Mainster has written extensively about the effects of the aging eye on health, estimate that by age 45, the photoreceptors of the average adult receive just 50 percent of the light needed to fully stimulate the circadian system, by age 55, it dips to 37 percent, and by age 75, to a mere 17 percent and recommend that people should make an effort to expose themselves to bright sunlight or bright indoor lighting when they cannot get outdoors and have installed skylights and extra fluorescent lights in their own offices to help offset the aging of their own eyes. 'In modern society, most of the time we live in a controlled environment under artificial lights, which are 1,000 to 10,000 times dimmer than sunlight and the wrong part of the spectrum,' says Turner. 'We believe the effect is huge and that it's just beginning to be recognized as a problem.'" -

The Silene stenophylla is the oldest plant ever to be regenerated, the researchers said, and it is fertile, producing white flowers and viable seeds. ... Adam Weinstein writes that the Office of Secure Transportation (OST) employs nearly 600 couriers to move bombs, weapon components, radioactive metals for research, and fuel for Navy ships and submarines between a variety of labs, reactors and military bases. Hiding nukes in plain sight and rolling them through major metropolitan centers raises a slew of security and environmental concerns, from theft to terrorist attack to radioactive spills. 'Any time you put nuclear weapons and materials on the highway, you create security risks,' says Tom Clements, a nuclear security watchdog for Friends of the Earth. For security, cabs are fitted with custom composite armor and lightweight armored glass, a redundant communications system that links the convoys to a monitoring center in Albuquerque, and the driver has the ability to disable the truck so it can't be moved or opened. The OST hires military veterans, particularly ex-special-operations forces (PDF), who are trained in close-quarters battle, tactical shooting, physical fitness, and shifting smoothly through the gears of a tractor-trailer. But accidents happen. In 1996, a driver flipped his trailer on a two-lane Nebraska hill road after a freak ice storm, sending authorities scrambling to secure its payload of two nuclear bombs; and in 2003, two trucks operated by private contractors had rollover accidents in Montana and Tennessee while hauling uranium hexafluoride, a compound used to enrich reactor and bomb fuel." -

How Companies Learn Your Secrets

Now the NY Times Magazine reports on how companies like Target identify those unique moments in consumers' lives when their shopping habits become particularly flexible and the right advertisement or coupon can cause them to begin spending in new ways. Among life events, none are more important than the arrival of a baby, and new parents are a retailer's holy grail. In 2002, marketers at Target asked statisticians to answer an odd question: 'If we wanted to figure out if a customer is pregnant, even if she didn't want us to know, can you do that?' Specifically, the marketers said they wanted to send specially designed ads to women in their second trimester, which is when most expectant mothers begin buying all sorts of new things, like prenatal vitamins and maternity clothing. 'We knew that if we could identify them in their second trimester, there's a good chance we could capture them for years,' says statistician Andrew Pole. 'As soon as we get them buying diapers from us, they're going to start buying everything else too.' As Pole's computers crawled through the data, he was able to identify about 25 products that, when analyzed together, allowed him to assign each shopper a 'pregnancy prediction' score and he soon had a list of tens of thousands of women who were most likely pregnant. About a year after Pole created his pregnancy-prediction model, a man walked into a Target outside Minneapolis and demanded to see the manager. He was clutching coupons that had been sent to his daughter, and he was angry. 'My daughter got this in the mail!' he said. 'She's still in high school, and you're sending her coupons for baby clothes and cribs? Are you trying to encourage her to get pregnant?' The manager apologized and then called a few days later to apologize again but the father was somewhat abashed. 'It turns out there's been some activities in my house I haven't been completely aware of. She's due in August. I owe you an apology.'" -
Former Goldman Programmer's Conviction Overturned

Scientists Study How Little Exercise You Need
Hugh Pickens writes "Millions of Americans don't engage in much exercise, if they complete any at all and asked why, a majority of respondents, in survey after survey, say, 'I don't have time.' Now Gretchen Reynolds reports that instead of wondering just how much exercise people really need in order to gain health and fitness, a group of scientists in Canada are turning that issue on its head and asking, how little exercise do we need to maintain fitness and the answer appears to be, a lot less than most of us think — provided we're willing to work a bit. Most people have heard of intervals, or repeated, short, sharp bursts of strenuous activity, interspersed with rest periods. Almost all competitive athletes strategically employ a session or two of interval training every week to improve their speed and endurance. Researchers have developed a version of high-intensity interval training (HIIT) that involves one minute of strenuous effort, at about 90 percent of a person's maximum heart rate (which most of us can estimate, very roughly, by subtracting our age from 220), followed by one minute of easy recovery. The effort and recovery are repeated 10 times, for a total of 20 minutes and the interval training is performed twice a week. Despite the small time commitment of this modified HIIT program, after several weeks of practicing it, both the unfit volunteers and the cardiac patients showed significant improvements in their health and fitness. 'A growing body of evidence demonstrates that high-intensity interval training can serve as an effective alternate to traditional endurance-based training, inducing similar or even superior physiological adaptations in healthy individuals and diseased populations, at least when compared on a matched-work basis.'" -

99.8% Security For Real-World Public Keys
An anonymous reader writes "If you grab all the public keys you can find on the net, then you might expect to uncover a few duds — but would you believe that 2 out of every 1000 RSA keys is bad? This is one of the interesting findings in the paper 'Ron was wrong, Whit is right' by Lenstra, Hughes, Augier, Bos, Kleinjung and Wachter. Quoting from the paper's abstract: 'We performed a sanity check of public keys collected on the web. Our main goal was to test the validity of the assumption that different random choices are made each time keys are generated. We found that the vast majority of public keys work as intended. A more disconcerting finding is that two out of every one thousand RSA moduli that we collected offer no security. Our conclusion is that the validity of the assumption is questionable and that generating keys in the real world for "multiple-secrets" cryptosystems such as RSA is significantly riskier than for "single-secret" ones such as ElGamal or (EC)DSA which are based on Diffie-Hellman.'" For a layman's interpretation of the research, the NY Times has an article about the paper. Update: 02/15 01:34 GMT by S : Security researcher Dan Kaminsky has commented on the paper, saying that while the survey work itself is good, it doesn't necessarily support the paper's thesis. He writes, "On the most basic level, risk in cryptography is utterly dominated, not by cipher selection, but by key management. The study found 12,720 public keys. It also found approximately 2.94 million expired certificates. And while the study didn’t discuss the number of certificates that had no reason to be trusted in the first place (being self signed), it did find 5.4M PGP keys. It does not matter the strength of your public key if nobody knows to demand it." -
"Liberated" Tunisia Still Censoring Websites
Frequent Slashdot contributor Bennett Haselton writes "Tunisia's high court will decide on Wednesday whether to allow censoring of websites containing pornography or 'calls to violence.' It's disappointing that censorship continues in post-revolutionary Tunisia, but it's enough of an improvement over the old regime, that anti-censorship cyber-activism efforts would probably best be spent on helping other countries." Read on for Bennett's analysis.In Tunisia, where dictator Zine El Abidine Ben Ali was ousted one year ago amid hopes for a new era of freedom, the high court will decide on Wednesday whether to censor foreign pornographic websites in accordance with local law. Facebook pages that "call for violence" may also be blocked. Conveniently, all the machinery for censoring the Internet in Tunisia is already in place, having been installed under Ben Ali's dictatorship for the purposes of censoring and spying on Tunisian citizens (and, for a while, phishing their Facebook passwords). The irony recalls the situation in Iraq in 2009, when the government announced plans to start censoring foreign websites -- to which Iraqi citizens complained that they thought censorship would end with the fall of Saddam's regime. Actually, apart from the three outlier countries of Turkey, Israel and Lebanon, pornography remains illegal in every Middle Eastern country (and some conservative African nations), including the recently "liberated" ones including Egypt, Iraq and Tunisia. (Although, Iraq's street market in pornography thrives as long as the police have better things to do.)
I'm against such censorship in principle -- I think that even the right to publish and access pornography counts as a fundamental human right. But I think we have to take what progress we can get, and censoring just pornography and calls to violence, is a big improvement over censoring pornography and dissident political speech, which is the norm in most non-"liberated" Middle Eastern countries like Syria, Iran, and Saudi Arabia. Syria blocks foreign opposition sites like All4Syria.info, Iran blocks Facebook and YouTube to keep dissidents from posting or viewing anti-government material, and Saudi Arabia blocks Reporters Without Borders and filters the Amnesty International report on human rights in Saudi Arabia (but not the rest of the Amnesty International site!).
Saudi Arabia blocking the Amnesty International report on human rights in their country (while leaving the rest of the site unblocked), in particular, seems like the kind of thing that a government would do more as a "fuck you" to human rights activists, than a means to achieve a practical goal. For one thing, most of the facts in the human rights report about Saudi Arabia -- about sex discrimination and lack of political and religious freedom -- are already well known to the people who live there. And secondly, what percent of the citizens of a country would ever read the Amnesty International report on human rights in that country, even if it were not blocked? How many Americans even know that Amnesty puts out an annual report about human rights violations in the United States? So it seems more like a symbolic move to remind everyone who's in charge. For all the disappointment in the lack of progress for free speech in post-"liberation" countries, the non-"liberated" ones are indeed worse.
As for the Tunisian proposal to censor "calls to violence", I wouldn't always be against that, even in principle. In most countries, direct incitements to violence can be considered illegal (it depends on what you say and, of course, on what judge you get). In a developing country rife with ethnic tensions, even greater restrictions on calls to violence could be justified. When you finally watched Hotel Rwanda , weren't you hoping someone would bust in on that radio DJ telling everyone to kill Tutsis in the middle of a civil war, and blow him to hell? The biggest problem with a rule against "calls to violence" is that the government could stretch the definition to silence political speech. But it's possible to keep that kind of abuse in check, as has mostly been achieved in the U.S. For that, what you need is an independent judiciary, not an abolishment of all rules against calls to violence.
So the free-speech situation in "liberated" Tunisia may be nothing to write home about, but it sounds much better than it used to be, when writing home to complain about it could get you arrested. A Wall Street Journal article from July 2011 describes how, under Ben Ali's dictatorship, Tunisian cyber-activist Slim Amamou had been imprisoned and abused by the police for calling for peaceful demonstrations. Post-revolution, he was freed and asked to join the interim government, where the strictest restriction placed on him was to "stop sending Twitter messages during internal government meetings to his 25,000 followers". They may not have their porn, but that's still progress.
Of course, if someone in Tunisia wants to circumvent the government filters (using tools like proxy sites, VPNs, Tor, UltraSurf, Psiphon, etc.) and get to a porn site, more power to them. I just wouldn't make it a priority to set aside resources to help them get it. Not while there are Iranians who need help getting around the latest restrictions blocking them from Facebook and Gmail.
Two caveats. First, if someone wants to sell circumvention services to Tunisians who just want to get around the porn blocker, that doesn't count as "setting aside resources", so that's a perfectly noble endeavor. In fact, given the economies of scale in the circumvention business, selling to Tunisians could help to bring the price down for other users, including users in countries like Saudi Arabia where the government does engage in political filtering, and where circumvention services could be a tool for social change. Second, providing circumvention services (free or paid) to Tunisians, does probably make it less likely that the new government would revert to political censorship, knowing that many of its citizens have the tools to beat it, even if those tools are only currently used to access porn sites. So to that extent, setting aside resources to provide circumvention services in Tunisia might be a worthwhile cause.
Still, I think it's a lot less important than using circumvention tools to fight political censorship in truly autocratic countries like Iran. For the next generation of proxy servers that I'm rolling out, I'm working on setting aside some of them just for Iranian IP addresses. Even if Iranians just use them to get on Facebook, that's still contributes more to advancing the cause of social democracy, than Tunisians using them to get on Playboy.

Hugh Pickens writes "What may once have sounded like the behavior of a raving paranoid is now considered standard operating procedure for officials at American government agencies, research groups and companies as the NY Times reports how businesses sending representatives to China give them a loaner laptop and cellphone that they wipe clean before they leave and wipe again when they return. 'If a company has significant intellectual property that the Chinese and Russians are interested in, and you go over there with mobile devices, your devices will get penetrated,' says Joel F. Brenner, formerly the top counterintelligence official in the office of the director of national intelligence. The scope of the problem is illustrated by an incident at the United States Chamber of Commerce in 2010 when the chamber learned that servers in China were stealing information from four of its Asia policy experts who frequently visited China. After their trips, even the office printer and a thermostat in one of the chamber's corporate offices were communicating with an internet address in China. The chamber did not disclose how hackers had infiltrated its systems, but its first step after the attack was to bar employees from taking devices with them 'to certain countries,' notably China. 'Everybody knows that if you are doing business in China, in the 21st century, you don't bring anything with you,' says Jacob Olcott, a cybersecurity expert at Good Harbor Consulting. 'That's "Business 101" — at least it should be.'" -
Sale Or License? Sister Sledge Sues Over ITunes
Hugh Pickens writes "The Hollywood Reporter reports that members of the iconic disco-era musical group Sister Sledge have filed a major class action lawsuit against Warner Music Group claiming that the music giant's method for calculating digital music purchases as 'sales' rather than 'licenses' has cheated them out of millions of dollars from digital music sales. Songwriters typically make much less money when an album is 'sold' than they do when their music is 'licensed' (the rationale derives from the costs that used to be associated with the physical production of records) but record labels have taken the position that music sold via such digital stores as iTunes should be counted as 'sales' rather than licenses. The difference in revenue can be significant as Sister Sledge claim their record deal promises 25 percent of revenue from licenses but only 5-1/2% to 6-1/2% of net from sales. Eminem's publisher brought a nearly identical claim against Universal Music Group and won an important decision at the 9th Circuit Court of Appeals in 2010 when the 9th Circuit ruled that iTunes' contract unambiguously provided that the music was licensed. The lawsuit argued that record companies' arrangements with digital retailers resembled a license more than it did a sale of a CD or record because, among other reasons, the labels furnished the seller with a single master recording that it then duplicated for customers. 'Unlike physical sales, where the record company manufactures each disc and has incremental costs, when they license to iTunes, all they do is turn over one master,' says attorney Richard S. Busch. 'It's only fair that the artist should receive 50 percent of the receipts.'" -
The Zuckerberg Tax

Miller writes that when Facebook goes public later this year, Mark Zuckerberg plans to exercise stock options worth $5 billion of the $28 billion that his ownership stake will be worth and since the $5 billion he will receive will be treated as salary, Zuckerberg will have a tax bill of more than $2 billion making him, quite possibly, the largest taxpayer in history. But how much income tax will Zuckerberg pay on the rest of his stock that he won't immediately sell? Nothing, nada, zilch. He can simply use his stock as collateral to borrow against his tremendous wealth and avoid all tax. That's what Lawrence J. Ellison, the chief executive of Oracle, did, reportedly borrowing more than a billion dollars against his Oracle shares to buy one of the most expensive yachts in the world. Or consider the case of Steven P. Jobs who never sold a single share of Apple after he rejoined the company in 1997, and therefore never paying a penny of tax on the over $2 billion of Apple stock he held at his death. Now Jobs' widow can sell those shares without paying any income tax on the appreciation before his death — only on the increase in value from the time of his death to the time of the sale — because our tax system is based on the concept of "realization." Individuals are not taxed until they actually sell property and realize their gains and the solution to the problem is called mark-to-market taxation. According to Miller, mark-to-market would only affect individuals who were undeniably, extraordinarily rich, only publicly traded stock would be marked to market, and a mark-to-market system of taxation on the top one-tenth of 1 percent would raise hundreds of billions of dollars of new revenue over the next 10 years." -

Finding Lost Recording From the 1880s

'In June 1889, Edison sent Wangemann to Europe, initially to ensure that the phonograph at the Paris World’s Fair remained in working order. After Paris, Wangemann toured his native Germany, recording musical artists and often visiting the homes of prominent members of society who were fascinated with the talking machine. Until now, the only available recording from Wangemann’s European trip has been a well-known and well-worn cylinder of Brahms playing an excerpt from his first Hungarian Dance. That recording is so damaged "that many listeners can scarcely discern the sound of a piano, which has in turn tarnished the reputations of both Wangemann and the Edison phonograph of the late 1880s," Dr. Feaster said. "These newly unearthed examples vindicate both."'" -

The studies indicate it's not a virus, but a distorted protein called Tau which moves from cell to cell. Further, the discovery 'may now offer scientists a way to move forward and develop a way to block tau's spread in Alzheimer's patients, said Karen Duff, a researcher at Columbia's Taub Institute for Research on Alzheimer's disease and co-author of one study published Wednesday in the journal PLoS One. "It's enlightening for us because it now provides a whole other area for potential therapeutic impact," said Duff. "It's possible that you can identify the disease and intervene (with potential tau-blocking drugs) before the dementia actually sets in."'" -

Defending Your Cellphone Against Malware
Hugh Pickens writes "Kate Murphy writes that as cellphones have gotten smarter, they have become less like phones and more like computers, and that with more than a million phones worldwide already hacked, technology experts expect breached, infiltrated or otherwise compromised cellphones to be the scourge of 2012. Cellphones are often loaded with even more personal information than PCs, so an undefended or carelessly operated phone can result in a breathtaking invasion of individual privacy as well as the potential for data corruption and outright theft. But there are a few common sense ways to protect yourself: Avoid free, unofficial versions of popular apps that often have malware hidden in the code, avoid using Wi-Fi in a Starbucks or airport which leaves you open to hackers, and be wary of apps that want permission to make phone calls, connect to the Internet or reveal your identity and location." Pickens continues: "One common ruse is a man-in-the middle attack when a target receives a text message that claims to be from his or her cell service provider asking for permission to 'reprovision' or otherwise reconfigure the phone's settings due to a network outage or other problem. Don't click 'O.K.' Call your carrier to see if the message is bogus. For the more paranoid, there are supersecure smartphones like the Sectéra Edge by General Dynamics, commissioned by the Defense Department for use by soldiers and spies which may soon be available to the public in the near future. Simple questions, like whether the police should have the right to pull over autonomous vehicles, have yet to be answered and legal scholars and government officials warn that society has only begun wrestling with laws required for autonomous vehicles. The big question remains legal liability for the designers and manufacturers as some point out that liability exemptions have been mandated for vaccines, which are believed to offer great value for the general health of the population, despite some risks. 'Why would you even put money into developing it?' says Gary E. Marchant, director of the Center for Law, Science and Innovation at the Arizona State University law school. 'I see this as a huge barrier to this technology unless there are some policy ways around it.' Congress could consider creating a comprehensive regulatory regime to govern the use of these technologies say researchers at the Rand Corporation adding that while federal preemption has important disadvantages, it might speed the development and utilization of these technologies (PDF) and should be considered, if accompanied by a comprehensive federal regulatory regime. 'This may minimize the number of inconsistent legal regimes that manufacturers face and simplify and speed the introduction of these technologies.'" -

Rapid7 says they could 'easily read a six-digit password from a sticky note over 20 feet away from the camera' and 'clearly hear conversations down the hallway from the video conferencing system.' With some systems, they could even capture keystrokes being typed in the room. Teleconferencing vendors defended their security, saying the auto-answer feature that left those system vulnerable was an effort to strike the right balance between security and usability." -
How the US Lost Out On iPhone Work

Today, almost all of the 70 million iPhones, 30 million iPads and 59 million other products Apple sold last year are manufactured overseas. 'It isn't just that workers are cheaper abroad,' write Charles Duhig and Keith Bradsher. 'Rather, Apple's executives believe the vast scale of overseas factories as well as the flexibility, diligence and industrial skills of foreign workers have outpaced their American counterparts so much that "Made in the U.S.A." is no longer a viable option for most Apple products.' Apple executives say that going overseas, at this point, is their only option and recount the time Apple redesigned the iPhone's screen at the last minute, forcing an assembly line overhaul. A foreman immediately roused 8,000 workers inside the company's dormitories, and then each employee was given a biscuit and a cup of tea, guided to a workstation and within half an hour started a 12-hour shift fitting glass screens into beveled frames. Within 96 hours, the plant was producing over 10,000 iPhones a day. 'The speed and flexibility is breathtaking,' says one Apple executive. 'There's no American plant that can match that.' Apple's success has benefited the U.S. economy by empowering entrepreneurs and creating jobs at companies like cellular providers and businesses shipping Apple products. But ultimately, Apple executives say curing unemployment is not Apple's job. 'We don't have an obligation to solve America's problems. Our only obligation is making the best product possible.'" -
NYPD Developing Portable Body Scanner For Detecting Guns
Zothecula writes "You have to feel sorry for the police officers who are required to frisk people for guns or knives — after all, if someone who doesn't want to be arrested is carrying a lethal weapon, the last thing most of us would want to do is get close enough to that person to touch them. That's why the New York Police Department teamed up with the United States Department of Defense three years ago, and began developing a portable scanner that can remotely detect the presence of a gun on a person's body. The NYPD announced the project this week."
