He didn't violate the ToS. Search it. The term spam doesn't occur anywhere therein. What IS covered is disrupting the service (such as posting lots of spammy content). However, that is not what happened here.
In other words, he didn't access a computer system without authorization, or exceed the authorized level of access. So much for the CFAA. You might actually want to read it some time.

Trade group USTelecom CEO Jonathan Spalter said in an op-ed Friday for website Axios that individual "browser history is already being aggregated and sold to advertising networks - by virtually every site you visit on the internet."

Has anyone read Slashdot's T&C? There are some onerous things in there, too. It's not exactly short or easy to understand. This is pretty common, unfortunately. And Slashdot is no better.

Not with a bang, but with a beta.
I have visited this website on a near-daily basis for over a decade. I have greatly benefited from its community, whether +5 Insightful or -1 Troll. It thus saddens me to watch Slashdot be changed into a bland, cookie-cutter news site, a la the present incarnations of Engadget and Digg. I am perhaps in the minority in this, but I kindly urge you to read this post, and others like it, and to consider joining the week-long Slashcott that begins on Feb 10th. I realize that posting off-topic comments such as this is disrupting the Slashdot experience for many of you, and I do apologize for it. But can you honestly say that the new Beta interface does not already disrupt Slashdot for all of us? These anti-Beta posts can quite rightly be viewed as "a series of shock slogans and mindless token tantrums", to borrow a phrase, but since we feel that we are ignored by Dice, this is the best that I, like many other slashdotters, could come up with.
What company directs 25% of its users to a partially-working, not-ready-for-production website? Please realize that Beta will not have the features that we want, because they interfere with Dice's plans for Slashdot. Dice presents Slashdot to their advertisers as a "Social Media for B2B Technology" platform. B2B - that's the reason Beta looks like a generic wordpress-based news site. To be sure, a large precentage of Slashdotters work in IT, but Slashdot is most certainly not a B2B site.
Nevertheless, Dice is desperate to make money off of Slashdot, even at the cost of losing much of its current userbase. Turning Slashdot into a social platform for IT "decision makers" is a Haily Mary attempt to recoup the failed investment Dice made in buying Slashdot. As they have revealed in a press release detailing their performance in 2013, this acquisition has not lived up to their financial expectations:
Slashdot Media was acquired to provide content and services that are important to technology professionals in their everyday work lives and to leverage that reach into the global technology community benefiting user engagement on the Dice.com site. The expected benefits have started to be realized at Dice.com. However, advertising revenue has declined over the past year and there is no improvement expected in the future financial performance of Slashdot Media's underlying advertising business. Therefore, $7.2 million of intangible assets and $6.3 million of goodwill related to Slashdot Media were reduced to zero.
The new Beta interface is not the result of a superficial makeover. Keeping in mind that Dice felt confident enough to present it as the new face of Slashdot to 25% of its visitors, it is safe to say that the new commenting and moderation system is exactly how they intended it to be. It is a new design that deliberately cripples the one thing that makes Slashdot what it is today, viz. thebest commenting and moderation system online today. From the users' perspective, there is nothing wrong with Slashdot that demands gutting its foundations and dumping the one part of Slashdot we exactly like. Interesting. I cruised around the site a little and found this bit about the "psychology" of social engagement. Maybe somebody at Slashdot is using this to try to understand us... so they can design Beta to be more "engaging". If so, I think they've got us figured all wrong.

It's interesting that this includes Slashdot... mostly because any conclusions you might draw from it will be horribly wrong if you're trying to understand the Slashdot community. I think I see now where some of the design imperatives driving the Beta site are coming from, and unfortunately, they might end up driving away all the people that actually create the content.

You're really not getting it.
The people who contribute to slashdot right now have very clear expectations. No slick bs on the front page, show whole summaries, UTF-8, high contrast, fluid layout, use my whole widescreen monitor, javascript optional, show all user info on comments, make the comment UI unimpeachable.
These are the expectations of people that make Slashdot worth visiting _at all_. You've been told this many, many times since announcing the beta.
These design goals may not meet the expectations of new or casual users of other sites or iphones. Well guess what? If you compromise the design of slashdot to cater to these people which add no value to the site then you alienate your core contributor. Users use slashdot for the community in spite of the perceived-backwardness of the boring older-style web UI and judging by active posters with high IDs who also complained they grow accustomed to it.
All of the people that Slashdot Media loves to talk about here: http://slashdotmedia.com/about... Those 4000+ commenters a day that are the supposed value add to Slashdot?

The classic design in 2014? Not too bad. The classic design in 2018? Probably not going to cut it.
Your point is moot: there won't even *be* a slashdot in 2018. Slashdot had a good run but the beginning of the end was when Malda left, and dice is *entirely clueless* about what slashdot really is.
Dice can certainly *try* to market the slashdot brand in this fashion since they own it now, but this strategy will fail. There is absolutely no doubt about that.

... you know it's going to be good." LOL."Intuitive menus" that feature prominently the desolate ghettos that are the new "Channels," SlashBI, SlashCloud, etc. The rest is just a randomly sorted list of "popular topics."
"Social media integration" Oh, they've got Facebook spy bugs now! Too bad those dumb little buttons are probably blocked by a fairly large contingent of the userbase has those sad little abominations blocked (bonus points for IPTables or HOSTS based solutions!) they seem to exist solely to provide free advertising for cheap, lazy entities and to vigorously ejaculate banal content around the internet, like a giant mug of frothy, steaming semen. For god's sake, the stopwatch on my phone has a share feature, so you can litter your facebook with "My time is 00:01:22."
To top it all off, the tour ends with the text "The New Slashdot. Newsier. Nerdier." What the hell is so nerdy about a rotten abortion of an update that, so far as I can tell, the community nearly unilaterally despises? Hey advertisers! Come pay to advertise on a site that just alienated it's user base!

After looking at how dice.com sells slashdot http://slashdotmedia.com/about... it's not hard to guess that the whole redesign is just for revenue purposes. And a good looking site just sells better to media morons.
I'm doubtful that the boycott will work but it's a good way of giving dice the finger.

People not logged in have had to jump through hoops to avoid beta. At first it was redirecting (server side) which you could fix with a firefox extension to stop redirects or by deleting the pertinent cookie. I'm not sure how or if they are still shuttling people there. Likely, they feel more entitled to put ACs there or something.
As to you logging in, that is you just agreeing to be another corporation's bitch:
