When the cable company got the right of way to build out the system in your town it was governed by your local cable commission(at least in the North East of the US). Basically saying what they could and could not do, what services they had to provide (ie Public access facilities and the likes) Maybe its time to tap those people in this instance if it is deemed that they are in violation of their contract with your town then the cable commission can levee fines and revoke the right of ways ( at least in the town I lived in). the cable company, in this case TW, will have to sell and move out of the town/city. If your cable commission members do not comply with the request of the constituents then I'm not sure what the recourse would be. but it is nice to know that there is some recourse locally.
Stop being a dumb L33T3 (or really dumb paper tiger) and actually do something positive for the IT portion of the world. Your type of attitude needs to leave the IT industry, you leave a bad taste in the mouths of the ones that think IT is just overhead.

umm no you dont have to ever go through a public server if your routing is set up correctly in your client/server setup -- if you are already stopping IM via - non-install/network protocol/routing restrictions then your half way there. Any FOSS package you decide to install you can apply those restrictions/rules.

Seriously if your data is that important to the daily operations of your business then off site with third party vendor that specializes in archiving is the only way to go it removes some of the liability from you as a whole if they are the ones to let your system be compromised
Generally the places they keep the medium in a place thats more secure than a bank(our vendor has an old silo with armed guards in an undisclosed location and yea I've been there).
If this is to pricey then you should probably rent a safe deposit box and as part of the routine rotate the tapes
