What exactly is your point here? That certificates are worthless and shouldn't be used? (They aren't) That they are overused? (possibly). What's the alternative here anyways? two factor auth? I mean, I'm trying hard to find value in your post, but I'm not getting a lot of good points out of it. People misuse certs for sure, but that doesn't mean that as an authentication mechanism that they are useless.

Based on the context it was more then just accessing publicly available data. It's not as if he clicked on an link and went "Oh, look, a bunch oh e-mail addresses!". There was effort involved into getting to that list.

That being said, even if he did run into a bunch of e-mail addresses by being in the wrong place at the wrong time.. e-mailing that list to someone and going "OMG LOOK AT THIS" was proof that he knew the seriousness of the list he found. It cannot be argued that he did not know what he was doing.

Thats still too much for buffer. 512 megabits is 64 megabytes. Still more likely that it's for processing

We are arguing about symantics. my point is: This is more then just a couple webcams and a couple of mics. We could debate about the symantics till the cows come home, but at the end of the day there are no hardware solutions that quite reproduce what the kinect does. It's worth hacking.
